Hi Brennan and Chad
I just heard back from our client at CenterPoint Development. They are currently in the process of evaluating the impact
the CenterPoint TIA will have on the intersection of Drysdale Drive Extension and Military Cutoff Rd. Apparently, there
are still some unknowns regarding how the proposed extension may affect the stream (and who's responsibility it will
be). Until some of these issues are more thoroughly vetted, can we place the application on hold? The applicant thinks
this should be finalized in the next few weeks.
I would rather place the application on hold than withdraw it (if possible) so we don't lose the 401 WQC application fee.

Reference is made to your pre -construction notification (PCN) for the discharge of fill material into waters of the United
States (WOUS) to facilitate the construction of a mixed use development located in Wilmington, New Hanover County,
North Carolina. The application has been reviewed and is not sufficient for us to evaluate your proposal. Please address
the items listed below:
1. NWP General Condition 23 (a) states "the activity must be designed and constructed to avoid and minimize adverse
effects, both temporary and permanent, to WOUS to the maximum extent practicable at the project site". After
evaluating the site plan, it appears that impact 01 and impact WS could be avoided and or minimized. Please provide
justification for this impact and explain why the storm water feature can't be shifted to avoid or minimize these impacts.
2. The proposed stream enhancement appears to involve the clearing of an existing vegetated bank and buffer. Please
justify that the proposed enhancement is preferable to other methods of enhancement or leaving it in its current state.
Have other forms of enhancement that do not involve clearing been considered?
The impacts being proposed appear to be permanent because it appears that you are relocating portions of the stream.
If the amount of material to be discharged is more than 25 cubic yards below the plane of the OHWM it could not be
authorized under NWP 18. We would have to authorize this under a NWP 27 and would need additional information to
show that the proposed enhancement will provide an ecological uplift.
3. The drawings for the bottomless culverts show rip -rap near the footers. It is unclear whether this is above or below
the OHWM. Please provide additional information and plans that clearly show these impacts are temporary.
Please provide this information within 30 days of the date of this e-mail.
