Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application: Existing conditions consist of a maintained 30' wide Town of Apex Utility Easement within a 40' wide Town of Apex Greenway Easement between the terminus of the Phase 1 Greenway and west to the Right-of-Way of Apex Barbecue Road. On the west side of Apex Barbecue Road, beyond the Right-of-Way, the greenway utilizes the 30' Town of Apex Utility Easement and then south through a roadside wooded area until it connects to the Town of Apex Nature Park. The general land use in the vicinity of the project is residential. 3b. Explain the purpose of the proposed project: The purpose of the proposed project is to construct Phase 2 of a town greenway, which will connect the Kelly West residential subdivision to the Town of Apex Nature Park. This phase 2 will connect to phase 1 and will ultimately connect Kelly Road Park to the Town of Apex Nature Park. 3e. Describe the overall project in detail, including the type of equipment to be used: The overall project is approximately 1, 915 linear feet and consists of the construction of phase 2 of the Beaver Creek Greenway from Kelly West residential subdivision to the existing Town of Apex Nature Park and utilizes the existing Town of Apex Utility Easement to the maximum extent practicable. In between these two locations is a bridge replacement on Apex Barbecue Road and under construction by the NCDOT. Therefore, this project stops and starts on the east and west side of the Apex Barbecue Road Right-of-Way. In detail, the greenway will utilize a boardwalk at wetland areas and will span Beaver Creek. The beginning and ends points of the boardwalk transition to at-grade in some locations. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project. S&EC completed a wetland delineation and Jordan Lake Watershed Buffer evaluation for the proposed greenway corridor to identify natural resources so that impacts could be avoided & minimized to the maximum extent practicable. Additional areas were added and delineated throughout the corridor to further avoid & minimize impacts to jurisdictional waters. Phase 2 of the proposed greenway will be approximately 1,915 linear feet long and has been designed to be constructed primarily within the existing 30' Town of Apex Utility Easement. The greenway will be a mix between boardwalk and concrete sections. The 30' Utility Easement includes a sanity sewer line previously permitted and installed by the Town. Utilizing the existing utility easement where a sanitary sewer was previously constructed allows the greenway to be built within a maintained corridor which provides overall minimization of proposed wetland impacts. For the greenway, a 40' Town of Apex Greenway Easement was established and the existing 30'utility easement is within the greenway easement. Additional greenway easement width was required to be able to construct the greenway at minimum separation distance from the sanitary sewer line. The separation distance that was agreed upon was 10' and was acquired throughout most of the greenway. Some separation distance exceptions were made at manhole locations, this was to avoid going outside the easement and impact additional wetland areas. Additionally, the Town of Apex design requirements does not allow for the greenway to be constructed directly above the sanitary sewer line and required that any greenway crossing sections (i.e. greenway crossing sanitary sewer line) be a concrete section vs. a boardwalk section. This was to avoid the boardwalk pilings that are driven into the ground to be near the below ground surface sanitarysewer. Boardwalk was utilized in wetland locations to avoid the permanent loss of wetlands however some concrete sections (i.e. permanent fill) were required at the beginning and ends sections of the boardwalk because of its proximity to the manholes. Bridge sections were utilized at the Beaver Creek stream crossing, therefore avoiding stream impacts. Temporary stream impacts were avoided in this phase, the proposed bridge span over Beaver Creek can be accessed from both directions. The average height of the boardwalk sections is 34, the height clearance from the boardwalk to the ground surface is 2' allowing for wetland vegetation to grow. Furthermore, the applicant is aware of the regional conditions associated with the Nationwide Permits 14. WIth respect to Linear transportation projects and Nationwide Permit 14 (NWP 14 -Regional Conditions section 4.0) the applicant is not proposing stream relocations or impacts within tidal waters/wetlands; the crossings are only upland to upland and are not being utilized in combination with a NWP 18 creating uplands; the proposed temporary crossings are not within a trout watershed. 1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques. Per the project engineer, for the most part, the project will be staying within previously cleared utility easements, mud mats will be utilized in wetland areas, silt fence will be used on both sides of the construction limits and also silt fence outlets will be utilized where necessary, construction entrances are used on all access points to the project area, and inlet protection is used on existing storm drain inlets near construction. Additionally, the project is located within the Town of Apex's jurisdiction, therefore any adjacent properties that have potential for development will have the following regulations to protect downstream waters: 1) the Phase II NPDES Stormwater Permit Program, this program includes permitting requirements for Municipal Separate Storm Sewer Systems (MS4s) in addition to post -construction stormwater management requirements; 2) Jordan Lake Watershed Riparian Buffer Protection regulations, these regulations require limited development within the riparian buffer area in addition to "diffuse flow" requirements at a minimum and could require Best Management Practices that control nitrogen if diffuse flow cannot be achieved, and 3) the Water Supply, Watershed Protection Program which limits development densities as well as requires protective riparian buffers.
