On February 6, 1986, we renewed general permit No. SAWC080-N-
000-0291 (enclosed), which provides Federal authorization for
construction activities that receive authorization from the State
of North Carolina.
A review of your application received May 8, 1986, for a
Department of the Army permit to construct and backfill a bulkhead
in a barge slip off the Pamlico River, north of Aurora, Beaufort
County, North Carolina, indicates it to be a candidate for Federal
authorization under this general permit. Accordingly, the
administrative processing of your application will be accomplished
by the North Carolina Division of Coastal Management. Comments
from Federal review agencies will be furnished to the State.
If your application must be withdrawn from this general permit
process for any reason, you will be written and informed of its
further management. If there are no unresolved differences of
State-Federal positions or policy, the final action taken on your
application by the State will result in your receiving written
notice from us that your application has been successfully
processed under our general permit. Only after receiving such
confirmation should you begin work.
Your application, pursuant to Section 10 of the River and
Harbor Act and Section 404 of the Clean Water Act, has been
assigned No. SAWC086-N-007-0285 and will be coordinated by Mr. Ken
Jolly. He is available to address questions or comments you may

Enclosed is the application of Texasgulf Chemicals Company,
represented by Mr. Douglas Mercer, for a Department of the Army
permit and a State Water Quality Certification to construct and
backfill a bulkhead on a barge slip off the Pamlico River, north
of Aurora, Beaufort County, North Carolina. Your receipt of this
letter verifies your acceptance of a valid request for
certification in accordance with Section 325.2(b)(ii) of our
administrative regulations.
We are considering authorization of the proposed activity
pursuant to Section 404 of the Clean Water Act, and we have
determined that a water quality certification may be required
under the provisions of Section 401 of the same law. A Department
of the Army permit will not be granted until the certification has
been obtained or waived.
In accordance with our administrative regulations, 60 days
after receipt of a request for certification is considered a
reasonable time for State action. Therefore, if your office has
not acted on the request by July 14, 1986, the District Engineer
will deem that waiver has occurred.

Dear Charlie,
Attached for your consideration is an application to
construct a bulkheaded finger and pave an area in our
existing bargeslip.
As shown,the bulkheaded finger pier will be constructed
of sheet piling and filled with rejects and/or sand from the
mining activities.
The area adjacent to the existing bulkhead will be
paved with asphalt. The paving will be done to reduce
maintenance problems in this area and provide an all weather
surface for equipment working in the area.

General Statute 113-229 requires that riparian landowners with property
adjoining a proposed project of the type covered therein be given thirty (30) days
in which to comment on the project. This form enables the adjacent riparian land-
owner to express either (1) that he objects to the project or, (2) that he does not
object and desires to waive his right to the 30-day period so that the processing of
the application can move along more quickly. Of course, the adjacent riparian
landowner need not sign this form at all, if he so chooses.

Dear Mr. Mercer:
Reference your application for a Department of the Army
permit to maintain a barge channel and slip on the Pamlico River,
north of Aurora, Beaufort County, North Carolina.'
Your proposal has been reviewed and found to be consistent
with the provisions and objectives of general permit No. SAWC080-
N-000-0291. Therefore, you may commence construction activity in
strict accordance with applicable State authorization and
Robert M. Chiles Engineers and Consultants' Drawings Nos. DOG-008-
020B and DOG-008-026A and Texasgulf drawing entitled "Civil-Barge
Slip Area 45 Proposed Maintenance Dredging Existing Barge Slip-
Vicinity", dated 18 July 1985. Failure to comply with the State
authorization or conditions of the general permit could result in
a violation of Federal law.
If any change in your work is required because of unforeseen
or altered conditions or for any other reason, plans revised to
show the change must be sent promptly to this office and the N. C.
Division of Coastal Management prior to performing any such change
or alteration. Such action is necessary as revised plans must be
reviewed and the authorization modified.

Reference the application of Texasgulf Chemicals Company,
represented by Mr. Douglas G. Mercer, for a Department of the Army
permit to place riprap material along the shorelines of South and
Bond Creeks to provide protection for Clay Pond No. 1, near
Aurora, Beaufort County, North Carolina.
The Federal agencies have. completed review of the proposal as
presented by the application and your field investigation report.
We recommend that the following conditions be included in the
State authorization:
a. The riprap material will be placed and aligned in strict
accordance with the permit plans.
b. The riprap material will be free from toxic pollutants in
toxic amounts. Only clean material free of waste metal products,
organic materials, and unsightly debris will be used.
c. The fill, the riprap material, will be properly
maintained.

3. Project summary The applicant is prooosing to perform maintenance excavation by dredge
and/or clamshell in two areas within the existing barge channel on the Pamlico River.

Environmental settin
At the Texasgulf plant site on the Pamlico River is the company's barge channel which
is used daily for transporting products. The channel is + 2000' long and averages
+ 300' wide. Most of the channel has a water depth of -12 feet to -16 feet at normal
water. These depths are adequate for barge traffic. Two areas, one in the southeast
corner, the other in the southwest corner, (see plat) do not have adequate water
depths. In these areas are water depths of -6 feet to -9 feet at normal water.
Much of the barge channel is bulkheaded and the channel contains various piers and
product loading and unloading equipment.
On the east side of the existing barge channel is a dike disposal.area which has been
used for the placement of spoils from the slip maintenance in the past. At the present
time the area contains a dense growth of Phragmites. Surrounding the disposal area is
the barge channel on the west, the Pamlico River on the north, the Lee creek outfall
ditch on the east and the company's highground storage area on the south. Since the
disposal area was last used, considerable riprap has been placed at its toe along
the Pamlico River in an effort to retard erosion. All of the shoreline has been
riprapped except for a short section at the northeast corner and a section on the
east side. These areas are presently being done and work should be ocopleted by
1 June 1985.
A recent survey of the disposal area (see plat) shows a top dike elevation of + 17',
and based on engineering review, the dike appears to be stable. It is estimated that
if the decant spillway is set at an elevation of 13 feet that the disposal area will
have a capacity of 52,700 cubic yards of materials with three feet freeboard. Two
decant pipes are presently in place, one entering the barge channel, the other the
Lee Creek outfall ditch.
Project proposal
The applicant is proposing to maintain by 8" dredge and possibly clamshell, two areas
within the barge channel (see plat). The areas are irregularly shaped and have been
previously described. The proposal is to maintain Area "A" (see plat) with a hydraulic
dredge to a depth of -12 feet at normal water. The spoils will be pumped to the diked
disposal area, and only the decant pipe entering the barge slip will be used.
Approximately 11,000 cubic yards of materials will be removed from this area.
Also proposed is to maintain Area "B" (see plat) with a clamshell or hydraulic dredge,
to a depth of -12 feet at normal water. The spoils again will be pumped to the diked
disposal area if the dredge is used, however, if the clamshell is used, the spoils
will be trucked to the company's mine. Approximately 3000 cubic yards of materials will
be removed from this area.
Environmental impact
The project as proposed should have a minimal environmental impact. The riprap work
which has been completed and which is ongoing, has added to the stability of the dikes
surrounding the disposal area, however, "muskrat" problems may still exist. It
appears that the disposal area has over three times the capacity of the materials
proposed to be placed'in it.

With close monitoring during dredging operations of the solid levels, and of the
decant structures, the project should be oompleted with minimal environmental
impacts.
No wetland vegetation will be excavated or filled except for the Phragmites growing
in the disposal areas.

Attached for your consideration is an application to
conduct maintenance dredging in Texasgulf's existing bargeslip.
Maintenance work in this area was performed under CAMA
Permit 90-73 and Corp Permit SAWKS 75-07-03-503 in 1980, and
the drawing used in those permit applications have been
modified (red-shading) to indicate the areas in which dredging
is currently needed.
We plan to use the existing spoil area adjacent to the
bargeslip for the disposal of the material removed by the dredge.
A report by R. M. Chiles, P.E. indicating the available storage
capacity of the disposal area is attached for your information.
As we have discussed, rip-rapping of short sections of the
spoils area dike will be completed prior to startup of the
dredge. We plan to use an 8" dredge owned and to be operated by
Gwin Engineering, Inc. of Belhaven, N. C. We expect the dredge
to operate approximately eight hours per day until the project
is completed.

With dike decant spillway set at 13.5 feet, the total. computed dredging
operation (water and solids) should be retained within the dike. With
the decant set at 13.0 feet to maintain three (3) feet freeboard, the
retention time for this operation will be approximately eight (8) days
initially.
3. SPOIL AREA CAPACITY
As of March 15, 1985 - 52,700 cu. yds.
Subsequenct to Dredging - 41,700 cu. yds.*
*This does not include volume of fill that could be placed in areas
within spoil dike that were submerged at the March 1985 survey.
4. MAINTENANCE DREDGING PROCEDURE-
It is our understanding that the dredge will operate on an eight (8)
hour per.day basis with anticipated production rate of 2700 gpm with
202 solids. The material to be excavated from the head of the barge
slip is 11,000 cubic yards. With the decant overflow set at 13.0 feet
elevation the excavation should be essentially completed prior to
any discharge to the Pamlico River. In the event that the solids
production is below that 202 projected, the retention time of the
dredge effluent should still be sufficient. Care must be taken in
selection of the dredge pipeline discharge point into the spoil
area to prevent short circuit of flow to the decant within the pond.

The intended hydraulic dredging of area "A" as shown on reference (b)
will result in returning the water depth to the full 12 foot and
also will expand the slip area northward 200 feet as shown within
area "A". The approximate 3000 cubic yards of material located
within area "B" can be removed by shore or barge based clam shell
machine as you have proposed, however the alternative of utilizing
the hydraulic dredge in this area also is feasible. The spoil site
could easily accept this additional yardage without problem in our
opinion although some slip equipment blockage will require careful
scheduling.
CONCLUSION
A. The barge slip dredge spoil area will be of sufficient volume for use
when conducting maintenance dredging operations with an 8 inch
hydraulic dredge.
B. Visual examination of the spoil area dike does not indicate problems
with the structural stability of the dike during the above proposed
operations. If some questions in this area arises, soil borings
of the dike core for further analysis will be required and are
recommended to asure the success of the work.

Reference the application of Texasgulf Chemical Company for a
Department of the Army permit to maintain a barge channel and slip
on the Pamlico River, north of Aurora, Beaufort County, North
Carolina.'
The Federal agencies have completed review of the proposal as
presented by the application and your field investigation report.
We recommend that the following conditions be included in the
State authorization:
a. All excavated materials will be confined landward of the
normal water elevation contour within adequate dikes or other
retaining structures to prevent spillover of solids into any marsh
or surrounding waters.
b. The terminal end of the pipeline from the dredge into the
diked retention area will be positioned at or greater than 50 feet
from any part of the dike and at a maximum distance from spillways
to prevent dike erosion and to allow adequate settlement of
suspended solids.
c. A water control structure will be installed at the intake
end of the effluent pipe leading from the retention area in order
to ensure maximum settlement of suspended solids.

d. Flow from the diked retention area will be confined by
w, pipe, trough, or similar device to a point at or below the
elevation of normal water to prevent gully erosion and resultant
unnecessary siltation.
e. Excavation will not exceed 12 feet below the elevation of
normal water.

permit and a State Water Quality Certificationto accomplish work
off the Pamlico River, near Aurora, in Beaufort County, North
Carolina. Your receipt of this letter verifies your acceptance of
a valid request for'certification in accordance with Section
325.2(b)(ii) of our administrative regulations.
We are considering authorization of the proposed activity
pursuant to Section 404 of the Clean Water Act, and we have
determined that a water quality certification may be required
under the provisions of Section 401 of the same law. A Department
of the Army permit will not be granted until the certification has
been obtained or waived.
In. accordance with our administrative regulations, 60 days
after receipt of a request for certification, is considered a
reasonable time for State action. Therefore, if your office has
not acted on the request by February 1, 1985, the District
Engineer will deem that waiver has occurred.

which has settled since the basin was built in the late
1960's.
After the fill is placed, a dragline will be used to
remove approximately 1200 cubic yards of sand which has
filled the basin entrance. The material removed will be
trucked to the mine area for disposal.
