I agree that it would not be the most efficient way to do things and we are trying to complete the on-site mitigation plans and documentation prior to the permit application being submitted, but I wanted to check with you since there is a possibility that it will not be done prior to our submittal. We have already paid for the compensatory mitigation for the B section when we submitted the permit for the A Section, so that should not be an issue with having that covered. The simple answer is yes, you could submit the permit mod request with NCDMS as the proposed compensatory mitigation method, assuming the NCDMS approval covers all proposed impacts. That being said, it's not a very efficient way to go about permitting given everyone's workload, and knowing that there will have to be another permit mod request in the very near future. Also, NCDOT would have to pay NCDMS for the compensatory mitigation prior to initiating to any impacts in phase B, or have the on-site compensatory mitigation approved via subsequent mod prior to initiating to any impacts in phase B. Chris Underwood informed me that they are still in the process of finalizing things for the on- site mitigation for the project; however, there is a potential that this will not be completed by the time that we would need to submit the permit modification request. The let date for the project is currently July, with a let review date at the end of May, so we would need to submit the application in the very near future to stay on schedule. We currently have DMS coverage for the B Section impacts since we had to acquire it when we submitted the initial permit application last year. Would it be possible to submit the modification request with DMS covering the mitigation requirements, then submit a modification to that in the future to convert the mitigation from DMS to on- site when Chris is able to finalize that information? Also, if this is possible, would we submit that as a modification to the IP modification or would it need to be submitted in another way or under another permit type? If you could email me back when you have an opportunity it would be much appreciated.
