U -? 2 2009 Lori / Cyndi: DENR WATERQUAL1Ty WETLANDS AND STQRMWATER BRANCH On behalf of Wilderness Creek Falls, Inc. we are requesting a revision to the Nationwide Permit for the site known as Wilderness Creek Falls. It is WNR's understanding that the revision request was agreed upon with the US Army Corps of Engineers during a meeting on March 27, 2009. The revisions were discussed with Kevin Barnett over the phone the following week and are presented as such. Wilderness Creek Falls plans to realign the previously approved North Pond channel restoration, remove seven culverts on the North end of the property, and keep four culvert impacts that were proposed to be removed in the previous Nationwide Permit. Please refer to the previously submitted IP application (withdrawn) and Nationwide Permit for copies of the USGS maps, aerial photo, agent authorization, and restoration plan for the mine area and Pond #1 and #2. Wilderness Creek Falls, Inc. is committing to remove significant portions of existing after-the- fact impacts to minimize impacts associated with this application. Total impacts have been reduced by over 600 linear feet, including the removal of seven culverts and the removal of two on-line impoundments. Total stream impacts will be 300 linear feet for culverts; all other impacts will be removed (see attached impact table and maps). The change request of impacts will result in over 300 linear feet of additional piped stream restoration. The stream restoration at North Pond will follow the existing topography and tie into the historic stream that has been piped (now proposed for restoration). Attached please find a letter from the developer committing that he has reviewed the requested revisions and does not anticipate additional changes. Also attached is an amendment to the Restrictive Covenants and Conditions to protect the remaining streams, wetlands, and protected Canton Office PO Box 882 Canton, NC 28716 stream buffers on site. Once the restoration work is complete a revised map can be recorded as an additional amendment to the Covenants. Registry, the undersigned Developer owning morn then 67'x6 of lots subject to said restrictions, does consent to hereby amend, and does hereby amend said restrictive covenants and conditions by adding the following as anew Article 20: ARTICLE 20 FILLING AND DRAINING Certain lots in the subdivision have been determined to meet the requirements for designation as a wetland, stream or protected stream buffer. Any subsequent fill or alteration of this area shall conform to the requirement of the state rules adopted by the State of North Carolina in force at the time of the proposed alteration. The intent of this provision is to prevent additional wetland, stream or buffer filling or draining, so the property owner should not assume that a future application for filling or draining would be approved. The property owner shall report the name of the subdivision in any application pertaining to said rules. This covenant is intended to ensure continued compliance with all rules adopted by the State of North Carolina and therefore the State of North Carolina may enforce benefits. This covenant is to run with the land and shall be binding on all parties and all persons claiming under them. This Article is not subject to amendment or deletion, except by permission of the Division of Water Quality, State of North Carolina.
