On July 8, 2008, Lauren Witherspoon from the DWQ Raleigh Regional Office conducted a site inspection for a
property located off at 1422 Mt. Carmel Church Road in Orange County. During the site inspection, Ms.
Witherspoon observed that approximately 555 linear feet of stream channel has been impacted by sediment
deposition measuring 8 inches to 3 plus feet in depth by land disturbing activities and approximately 400 linear
feet of stream channel has been impacted by the placement of a pipe. On July 14, 2008, a Notice of Violation was
issued for these violations.
A 401 Water Quality Certification (WQC) application dated October 16, 2008 was submitted to DWQ by McKim
& Creed (on behalf of William Blackwood) for the placement of the pipe in the stream. On December 31, 2008,
DWQ issued an after-the-fact 401 WQC for the pipe impacts.
On January 8, 2009, Ms. Witherspoon conducted a site inspection at the above referenced property and
determined that the removal of sediment from the stream channel was sufficient.
