Transcontinental Gas Pipe Line Company's (Transco) 85 North Expansion Project. We
recently submitted a completed copy of the new PCN form to the USACE Asheville
Regulatory Field Office. It is our understanding (after a phone conversation with Ian
McMillan on 04-20-09) that the Project will not require compensatory mitigation, due to
the Project only having temporary impacts to streams, and Transco's plan to restore
original contours within affected streams.

The Project area lies within an area that is relatively flat. Currently there are three existing Transco pipelines within their
maintained right-of-ways. The Project contains the following land uses: Agricultural Land 98.06 acres; Open Land 30.54
acres; Upland Forest 19.43 acres; Industrial/Commercial Land 4.89 acres; Residential Land 4.31 acres; Transportation
Corridors 3.17 acres; Managed Pine Forest 0.57 acre; and Open Water 0.96 acre.

This pipeline expansion will enable Transco to deliver natural gas more efficiently throughout its natural gas pipeline

The proposed Project consists of the following: addition of gas cooling fans at compressor station (Station) 150 in Iredell
County, compressor modifications at Station 155 in Davidson County, 8.25 miles of 42-inch natural gas pipeline along
Transco's existing mainline system, and the use of four contractor/pipe yards to aid in the construction of the proposed
pipeline loop in Iredell and Rowan Counties, NC. This proposed pipeline expansion project will be collocated along
Transco's existing maintained rights-of-way, which contain 3 existing natural gas pipelines. The only component of the
Project crossing waterbodies will be the pipeline portion. The types of equipment to be used during construction of the
Project include bulldozers, rotary trenching machines, track-mounted backhoes, tractor trailers, side boom cranes,
welders, pipe bending machines, and x-ray machines.

D. Impact Justification and Mitigation
1. Avoidance and Minimization
1a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project.
Transco has collocated the proposed Project along its existing ROWs which contain three of their pipelines. Although
there are stream crossings at angles less than 75° proposed due to the construction of the 85 North Expansion Project
there would be greater environmental impacts if the pipeline were to be located within a new ROW. Due to the length of
the proposed project there are stream crossings proposed that do cross two streams above the confluence of those
streams. The 85 North Expansion Project would result in greater environmental impacts if the pipeline were to be located
within a new ROW. Although Sills Creek is crossed twice by the proposed project, relocating the 85 North Expansion
Project to a new ROW would result in greater environmental impacts, such as clearing of forested areas, disturbing of
non-previously disturbed areas, the potential to impact wetland areas with the creation of a new ROW, and the potential
to impact additional streams with the creation of a new ROW.
1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques.
Construction activities at stream and river crossings will be in accordance with all federal, state and local regulations and
permit requirements. Whenever possible, pipeline construction at stream crossings will be conducted during low flow periods.
Construction during low flows will minimize sedimentation and turbidity, stream bank and bed disturbances, and limit the time
it takes to complete in-stream construction.
During construction, clearing, and grading of vegetative cover could increase erosion along stream banks. Compaction of
soils by heavy equipment near stream banks may accelerate erosion of the banks and the transportation of sediment carried
by stormwater runoff into waterbodies. To minimize these erosion impacts Transco will avoid stripping the bank vegetation,
except at bridge areas, until the time of crossing. Transco will install temporary equipment bridges to reduce the potential for
turbidity and sedimentation resulting from construction equipment and vehicular traffic crossing waterbodies for access along
the ROW. Equipment bridges will be constructed of timber mats, portable prefabricated bridges, or railcars. Equipment
bridges will be designed to accommodate normal to high stream flow and will be maintained to prevent restriction of flow
during the period of time the bridge is in use. To minimize sedimentation during pipeline construction across minor or
intermittent waterbodies, trench spoil will be placed at least 10 feet from the top of the bank, unless impractical due to
topography. Silt fence and/or straw/hay bales will be placed around the spoil piles to prevent spoil from flowing into the
waterbody. In-stream construction will generally be limited to 24 to 48 hours, thereby minimizing impacts by limiting the
duration of disturbance. Transco will implement provisions to set extra work areas 50 feet from the stream banks to the
maximum extent practicable and install temporary sediment barriers around disturbed areas. Once the pipe is placed in the
trench, the excavated material will be immediately replaced and the stream banks and streambed will be restored as close as
possible to their pre-construction contours. Upon completion of construction, Transco will install permanent erosion control
measures to protect the stream from erosion and/or sedimentation. Stream banks and riparian areas will be revegetated using
appropriate seed mixes to further stabilize the banks.

On behalf of our client, Transcontinental Gas Pipe Line Company, LLC, (Transco),
Perennial Environmental Services, LLC (Perennial) submits this letter and the attached
information as a Pre-Construction Notification (PCN) for Nationwide Permit 12 (NWP)
for Utility Line activities. The proposed Project is known as the 85 North Expansion
Project (Project) and will consist of the addition of a new pipeline loop, modifications to
an existing compressor station, and the use of one industrial site and three agricultural
areas as contractor/pipe yards within Iredell and Rowan Counties, North Carolina. The
Project area in Iredell County will include a small portion of the proposed pipeline loop,
compressor station modifications, and two pipe yards. Rowan County will contain the
remainder of the pipeline loop along with two yards. To assist you in your evaluation of

Proiect Description
Iredell County
Four Project areas are proposed within Iredell County, North Carolina. The first marks
the beginning of the Iredell Loop, and consists of approximately 0.25 miles of 42-inch
natural gas pipeline loop on Transco's mainline system. This portion of proposed
pipeline loop will cross State Highway 152 southeast of the intersection of 152 and
Brumley Road, and is located on the Mooresville, NC, United States Geological Service
(USGS) topographic quadrangle (Attachment 1). Two sites will be used as
contractor/pipe yards to aid in construction of the proposed Iredell Loop. The first site is
just to the east of Mooresville, and is located approximately 0.5 miles north of the
intersection of Brumley Road and Linwood Road. A 7.77-acre area will be utilized at
this site, and is located entirely within an agricultural field. The second site is located
just to the east of the intersection of State Highway 150 and 152, approximately 0.45
miles north of the proposed pipeline loop. The Project area consists of a 6.67-acre
construction area, and is located within a preexisting industrial site and open field. Both
Project areas are located on the Mooresville, NC, United States Geological Service
(USGS) topographic quadrangle (Attachment 1).
The final Project area is located approximately five miles southwest of the town of
Mooresville, and is just to the east of Interstate HWY 77 off of Transco Road. This
portion of the proposed Project is situated on a gently rolling landscape position within
Transco's Compressor Station 150 (Attachment 1). To facilitate various modifications at
the existing Compressor Station 150, a 3.17-acre construction area will be utilized. This
Project area is located on the Mooresville, NC, United States Geological Service (USGS)
topographic quadrangle (Attachment 1).
Rowan County
Three Project areas are proposed in Rowan County, North Carolina. The first consists of
the remaining 8.00 miles of Iredell Loop. Located approximately four miles east
northeast of the city of Mooresville, this portion of the proposed Project is situated on a
rolling landscape position within agricultural areas. As stated above, the pipeline loop is
proposed to start near the intersection of State Highway 152 and Brumley Road in Iredell
County, and end approximately 830 feet east of the intersection of Lyerly Road and Kerr
Mill Road in Rowan County. This portion of the Project area is located on the Salisbury,
NC, USGS topographic quadrangle and the Cleveland, NC, USGS topographic

quadrangle (Attachment 1). The entire Iredell Loop will contain a 99.81-acre
construction area, and will utilize 36.78 acres for extra workspace areas (EWA).
The other two Project areas within Rowan County will consist of the use of agricultural
areas as pipe yards to aid in construction of the Iredell Loop. The first proposed pipe
yard will be located adjacent to London Road. This site's 3.51-acre area is immediately
to the south of Transco's existing ROW in a soybean field. The other proposed pipe yard
is located within a corn field and consists of a 4.65-acre area. It is located near the
terminus of the proposed pipeline loop adjacent to Lyerly Road. The two Project areas
are located on the Salisbury, NC, USGS topographic quadrangle and the Cleveland, NC,
USGS topographic quadrangle (Attachment 1) respectfully.
Project Impact Summary
Perennial evaluated the Project area for "Waters of the United States", Threatened and
Endangered species, and cultural resources. The results of these evaluations are
presented below.
"Waters of the United States"
Perennial evaluated and mapped all wetlands and waterbodies within the Project area that
are subject to the jurisdiction of the USACE under Section 404 of the Clean Water Act.
Wetland surveys were conducted in accordance with the procedures established in the
USACE 1987 Wetlands Delineation Manual (USACE 1987). The results of this
evaluation are presented in the attachments to this cover letter.
In Iredell County, site visits were conducted on May 5, 2008 for the Iredell Loop, August
21, 2008 for Compressor Station 150, and December 17th-18th for the two contractor/pipe
yards. Site visits in Rowan County occurred from May 5th - May 8th, 2008 for the Iredell
Loop and August 21, 2008 for the two pipe yards.
Compressor Station 150 and all four proposed yards are located within upland areas and
do not contain any environmental features such as wetlands or waterbodies. Surveys at
the Iredell Loop revealed a total of 25 Jurisdictional "Waters of the United States" that
will be crossed during construction of the proposed Iredell Loop, including 23
waterbodies and two open waters. Please note that no wetlands will be impacted by the
85 North Expansion Project in North Carolina. No Jurisdictional waters will be impacted
as a result of auxiliary areas (i.e. access roads). Details regarding impacts to individual
waterbodies and open water are detailed in Table 1 (Attachment 2). The survey area
mapping, wetland data sheets, and photographic log have been included in the Wetland
Delineation Report which is provided as Attachment 4. Jurisdictional Determination
Forms were completed by Perennial staff for each of the impacted areas and are included
in Attachment 3.
Threatened and Endangered Species
Perennial conducted a threatened and endangered species assessment for the proposed
Project. Habitat assessments/surveys were conducted for state and federally listed
species potentially occurring in Iredell and Rowan Counties, North Carolina. This
assessment concluded that the project would either have no effect, or was not likely to
adversely affect any state or federally listed species. The assessment results are
documented in Table 2 (Attachment 2).
Cultural Resources
A report of the archeological and cultural resources investigation conducted by Florida
History, LLC will be submitted to the North Carolina State Historic Preservation Office
(NCSHPO) in Raleigh in January 2009. Results of the investigation revealed no
archeological sites eligible for National Listing within the proposed Project. A copy of
this report is provided upon submittal. The response from AHC will be provided upon
receipt.
Construction Procedures and Mitigation
Construction procedures for the Station 85 North Expansion Project have been designed
to present minimal impacts to Jurisdictional "Waters of the United States". These
procedures and mitigative measures are presented below.
To minimize impacts to sensitive resources, Transco will collocate the pipeline loop
along the existing Transco ROW. Conventional trench excavation techniques will be
utilized for the Project. Where practicable, Extra Work Areas (EWA) will be placed no
less than 50 feet from waterbody boundaries, except as depicted in individual waterbody
maps (Attachment 1). Transco will incorporate Best Management Practices (BMPs)
during construction activities to assist in the control of erosion and transport of
sediments. BMP's may include the use of trench spoils, silt fences, filter bags, straw
bales, coir logs and other measures as appropriate to minimize erosion and sedimentation
during construction. In-stream construction will generally be limited to 24 to 48 hours,
thereby minimizing impacts by limiting the duration of disturbance. Once the pipeline
loop is installed, the trench will be backfilled and the construction workspaces will be
restored to pre-construction contours and stabilized.
Authorization Request
As outlined above, the Iredell Loop portion of the 85 North Expansion Project will cross
a total of 25 "Waters of the United States," including 23 waterbodies and two open
waters. The affected "Waters of the United States" are listed in Table 1 (Attachment 2),
which details the following information; waterbody or open water ID, classification,
crossing distance, acreage impacted, location, and Section 10 or 404 classifications. The
attached Project mapping also shows the "Waters of the United States" located within the
pipeline loop construction corridors and the location of each crossing (Attachment 1).
Pursuant to the conditions of NWP 12, construction activities necessary for the 23
waterbodies and two open water crossings does not require pre-construction notification.
This letter and attachments serve as a request for concurrence that this Project qualifies
for NWP 12. Perennial and Transco appreciate your efforts to review and process this
request for authorization. The proposed construction start date for this Project is May
2010 for the Iredell Loop, and August 2010 for modifications at Station 150. If I can be

1. The Corps of Engineers believes that there may be jurisdictional waters of the
United States on the subject site, and the permit applicant or other affected party
who requested this preliminary JD is hereby advised of his or her option to
request and obtain an approved jurisdictional determination (JD) for that site.
Nevertheless, the permit applicant or other person who requested this
preliminary JD has declined to exercise the option to obtain an approved JD in
this instance and at this time.
2. In any circumstance where a permit applicant obtains an individual permit, or
a Nationwide General Permit (NWP) or other general permit verification requiring
"pre-construction notification" (PCN), or requests verification for a non-reporting
NWP or other general permit, and the permit applicant has not requested an
approved JD for the activity, the permit applicant is hereby made aware of the
following: (1) the permit applicant has elected to seek a permit authorization
based on a preliminary JD, which does not make an official determination of
jurisdictional waters; (2) that the applicant has the option to request an approved
JD before accepting the terms and conditions of the permit authorization, and
that basing a permit authorization on an approved JD could possibly result in less
compensatory mitigation being required or different special conditions; (3) that
the applicant has the right to request an individual permit rather than accepting
the terms and conditions of the NWP or other general permit authorization; (4)
that the applicant can accept a permit authorization and thereby agree to comply
with all the terms and conditions of that permit, including whatever mitigation
requirements the Corps has determined to be necessary; (5) that undertaking
any activity in reliance upon the subject permit authorization without requesting
an approved JD constitutes the applicant's acceptance of the use of the
preliminary JD, but that either form of JD will be processed as soon as is
practicable; (6) accepting a permit authorization (e.g., signing a proffered
individual permit) or undertaking any activity in reliance on any form of Corps
permit authorization based on a preliminary JD constitutes agreement that all
wetlands and other water bodies on the site affected in any way by that activity
are jurisdictional waters of the United States, and precludes any challenge to
such jurisdiction in any administrative or judicial compliance or enforcement
action, or in any administrative appeal or in any Federal court; and (7) whether
the applicant elects to use either an approved JD or a preliminary JD, that JD
will be processed as soon as is practicable. Further, an approved JD, a proffered
individual permit (and all terms and conditions contained therein), or individual
permit denial can be administratively appealed pursuant to 33 C.F.R. Part 331,
and that in any administrative appeal, jurisdictional issues can be raised (see 33
C.F.R. 331.5(a)(2)). If, during that administrative appeal, it becomes necessary
to make an official determination whether CWA jurisdiction exists over a site, or
to provide an official delineation of jurisdictional waters on the site, the Corps will
provide an approved JD to accomplish that result, as soon as is practicable.
This preliminary JD finds that there "may be" waters of the United States on the
subject project site, and identifies all aquatic features on the site that could be
affected by the proposed activity, based on the following information:
