3. Project Description
3a. Describe the existing conditions on the site and the general land use near the project at the time of this application:
The project site (Tract 1), where the subdivision is to be located, has been cleared of underbrush and insignificant
trees, over the years. One residential dwelling, a barn and non -jurisdictional, horseshoe shaped pond exists on the
property. Wetlands and a stream can be found along the western property boundary and southwestern corner of the
parcel (see Appendix A). The wetland and stream also extend into the CFPUA utility easements on the Pennington's
(Tract 2) and the Ogden 12 Properties, LLC's (Tract 3) properties (see Appendix D). There appears to be an existing
8" sewer line within the easement, on the Park at Three Oaks Apartments (Tract 4). SEGi is not aware of any permits
for wetland impacts being issued for that utility line. The work is proposed to take place within the CFPUA utility
easement areas only. Deeded easements have been secured by the CFPUA (see Appendix B-2). Residential is the
general land use in the area.

3d. Explain the purpose of the proposed project:
The purpose of the project is install and connect to an existing CFPUA water main, located within an existing CFPUA
utility easement. The water line will service the proposed 35 lot, Catherine's Cove Subdivision.
3e. Describe the overall project in detail, including the type of equipment to be used:
Prior to construction commencing, sedimentation and erosion control structures will be installed. Large machinery,
such a backhoe will be used excavate a pit within the wetland, to install an 8" water main. The pipe will need to be
buried at least 3' below existing grade. Approximately 6241 SF / 0.10 AC) of forested, bottomland hardwood forest
and 45 linear feet of stream will be temporarily impacted to install the water main (see Appendix D for details). An
earthen berm will hold water back in the stream, while the water main is being installed. Once work has been
completed, which will be in sections, the excavated material will be put back to its original grade and contour, seeded
with a wetland seed mix and allowed to revegetate naturally. The stream bed will be returned to its original grade
and contour and lined with jute mat. Several coir baffles will also be installed, to lower the velocity of water in this
area and to assist with the accumulation of sediments and larger debris, such as leaves, small branches, etc., which
will advance the restoration of the stream bed. Excelsior matting will be used along the slopes of the banks.

D. Impact Justification and Mitigation
1. Avoidance and Minimization
1 a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project.
The project was designed to avoid permanent impacts for roads and dwellings. The proposed wetland impact has
been limited to the temporary impact work, within a limited amount of space. The Utility line only crosses wetlands
where necessary. In addition, sediment and erosion control measures have been incorporated into the construction
design to ensure sediment and/or turbid water does not discharge into adjacent wetlands.
2b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques.
A trench box will be used to minimize the area to be excavated, thus limiting the area of wetland impact. In addition,
work within the stream will not take place within 48 hours of a rain event that is forecast to produce more than 0.50"
of rain within a 24-hour period or after a rain event that produced more than 0.50" of rain within a 24-hour period.
If necessary, water will be pumped into the pond, to avoid overbank flooding and silt fence will be used along the
limits of disturbance, to ensure sediment does not leave the authorized impact area. Coir baffles will be installed
within the stream to catch sediment, reducing the potential for it to be deposited downstream.

THAT, WHEREAS, Grantors own real property which they acquired by a deed recorded in
Book 1524, at Page 491 of the New Hanover County Registry (the "Pennington Property"); and
WHEREAS, Highgreen Drive, LLC, is purchasing adjacent property on the Northeast side
of the Pennington Property which is owned by Jabe and Shirley Hardee, who acquired the Property
by deed in Book 1253 at Page 507 of the New Hanover County Registry; and
WHEREAS, Grantors and Grantee hereby state the terms and conditions of their agreement
according to which Grantors shall transfer to Grantee an access and utility easement for sewer and
water facilities (the "Easement") over the Pennington Property as set forth in the attached description
and Exhibit drawing on Exhibit "A" incorporated herein by reference.
NOW, THEREFORE, Grantors for and in consideration of the sum of Ten Dollars ($10.00)
and other good and valuable consideration, to them in hand paid by Grantee, does hereby give, grant
and convey unto Grantee and it heirs and assigns and successors in title for the benefit and as an
appurtenance to the Highgreen Drive, LLC Property, the following rights and easement over and
across the Pennington Property, to have and to hold said rights and easement in perpetuity to Grantee
and its heirs, assigns and successors in title, subject to the following terms and conditions.
1. Grantor hereby gives, grants and conveys to Grantee and Grantee heirs, assigns
and successors in title an access and utility easement for purposes of tying into the existing utility

easement recorded in Book 4235 at Page 862 of the New Hanover County Registry for ingress,
regress and egress and the installation, construction, operation, maintenance, repair and replacement
of utility facilities (including, without limitation, facilities providing electric, water, sewer, storm
water drainage, gas, telephone, fiber optic and cable service) over, across, under and upon the
easement being more particularly described on Exhibit "A" which. is shown and depicted on a
drawing by Gary W. Keyes Land surveying P.C., as Exhibit `B" and is suitable for deed attachment
to help locate the easement attached and incorporated herein by reference.
2. Grantee shall be entitled to construct within the Easement such landscaping,
fencing, pipes, conduits and utilities as Grantors deems necessary and/or appropriate to provide for
residential homes to be constructed.
3. The rights and obligations of this Agreement shall run with title to the Highgreen
Drive, LLC Property and shall be binding upon the heirs, assigns and successors in title of the
Grantors and shall inure to the benefit of the heirs, assigns and successors in title of the Grantee.

WHEREAS, GRANTOR owns property within the area of New Hanover County to be
served by the County's sewer system; and
WHEREAS, GRANTEE requires an easement for the purpose of constructing and
maintaining water and sewer lines, and GRANTOR has agreed to convey the necessary easements
to GRANTEE;
NOW THEREFORE, GRANTOR, for and in consideration of the sum of One Dollar
($1.00) and other valuable consideration to it in hand paid by GRANTEE, and in consideration of
the mutual benefits inuring to the parties hereto, does hereby give, grant and convey unto
GRANTEE a perpetual right and easement as more fully described in the paragraphs below.
1. Location of Easement. Being a permanent sewer and water easement on the
property of the above -referenced GRANTOR described in Deed Book 4572, Pages 269 - 271, New
Hanover County Registry, said property containing approximately 9.83 acres, and being more
specifically described as shown as Tract A on a map of Three Oaks Division recorded in Map Book
47, Page 42, of the New Hanover County Registry.
2. Purpose of Easements. The purpose of the easement is for water and sanitary sewer.
GRANTEE'S rights shall include constructing, laying, maintaining, inspecting, operating,
protecting, repairing, changing the size of, replacing, removing or abandoning lines and facilities,
and removing structures, fences, trees, shrubs and vegetation within the easement area. GRANTOR
shall have the right to use and enjoy said easement area subject to the easement and rights herein
granted. At the conclusion of any installation or maintenance activities within the above-described
easement, the GRANTEE will return the easements to as near prior conditions as feasibly possible.
3. Restrictions on Grantor's Use of Easements. GRANTOR agrees not to place,
construct, deposit, leave, permit to be or remain on, within or over any easement for public water
and/or sewer use, any construction materials, metals, lumber, trees, berms, water bodies, rubbish,
refuse, fences, structures, buildings or other obstructions, except for vegetation existing at the time
of the herein conveyance and for permeable surface coverings of stone and gravel suitable for
parking automobiles; provided, however, that any such coverings shall be at the GRANTOR'S sole
cost and expense and risk of loss and GRANTEE shall have no responsibilities for disturbing the
same, from time to time, as GRANTEE deems appropriate in carrying out the purpose of this
EASEMENT. Obstructions shall constitute an easement nuisance under Section 56-287 of the New
mentioned in this instrument, any restrictions of record, any utility or drainage easements of record,
and the lien of local property taxes; and that it shall, and its successors and assigns shall, warrant
and defend the title to said easement against the lawful claims and demands of any and all persons
whomsoever.
TO HAVE AND TO HOLD the right and easement hereby granted to the GRANTEE and
its successors in tide forever; it being agreed that the right and easement hereby granted are
appurtenant to and runs with the lands now owned by GRANTOR.
