Dear Mr. Barnett,
Please reference the "Notice of Violation" (NOV) letter dated March 30, 2009 (Appendix
A) sent by the NC Division of Water Quality (DWQ) in response to a site visit conducted
on February 18, 2009. The subject property known as the Ramble is located off NC
Highway 25 south of Asheville in Buncombe County, North Carolina. The NOV cites
construction activities within waters of the US for which the Ramble has not complied
with the issued 401 Water Quality Certification. The NOV require responses to several
listed concerns. The DWQ concerns are addressed below.
Violation I.: "Placement of culverts and other structures in waters, streams, and
wetlands must be placed below the elevation of the streambed to allow low flow passage
of water and aquatic life. It was observed that installed culverts were either at grade or
perched."
Required Response La.: "The Division of Water Quality requests that as-built surveys
and drawings be submitted showing the current disposition of all installed crossings
within the boundaries of the Ramble development."
Photographs of each crossing are attached for review (Appendix B). Each culvert
is discussed below.
New Crossing #1 (Photo 1) -New Crossing #1 is a double-barrel culvert crossing.
These culverts are tied into the DOT culverts beneath Highway 25. Immediately
upstream of the culverts is a dam and impoundment that is a part of the Deer Lake
development. The culvert invert on the left (in the photo) is slightly raised above
the stream. This is a high flow culvert utilized during period of heavy

precipitation. The culvert invert on the right (in the photo) is slightly below the
water surface. Although the culvert on the right is not buried, aquatic life
movement is inhibited by the dam and impoundment immediately upstream of the
culvert. No work is proposed to modify this crossing.
Existing Crossing #2 (Photo 2) - Existing Crossing #2 is a double-barrel culvert
crossing. These culverts have a concrete apron and are not buried to DWQ
standards. These culverts impact the origin of the stream and there is no
jurisdictional stream channel above the culvert; therefore, there is no upstream
reach for aquatic life. No work is proposed to modify this crossing.
Existing Crossing #3 (Photo 3) - Existing Crossing #3 is not buried and is slightly
perched. The permittee proposes to install a step pool (Appendix C) to raise the
water level slightly which will, in turn, allow aquatic life to pass through the
culvert.
New Crossing #8 (Photo 4) - New Crossing #8 has been installed according to
DWQ guidelines for culvert installation.
Existing Crossing #9 (Photo 5) - Existing Crossing #9 has been installed
according to DWQ guidelines for culvert installation.
Existing Crossing #10 (Photo 6) - Existing Crossing #10 has been installed
according to DWQ guidelines for culvert installation.
Existing Crossing #18 (Photo 7) - Existing Crossing #18 is an arched crossing
with a concrete bottom. Natural substrate has completely covered the bottom of
the crossing. The crossing is in compliance with permit conditions.
Violation II.: "In accordance with 15A NCAC 2H. 0506 (h) compensatory mitigation may
be required for impacts to 150 linear feet of more of streams andlor one acre of more of
wetlands for an entire project. Your submitted Mitigation Monitoring plan shows that
your impacts exceed the mitigation preformed by 51 linear feet."
Required Response II.a.: "The Division of Water Quality requests that a plan and
timeline for performing mitigation to complete the required 51 linear feet be submitted.
Please noet that any submission not in accordance with the issued 401 Water Quality
Certification must include application for a Certification modification (to the
Wetlands/401 Certification Unit, along with appropriate fee)."
On March 24, 2009, 20 linear feet of culvert (Existing Crossing #13) was
removed at the Ramble and 10 linear feet was restored on the upstream and
downstream side of the culvert, which leaves the mitigation deficit at 15 linear
feet. The permittee will modify the permit and mitigation plan to include
payment into the Ecosystem Enhancement Program for 15 linear feet of cool
water stream restoration in the Upper French Broad River Basin (HUC
06010105). A new permit application is attached for review (Appendix D).
Payment will be made to EEP upon approval of the permit modification by the
Corps and DWQ.

On February 18, 2009 Chuck Cranford and Kevin Barnett from the Asheville Regional Office of
the Division of Water Quality (DWQ), along with Liz Hair of the US Army Corps of Engineers,
and Clement Riddle and Rebekah Newton of Clearwater Environmental, conducted a site
inspection for The Ramble Buncombe County.
401 certification violations were noted during the inspection and file review. It was noted that
culvert installations were performed in such a way that may violate Water Quality General
Certification 3402, Condition #9. Additionally, it was noted that impacts were installed in excess
of the amount of mitigation performed, as approved in Water Quality. Certification Approval letter
20041178.
As a result of the site inspection and file review, the following violations, detailed below, were
noted:

401 WQC Condition Violations
VIOLA'T'IONS
1. 401 WQC Condition Violations - Biltmore Farms, Inc. submitted a Pre-Construction
Notification (PCN) on July 20, 2004. The impacts were requested under U.S. Army Corps
of Engineers Natioi wi-6 'Permit(s) 12 and 39, and the corresponding General Water
Quality Certifications. DWQ issued an approval letter for the impacts on August 5, 2004,
for 20041178. The approval'letter specifies that the activities must follow the conditions
listed in the General Water Quality Certification, as well as additional conditions listed in
the letter. General Water Quality Certification 3402, Condition 9 states the following:

II. 401 WQC Condition Violations - Biltmore Farms, Inc. submitted a Pre-Construction

Assistance and Compliance Oversight Unit, 1617 Mail Service Center, Raleigh, NC 27699-1617.
Your response should address the following iterns:

a. The Division of Water Quality requests that as-built surveys and drawings be
submitted showing the current disposition of all installed crossings within the

II. 401 WQ Certification
a. The Division of Water Quality requests that a plan and timeline for performing
mitigation to complete the required 51 linear feet be submitted. Please note that any
submission not in accordance with the issued 401 Water Quality Certification must
include application for a Certification modification (to the Wetlands / 401
Certification Unit, along with appropriate fee).
Thank you for your attention to this matter. This Office is considering sending a recommendation
for enforcement to the Director of the Division of Water Quality regarding these issues and any
future/continued violations that may be encountered. Your above-mentioned response to this
correspondence will be considered in this process. This office requires that the violations, as
detailed above, be abated immediately. These violations and any future violations are
subject to a civil penalty assessment of up to $25,000.00 per day for each violation. Should

The site is residential and contains all related infrastructure. In general, of the originally permitted impacts, only those
impacts north and east of Dingle Creek; and those impacts associated with the construction entrance have been
complete. These impacts are shown in blue on the permit map. All other impacts where never completed. These areas
are shown in red on the permit map. General land use in the vicinity of the project is residential subdivision, commercial
business, and public land (Blue Ridge Parkway).

Culverts for the development have been installed under Action ID 200431348 and DWQ Project # 04-1178. Impacts
currently at the site are less than impacts originally permitted; the permittee wishes to modify the permit and mitigation
plan to reflect the conditions at the site.

The project included installation of culverts. Typical earth-moving and construction equipment was used at the site for
culvert installation.

A permit application was submitted to the US Army Corps of Engineers on July 16, 2004 and issued on August 16, 2004.
This permit authorized 282 linear feet of permanent impact and 180 linear feet of temporary impact. A permit modification
was submitted on June 6, 2005 and issued on June 22, 2005. The permit was modified to authorize 266 linear feet of
permanent impact and 180 linear feet of temporary impact. A site visit was conducted on February 18, 2009 and a Notice
of Violation (NOV) was issued on March 30, 2009. The permittee would like to modify the permit and mitigation plan to
reflect the current status of the property; DWQ requested in the NOV that a new permit application be submitted in order
for the modification to be processed.

The original permit for the Ramble included development on all 940 acres. Because of the economy and downturn in the
real estate market, development was delayed. The permits issued for development at the site have since expired. The
permittee is applying to modify the permit and mitigation plan to authorize completed impacts (214 linear feet). The future
of development at the Ramble is dependent of future market conditions. Modifying the permit to reflect the current status
of the property provides the Ramble with the opportunity to be in compliance with all permit and mitigation conditions. If
real estate development increases and the Ramble is able to continue development of the property, a new permit
application will be submitted to apply for impacts associated with the rest of the development. All impacts currently in
place (designated in blue) and potential future impacts (designated in red) are on the permit drawings.

The other five culverts are culvert replacements with extensions. All impacts associated with utility line installation were

This replaces a previously issued letter dated March 12, 2009. The purpose of this letter is to notify you that the North Carolina
Ecosystem Enhancement Program (NCEEP) is willing to accept payment for impacts associated with the above referenced project.
Please note that this decision does not assure that the payment will be approved by the permit issuing agencies as mitigation for project
impacts. It is the responsibility of the applicant to contact these agencies to determine if payment to the NCEEP will be approved.
You must also comply with all other state federal or local government permits, regulations or authorizations associated with the
proposed activity including SL 2008-152: An Act to Promote Compensatory Mitigation by Private Mitigation Banks
This acceptance is valid for nine months from the date of this letter and is not transferable. If we have not received a copy of the
issued 404 Permit/401 Certification/CAMA permit within this time frame, this acceptance will expire. It is the applicant's
responsibility to send copies of the permits to NCEEP. Once NCEEP receives a copy of the permit(s) an invoice will be issued based
on the required mitigation in that permit and payment must be made prior to conducting the authorized work. The amount of the In
Lieu Fee to be paid to NCEEP by an applicant is calculated based upon the Fee Schedule and policies listed at www.nceep.net.
Based on the information supplied by you the impacts that may require compensatory mitigation are summarized in the following
table.

Upon receipt of payment, EEP will take responsibility for providing the compensatory mitigation. If the regulatory agencies require
mitigation credits greater than indicated above, and the applicant wants NCEEP to be responsible for the additional mitigation, the
applicant will need to submit a mitigation request to NCEEP for approval prior to permit issuance. The mitigation will be performed
in accordance with the Memorandum of Understanding between the N.C. Department of Environment and Natural Resources and the
U.S. Army Corps of Engineers dated November 4, 1998.
