Director Division of Water Quality November 28, 2006 DWQ Project # 06-1649 Wake County CERTIFIED MAIL: RETURN RECEIPT REQUESTED Mr. David Phillips 1505 Perryclear Court Raleigh, NC 27614 Subject Property: Towns of Southgate UT to Walnut Creek [030402, 27-34-(4), C, NSW] 303d REQUEST FOR MORE INFORMATION Dear Mr. Phillips: On October 12, 2006, the Division of Water Quality (DWQ) received your application dated October 12, 2006, to impact 0.0256 acres of wetland, 941inear feet of stream (701inear feet perennial stream impacts, 24 linear feet intermittent stream impacts) and 5,534 square feet of Zone 1 Neuse River basin protected riparian buffer, and 3,915 square feet of Zone 2 Neuse River basin protected riparian buffer, to construct the proposed residential subdivision, subdivision improvements and dam improvements. On November 22, 2006, you delivered one set of the additional information requested by the DWQ in correspondence to you dated November 17, 2006. The DWQ will require four additional sets of the additional information requested by the DWQ in correspondence to you dated November 17, 2006, in as well as the additional information requested below. The DWQ will require this additional information in order to process your application to impact protected wetlands and/or streams on the subject property. Therefore, unless we receive the additional information requested below, we will have to move toward denial of your application as required by 15A NCAC 2H .0506 and will place this project on hold as incomplete until we receive this additional information. Please provide the following information so that we may continue to review your project. Additional Information Requested: 1. Your proposed permanent pool surface area is considerably undersized. Please make the proper adjustments and resubmit your plans. 2. The orifice diameter is too small. The DWQ would recommend a 1" orifice diameter. Please make this change and resubmit your plans. Please respond within three weeks of the date of this letter by sending this information to me in writing and Eric Kulz of the DWQ Raleigh Regional Office.
