The following questions provide direction in determining when the Department is
required to prepare environmental documents for state-funded construction and
maintenance activities. Answer questions for Parts A through C by checking either "Yes"
or "No". Complete Part D of the checklist when Minimum Criteria Rule categories #8,
#12(i), or #15 are used.

Project Location: Bridge No. 163 on SR 1348 (Bates Creek Road) over Bates Creek -
Cherokee County, North Carolina
Project Description: Replace Bridge No. 163 with a 63' 3" L x 18'-4" W x 8'-3" H(2
Barrels @ 8' W x 6' H) reinforced concrete box culvert structure on existing location
(with 1 ft. seal on low flow barrel, 2ft. seal on high flow barrel), near the Hangdog
Community in Murphy, North Carolina. The project will use an offsite detour for
construction.
Anticipated Permit or Consultation Requirements: Anticipated Permit or
Consultation Requirements:
1. Outside river corridor = Yes (2.02 miles from Valley River)
2. Below impact threshold for applicable NWP = No
3. Tree clearing = No Clearing (otherwise have no effect on T&E)
4. Trout watershed = Yes (follow moratarium unless verification NCWRC letter
states no)
5. NLEB HUC = Yes (greater than 025 miles from known hibernacula/maternity
roost)
NWP 14 will require written authorization and written 401 Certification.

1. Is the proposed project listed as a type and class of activity allowed under
the Minimum Criteria Rule in which environmental documentation is not
required?
If the answer to number 1 is "no", then the project does not qualify as a
minimum criteria project. A state environmental assessment is required.
