Reference your application for a Department of the Army permit
to authorize the placement of fill material in a manmade basin off
Roanoke Sound, Wanchese, Dare County, North Carolina.
Your proposal has been reviewed and found to be consistent
with the provisions and objectives of general permit No. SAWC080-
N-000-0291. Therefore, you may commence construction activity in
strict accordance with applicable State authorization and the
enclosed plan. Failure to comply with the State authorization or
conditions of the general permit could result in a violation o
Federal law. .
If any change in your work is required because of unforeseen
or altered conditions or for any other reason, plans revised to
show the change must be sent promptly to this office and.the North
Carolina Division of Coastal Management prior to performing any
such change or alteration. Such action is necessary as revised
plans must be reviewed and the authorization modified.

Dear Mr. Parker:
Reference the application of Mr. Richard V. Scarborough for
Department of the Army authorization to authorize the placement of
fill material in a manmade basin off Roanoke Sound, Wanchese, Dare
County, North Carolina.
The Federal agencies ave comp e e
presented by the application and your field investigation report.
We recommend that the following conditions be included in the
State authorization:
a. An impervious barrier will be installed across the mouth
of the basin prior to the placement of any fill material.
b. All fill material will be obtained from a high ground
source.
c. The fill material will be clean and free of any pollutants
except in trace quantities. Metal products, organic materials, or
unsightly debris will not be used.
d. The activity will be conducted in such a manner as to
prevent a significant increase in turbidity outside the area of
construction or construction-related discharge. Increases such
that the turbidity in the waterbody is 50 NTU's or less are not
considered significant.

On February 6, 1986, we renewed general permit No. SAWC080-N-
000-0291 (copy enclosed), which provides Federal authorization for
construction activities that receive authorization from the State
of North Carolina.
A review of your application received February 8, 1988, for a
Department of the Army permit to reauthorize the placement of fill
material in a manmade basin off Roanoke Sound, Wanchese, Dare
County, North Carolina, indicates it to be a candidate for Federal
authorization under this general permit. Accordingly, the
administrative processing of your application will be accomplished
by the North Carolina Division of Coastal Management. Comments
will be furnished to the State.
If your application must be withdrawn from this general permit
process for any reason, you will be informed regarding its further
management. If there are no unresolved differences in State-
Federal positions or policies, the final action taken on your
application by the State will result in your receiving written
notice from us that your application is consistent with the
general permit and you may commence your activity. Only after
receiving such confirmation should you begin work.
Your application, pursuant to Section 10 of the River and
Harbor Act and Section 404 of the Clean Water Act, has been
assigned No. SAWC088-N-028-0164 and will be coordinated by

This permit, issued on _ aT/bS , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may subject
permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void.
(1) The stone and silt barrier shall be installed prior to the filling of the
basin.

increase in turbidity outside the area of construction or construction related
discharge (increases such that the turbidity in the stream is 25 NTUs or
less are not considered significant).
(4) In accordance with information submitted by letter to the Division of Environ-
mental Management, the area after filling will be grassed and not built
upon.
(5) This office will require that a ground cover be provided within 30 days
after project completion.
This permit action may be appealed by the permittee
or other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on-site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification
not covered hereunder requires further Departmental
approval.
All work must cease when the permit expires on
December 31, 1991
In issuing this permit, the State of North Carolina
agrees that your project is consistent with the North
Carolina Coastal Management Program.

to an application filed on the 22nd day of October, 1988 to place fill
material in an existing boat basin.
The Application provides adequate assurance that the discharge of
fill material into a wetlands area adjacent to the waters of a tributary
to Roanoke Sound in conjunction with the proposed filling of the boat
basin in Dare County will not result in a violation of applicable Water
Quality Standards and discharge guidelines. Therefore, the State of
.....North Carolina certifies. that this activity-will . not violate- Sections- - -- --
301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in
accordance with the application and conditions hereinafter set forth.

SITE DESCRIPTION
The applicant currently owns and operates a commercial boat building business
located on Roanoke Sound behind Davis's Boat Works, off S.R. 1141 in Nanchese, Dare
County. His business includes the construction of commercial and sportfishing
vessels ranging from 15' to 40' + in length.
The property upon which2this business is located is approximately 1/2 acre in
size. An L-shaped 3,920 ft. pile-supported building houses the boat building
operation. The entire structure is almost entirely over what were on p coastal
wetlands. Currently the only highground is an approximately 6000 ft. area used
for employee parking and access. The remainder of the lot (to the north of the
building) is characterized by a thick mixture of black needlerush (Juncus roemerianus)
and smooth cord grass (Spartina alterniflora) mixed with minor amounts of salt grass
(Distichlis s icata and salt reed grass Spartina cynosuroides). To the south of
the building, a man-made L-shaped boat basin leads off of the Roanoke Sound. This
basin is fringed by wax myrtle, groundsel tree and oxeye.
The applicant proposes to fill in the terminal end of the L-shaped boat basin;
this comprises a 40' X 35' area (1400 ft. ) of shallow water habitat. This would
require approximately 190 cubic yards of fill; the applicant proposes to truck in

placed behind this.
ANTICIPATED IMPACTS
The proposed project would result in the loss of approximately 1400 square feet
of shallow-water habitat in the man-made boat basin. Some localized turbidity will
result from the filling, but this should be short termed.

In addition to the completed application
following items must be submitted:
A copy of the deed (with state application only) or
other instrument under which the applicant claims
title to the affected property. If the applicant is not
claiming to be the owner of said property, then for-
ward a copy of the deed or other instrument under
which the owner claims title, plus written permis-
sion from the owner to carry out the project.
An accurate work plat (including plan view and
cross sectional drawings) drawn to scale in black
ink on 8 1/2 x 11 white paper. (Refer to Coastal
Resources Commission Rule 7J.0203 for a detailed
description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue-line
prints or other larger plats are acceptable only if 16
high quality copies are provided by the applicant.
(Contact the U.S. Army Corps of Engineers regard-
ing that agency's use of larger drawings.) A site or
location map is a part of plat requirements and it
must be sufficiently detailed to guide agency per-
sonnel unfamiliar with the area to the site. Include
------ -county-road-(S-R)-numbers Ilaardmarks, and-the-like.-
K A stormwater management plan, if applicable, that
may have been developed in consultation with the
Division of Environmental Management.
A list of the names and complete addresses of the
adjacent waterfront (riparian) landowners. These
individuals have 30 days in which to submit com-
ments on the proposed project to the Division of
V Coastal Management. The applicant must advise
the adjacent landowners of this opportunity by sen-
ding a copy of the permit application to them by
registered or certified mail. This notification is re-
quired by G.S. 113-229(d).

The Department of Natural Resources'and Community Development hereby

(c) -that RICHARD SCARBOROUGH of Wanchese, J4.C.
filed an application on 10/22/87
for a permit from the Division of Coastal Management to develop in an
Area of Environmental Concern and for certification from the Division
of Environmental Management that a discharge of fill material in project
wetlands will not violate applicable water quality standards.
