1.0 Introduction (Block 18)
Nottingham Subdivision is a 71.2 acre property located off of Burns Drive in Sanford, North
Carolina (Attachment A). The property is being developed with 152 single-family lots, which are
being constructed in three phases. Residential and infrastructure construction has already begun
in Phases 1 and 2. Infrastructure construction has started in Phase 3, but residential has not
begun. Sewer and power easements have been constructed on the site.
On September 29, 2005, Nottingham Property Associates, LLC received a Notice of Violation
from the North Carolina Division of Water Quality (NCDWQ) for failure to secure a 401 Water
Quality Certification. On December 29, 2005, Nottingham Property Associates, LLC received a
Notification of Unauthorized Activity/Permit Noncompliance from the U.S. Army Corps of
Engineers (USACE). Both notifications pertained to placement of fill in stream channels, which
are jurisdictional under Section 404/401 of the Clean Water Act, without obtaining the required
permits. The following information is provided as part of an after -the -fact Individual Permit to
satisfy Sections 404 and 401 of the Clean Water Act and to resolve the NCDWQ's and USACE's
notices of violation. All three phases of the subdivision are covered in this permit application,
and no future permit requests are anticipated.
2.0 Purpose and Need (Block 19)
The purpose and need for this project is to build and satisfy a demand for single-family homes in
a growing area of Lee County. The roadways and associated stream crossings were needed in
order to access buildable lots within the property.
3.0 Site Description
The project site is located within the Piedmont physiographic region, characterized by rolling
hills with a gentle slope. Elevations on the property range from 290 feet to 350 feet above mean
sea level. The soils on the site are characterized as Pinkston and the Mayodan series, both of
which are well -drained and non -hydric.
Three jurisdictional features, two intermittent streams, and one perennial stream, all unnamed
tributaries to Big Buffalo Creek (DWQ Index # 17-40, Class C), flow through the site. The
streams are located within the Cape Fear Watershed. The jurisdictional determination plat,
verifying the locations of these streams, was signed by Mr. Todd Tugwell of the USACE on
April 20, 2006.
4.0 Impacts
4.1 Stream Impacts (Block 20)
There will be permanent impacts to 566 linear feet of stream (Table 1). 206 linear feet
has been impacted by for the placement of three culverts to allow for road crossings of
streams. There are impacts to 360 linear feet of stream for the purposes of placing rip -rap

in the streambed for stream stability during construction of utility easements and culverts,
which is required by the North Carolina Division of Land Resource's (NC DLR)

Impervious surface on the site at build out will be 18.4% (Attachment C), therefore
stormwater controls are not required by NCDWQ. Sewage will be treated by the City,
and homes will be connected to the sewer line that has already been constructed on the
site. This project will not have cumulative impacts which would result in additional
development that could impact nearby downstream water quality.

4.2 Cultural Resources
ArcheolgW
A review of the North Carolina Office of State Archeology database revealed no
archeological sites in the project area. ECS contacted Ms. Renee Gledhill -Earley,
Environmental Coordinator for the SHPO, on September 28, 2006 (Attachment
B), to determine if there were any archeological issues with the project site. ECS
received a response from the SHPO requesting an archeological survey.
Environmental Services, Inc, performed an archeological survey in November,
2006. The report from that survey was submitted to the SHPO on November 20,
2006, and the clearance letter from the SHPO was dated January 10, 2007.
Architecture
A review of the North Carolina State Historic Preservation Office (SHPO)
database revealed one historic property within the vicinity of this project, the
L.M. Thompson House. ECS contacted Ms. Renee Gledhill -Earley,
Environmental Coordinator for the SHPO, on September 28, 2006 (Attachment
B), to determine if this project will have an impact on the National Register of
Historic Places eligible property. The SHPO did not request an architectural
survey of this property in their response.
Wild and Scenic Rivers
This project will not impact any designated Wild and Scenic Rivers.
4.3 Federally Protected Species
A review of the North Carolina Natural Heritage Database for the USGS 7.5 Minute
Sanford Quad revealed no Federally endangered, threatened, proposed endangered, or
proposed threatened species.
5.0 Impact Justification
The stream crossings were required in order to access buildable areas of the property. The rip -rap
was required by the DLR Sediment and Erosion Control Permit. Nottingham Property Associates
attempted to reduce impacts (Attachment B) to the stream by removing most of the rip -rap from
the streambed, and by replacing the 72" RCP at Stream A with a bottomless arch culvert.
However, when they requested a revision in their Sediment and Erosion Control Permit, DLR
denied them their request. Therefore, the original culvert and rip -rap must now remain in the
streams.

6.0 Mitigation
Nottingham Property Associates is purchasing all compensatory mitigation via the North
Carolina Ecosystem Enhancement Program's In -lieu Fee Process. The acceptance letter can be
found in Attachment B.

hydrological situation that exists within the proposed project area, we have determined that there is a very high
probability that archaeological sites exist in the project area. We therefore recommend that a comprehensive
archaeological survey be conducted by an experienced archaeologist to identify and evaluate the significance of any
archaeological remains that may be damaged or destroyed by the proposed project. Potential effects on unknown
resources must be assessed prior to the initiation of any earth moving activities. Please note that our office now
requests consultation with the Office of State Archaeology to discuss appropriate field methodology prior to the
archaeological field investigation.
Two copies of the resulting archaeological survey report, as well as one copy of the appropriate site forms, should
be forwarded to us for review and comment as soon as they are available and well in advance of any earth moving
activities.
A list of archaeological consultants who have conducted or expressed interest in contract work in North Carolina is
available at www. arch.dcr.state.nc.us/consults. The archaeologists listed, or any other experienced archaeologists
may be contacted to conduct the recommended survey.

The purpose of this letter is to notify you that the North Carolina Ecosystem Enhancement Program (NC EEP) is willing to
accept payment for impacts associated with the above referenced project. "This letter replaces the previous acceptance
letter dated June 29, 2006.*s Please note that this decision does not assure that the payment will be approved by the permit
issuing agencies as mitigation for project impacts, It is the responsibility of the applicant to contact these agencies to
determine if payment to the NC REP will be approved.
This acceptance is valid for six months from the date of this letter. If we have not received a copy of the issued 404
Permit/401 Certification.within this time frame, this acceptance will expire. It is the applicant's responsibility to send
copies of the 404/401 permits to NC EEP. Once NC EEP receives a copy of the 404 Permit and/or the 401 Certification an
invoice will be issued and payment must be made.

Upon receipt of payment, EEP will take responsibility for providing the compensatory mitigation for the permitted impacts
up to a 2:1 ratio, (buffers, Zone 1 at a 3:1 ratio and zone 2 at a 1.5:1 ratio). The type and amount of the compensatory
mitigation will be as specified in the Section 404 Permit and/or 401 Water Quality Certification, and/or CAMA Permit. ',"he

This office has reviewed the subject Erosion and Sedimentation Control Plan. We find
the plan to be acceptable and hereby issue this letter of approval. If any modifications,
performance reservations, or recommendations are applicable, a list is enclosed and is
incorporated as a part of this letter of approval. The enclosed Certificate of Approval should be
posted at the job site. In addition, it should be noted that this plan approval shall expire three (3)
years following the date of approval, if no land -disturbing activity has been undertaken, in
accordance with Title 15A, North Carolina Administrative Code (NCAC) 4B.0029.
If any modifications are not incorporated into the plan and implemented in the field, the
site will be in violation of the Sedimentation Pollution Control Act of 1973 (North Carolina
General Statute (NCGS), 113A-61.1).
15A NCAC 4B.0018(a) requires that a copy of the approved plan be on file at the job site.
Also, this letter gives the notice required by NCGS 113A -61.1(a) concerning our right to perform
periodic inspections to ensure compliance with the approved plan.
North Carolina's sedimentation pollution control program is performance oriented,
requiring protection of the natural resources and adjoining properties. If at any time during this
project it is determined that the Erosion and Sedimentation Control Plan is inadequate to meet

In accordance with your application received August 31, 2001 we are forwarding herewith Permit No.
WQ0020453, dated September 28, 2001, to the City of Sanford for the construction and operation of the subject
wastewater collection system extension. This permit shall be effective from the date of issuance until rescinded
and shall be subject to the conditions and limitations as specified therein. This cover letter shall be considered a
part of this permit and is therefore incorporated therein by reference.
Please pay particular attention to Permit Condition 3 which requires that the wastewater collection
facilities be properly operated and maintained in accordance with 15A NCAC 2H.0227 or any individual system-
wide collection system permit issued to the Permittee.
Permitting of this project does not constitute an acceptance of any part of the project that does not meet
15A NCAC 2H.0200; the Division of Water Quality's (Division) Gravity Sewer Minimum Design Criteria
adopted February 12, 1996 as applicable; and the Division's Minimum Design Criteria for the Fast -Track
Permitting of Pump Stations and Force Mains adopted June 1, 2000 as applicable, unless specifically mentioned
herein. Division approval is based on acceptance of the certification provided by a North Carolina -licensed
Professional Engineer in the application. It shall be the Permittee's responsibility to ensure that the as -constructed
project meets the appropriate design criteria and rules. Failure to comply may result in penalties in accordance
with North Carolina General Statute § 143-215.6A through § 143-215.6C, construction of additional or
replacement wastewater collection facilities, and/or referral of the North Carolina -licensed Professional Engineer
to the licensing board.
In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North Carolina as
amended, and other applicable Laws, Rules, and Regulations, permission is hereby granted to the City of Sanford
for the construction and operation of approximately 4,050 linear feet of 8 -inch gravity sewer to serve 51 three-
bedroom homes as part of the Nottingham Subdivision Phase I project, and the discharge of 18,360 gallons per
day of collected domestic wastewater into the City of Sanford existing sewerage system, pursuant to the
application received August 31, 2001 and in conformity with 15A NCAC 2H.0200-, the Division's Gravity Sewer
Minimum Design Criteria adopted February 12, 1996 as applicable; the Division's Minimum Design Criteria for
the Fast -Track Permitting of Pump Stations and Force Mains adopted Jone 1, 2000 as applicable; and other

DRIVEWAY SPECIAL
PROVISIONS
The entrance on to SR 1406 is to be constructed in accordance with the attached plan/detail
sheets. At no time shall run-off enter the travel lanes of SR 1406.
2. All soil areas within the right-of-way on SR 1406 and any other soil areas disturbed during
construction shall be seeded and mulched immediately upon completion of driveway
construction.
3. No parking or outdoor advertising signs shall be allowed inside the right-of-way of SR 1406.
4. Erosion control devices must be in place and functioning during the construction phase.
5. Driveway entrance shall require 108' of 18" pipe (reinforced concrete pipe is recommended).
The driveway pipe is to be furnished by the owner, installed by the owner, and inspected by
the Department of Transportation at a set rate of $50.00.
6. This permit is for access to SR 1406 only. It is not Certification of Subdivision Plats as
stated in General Statute 136-102.6.
7. Contact Mr. Steve Davis, Lee County Road Supervisor, at (919) 775-3122 about setting
grades for installation of the driveway pipe.
8. Where a new street or driveway connection is made to the State Highway System, a
permanent pavement should be placed to the end of the connecting radii, sidewalk, or
other portion of the connection within the highway right of way. Where application
for access is made for a commercial or industrial development, permanent pavement
should be placed to the right of way line or to the radius point, which ever distance is
the greater of the two.
9. Please contact Mr. Johnny Ransdell, County Maintenance Engineer, upon completion of the
driveway.
10. It is agreed that the Department of Transportation grants to the owner/applicant the
right and privilege to make this driveway connection as shown on attached plan
sheets, specifications, and special provisions 1 to 9 which are made a part hereof.

The Authorization to Construct is valid for 24 months from the date of this letter. Authorization to Construct
may be extended if the Rules Governing Public Water Supplies and site conditions have not changed. The
Authorization to Construct and the engineering plans and specifications approval letter, shall be posted at the
primary entrance of the job site before and during construction.
Approval must be secured from the Department before any construction or installation if:
Deviation from the approved engineering plans and specifications is necessary; or
There are changes in site conditions affecting capacity, hydraulic conditions, operating units, the
function of water treatment processes, the quality of water to be delivered, or conditions imposed by
the Department in any approval letters.
Upon completion of the construction or modification and in accordance with Rule .0303, the applicant shall
submit a certification statement signed and sealed by a registered professional engineer stating that construction
was completed in accordance with approved engineering plans and specifications, including any provisions
stipulated in the Department's engineering plan and specification approval letter. Prior to Final Approval, the
applicant shall submit a signed certification stating that the requirements in 15A NCAC 18C .0307 (d) and (e) have
been satisfied and if applicable, a completed application for an Operating Permit and fee. Once the certification
statements and operating permit application and fee, if applicable, are received and determined adequate, the
Department will grant Final Approval in accordance with Rule .0309 (a). Therefore, no construction, alteration, or
expansion of a water system shall be placed into service until Final Approval has been issued by the Department.

Blocks 1 through 4. To be completed by Corps of Engineers
Black S. AppRcont's Name. Enter the name of the responsible party or parties. If the responsible pon party is an agency,
company, corporation or other organization, indicate the responsible officer and title. If more than one party is
associated with the application, please attach a sheet with the necessary information marked Block S.
Block 6. Address of Appliicant. Please provide the full address of the party or parties responsible for the application.
If more space is needed, attach an extra sheet of paper marked Block 6.
Block 7. Applicant Telephone Nundw(s). Please provide the number where you can usually be reached during normal
business hours.
Blocks 8 through 11. To be completed if you choose to have an agent.
Block S. Authorized Agent's Nene and Title. Indicate name of individual or agency, designated by you, to represent
you in this process. An agent can be an attorney, builder, contractor, engineer or any other person or organization.
Note: An agent is not required.
Blocks 9 and 10. Agent's Address and Telephone Number. Please provide the complete mailing address of the agent,
along with the telephone number where he/she can be reached during normal business hours.
Block 11. Staternsnt of Authorization. To be completed by applicant if an agent is to be employed.
Block 12. Proposed Project Name or Title. Please provide name identifying the proposed project (i.e., Landmark
Plaza, Burned Hills Subdivision or Edsall Commercial Center).
Block 13. Name of Waterbody. Please provide the name of any stream, lake, marsh or other waterway to be directly
impacted by the activity. If it is a minor (no name) stream, identify the waterbody the minor stream enters.
Block 14. Proposed Project Street Address. If the proposed project is located at a site having a street address (not a
box number), please enter here.
Block 15. location of Proposed Project. Enter the county and state where the proposed project is located. If more
space is required, please attach a sheet with the necessary information marked Block 15.
Block 16. Odor Location Descriptions. If available, provide the Section, Township and Range of the site and/or the
latitude and longitude. You may also provide description of the proposed project location, such as lot numbers, tract
numbers or you may choose to locate the proposed project site from a known point (such as the right descending
bank. of Smith Creek, one mile down from the Highway 14 bridge). If a large river or stream, include the river mile of
the proposed project site if known.
Block 17. Directions to the Site. Provide directions to the site from a known location or landmark. Include highway
and street numbers as well as names. Also provide distances from known locations and any other information that
would assist in locating the site.
Block 18. Nature of Activity. Describe the overall activity or project. Give appropriate dimensions of structures such
as wingwalls, dikes (identify the materials to be used in construction, as well as the methods by which the work is to
be done), or excavations (length, width, and height). Indicate whether discharge of dredged or fill material is involved.
Also, identify any structure to be constructed on a fill, piles or float supported platforms.
The written descriptions and illustrations are an important part of the application. Please describe, in detail, what you
wish to do. If more space is needed, attach an extra sheet of paper marked Block 18.
Bock 19. Proposed Project Purpose. Describe the purpose and need for the proposed project. What will it be used for
and why? Also include a brief description of any related activities to be developed as the result of the proposed project.
Give the approximate dates you plan to both begin and complete all work
Block 20. Reason(s) for Discharge. If the activity involves the discharge of dredged and/or fill material into a wetland or
other waterbody, including the temporary placement of material, explain the specific purpose of the placement of the
material (such as erosion control).
Block 21. Types) of Material Being Discharged and the Amount of Each Type in Cubic Yards. Describe the
material to be discharged and amount of each material to be discharged within Corps jurisdiction. Please be sure this
description wig agree with your illustrations. Discharge material includes: rock, sand, clay, concrete. etc.
Block 22. Surface Areas of Wetlands or Other Waters Filled. Describe the area to be filled at each location.
Specifically Identify the surface areas, or part thereof, to be filled. Also include the means by which the discharge is to be
done (backhoe, dragline, etc.). If dredged material is to be discharged on an upland site, identify the site and the steps to
be taken ()f necessary) to prevent runoff from the dredged material back into a waterbody. If more space is needed, attach
an extra sheet of paper marked Block 22.
Block 28. Is Any Portion of the Work Already Complete? Provide any background on any part of the proposed project
already completed. Describe the area already developed, strictures completed, any dredged or fill material already
discharged, the type of material, volume in cubic yards, acres filled, if a wetland or other waterbody (in acres or square
feet). If the work was done under an existing Corps permit, identify the authorization if possible.
Block 24. Names and Addresses of Adjoining Property Owners, Lessees, etc., Whose Property Adjoins the
Project Site. List complete names and fug mailing addresses of the adjacent property owners (public and private) lessees,
etc., whose property adjoins the waterbody or aquatic site where the work is being proposed so that they may be notified of
the proposed activity (usually by public notice). If more space is needed, attach an extra sheet of paper marked Block 24.
Information regarding adjacent landowners Is usually available through the office of the tax assessor in the
county of counties where the project is to be developed.
Block 25. Information about Approvals or Deniale by Other Agencies. You may need the approval of other Federal,
state or local agencies for your project. Identify any applications you have submitted and the status, if any (approved or
denied) of each application. You need not have obtained all other permits before applying for a Corps permit.
Block 26. Signature of Applicant or Agent. The application must be signed by the owner or other authorized party
(agent) . This signature shall be an affirmation that the party applying for the permit possesses the requisite property rights
to undertake the activity applied for (including compliance with special conditions, mitigation, etc.).
DRAWINGS AND ILLUSTRATIONS
General Information.
Three types of illustrations are needed to properly depict the work to be undertaken. These illustrations or drawings
are identified as a Vicinity Map, a Plan View or a Typical Goss -Section Map. Identify each illustration with a figure
or attachment number.
Please submit one original, or good quality copy, of all drawings on 8 1/2x t 1 inch plain white paper (tracing paper or
film may be substituted). Use the fewest number of sheets necessary for your drawings or illustrations.
Each illustration should identify the project, the applicant, and the type of illustration (vicinity map, plan view or
cross-section) . While illustrations need not be professional (many small, private project illustrations are prepared by
hand), they should be clear, accurate and contain all necessary information.
