Dear Mr. Phillips:
On October 12, 2006, the Division of Water Quality (DWQ) received your application dated October 12,
2006, to impact 0.0256 acres of wetland, 941inear feet of stream (701inear feet perennial stream impacts,
24 linear feet intermittent stream impacts) and 5,534 square feet of Zone 1 Neuse River basin protected
riparian buffer, and 3,915 square feet of Zone 2 Neuse River basin protected riparian buffer, to construct
the proposed residential subdivision, subdivision improvements and dam improvements. On November
22, 2006, and December 1, 2006, the DWQ received additional information from you, however, the DWQ
has determined that your application remains incomplete and/or provided inaccurate information as
discussed below. The DWQ will require this additional information in order to process your application
to impact protected wetlands and/or streams on the subject property. Therefore, unless we receive the
additional information requested below, we will have to move toward denial of your application as
required by 15A NCAC 2H .0506 and will place this project on hold as incomplete until we receive this
additional information. Please provide the following information so that we may continue to review your
project.
Additional Information Requested:
Only a portion of the site is receiving stormwater treatment. The stormwater from the east side of
the stream is entering into the stream without any treatment at all. Also, a portion of the
stormwater from the site is flowing untreated into the existing wetland. In order to comply with
the provisions of Water Quality Certification Number GC 3402, all of the stormwater from the
site must be treated with an appropriate stormwater best management practice. The resubmittal
on this issue must include plans of the entire project area.
2. The extended detention wetland has not been designed in accordance with the DWQ BMP
Manual. The wetland;must include more complex topography to increase the flow path through
the wetland. The micropool needs to be located in the vicinity of the outlet structure. What has
been submitted appears to be a wet detention pond with a littoral shelf. Please address this issue
in your resubmittal.

3. There is an error in the worksheet where the surface areas at various depths were reported. The
areas add up to 4,198 square feet, however, the total surface area for the wetland was reported as
3,440 square feet. Please address this discrepancy in your resubmittal:
4. The temporary water quality pool elevation is given as 295.5 on the plans, but as 296 on the
extended detention worksheet. Please address this discrepancy in your resubmittal.
The 0.75 orifice diameter appears to be too small, resulting in a drawdown time that exceeds five
days.
The outlet structure has not been shown in plan view. The profile of the stormwater wetland does
not appear to be consistent with a 0.75-inch orifice diameter.
Sizes for all of the plant materials specified must be shown on the plans. Fescue may not be
planted within an extended detention wetland because of its tendency to be invasive. Please
address this issue in your resubmittal.
Please respond within three weeks of the date of this letter by sending this information to me in writing
and Mike Horan of the DWQ Raleigh Regional Office. If we do not hear from you within three weeks,
we will assume that you no longer want to pursue this project and we will consider the project as
withdrawn.
This letter only addresses the application review and does not authorize any impacts to wetlands, waters
or protected buffers. Please be aware that any impacts requested within your application are not
authorized (at this time) by the DWQ. Please call Ms. Cyndi Karoly or Mr. Ian McMillan at 919-733-

regarding or would like to set up a meeting to discuss this matter.
