, as requested in the permittee's application dated 5/2/17, including attached
workplan drawin�(2): 1 dated 4/20/17, and 1 dated 5/15/17, and attached AEC Hazard Notice dated 7/10/17.
This permit, issued on Julv 21. 2017 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terrns may
be subject to fines, imprisonment or civil action; or rnay cause the permit to be rtull and void.
1} Unless specifically altered herein, this Major Madification authorizes the following: (1) the expansion
of the currently permitted channel at the entrance/exit ta the Southdock Ferry Facility basin not to
exceed the limits of excavation shown on the attached workplan drawing dated 5/15/17; and (2)
placement of the excavated material by pipeline dredge on the Hatteras Inlet beach shoreline adjacent
to the vehicle sta.cking lanes/hairpin turn at the northern terminus of Ocracoke Island, ar at the existing
upland spoil site on Ocracoke Island, all as depicted on the attached workplan drawings.
2) No in-water work shall be conducted between April 1 to September 30 of any year without prior
approval of the N.C. Divisian of Coastal Management (DCM}, in consultation with the appropriate
resource agencies.

This permit action may be appealed by the pertnittee or
other quali�ed persons within twenty (20) days of the issuing
date.
This permit must be accessihle on-site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2021
In issuing this permit, the State of North Carolina ,agrees
that your project is consistent with the North Carolina Caastal
Management Program.

Chairman of the Coastal Resources Commission.

ADDITIONAL CONDITIONS
3) Excavation sha11 not exceed -12 feet below the mean low water level. In no case shalt the depth of
excavation exceed the depth of conr�ecting waters.
4) If, duz7ng project activity, submerged materials of archaeological significance are encountered, the
permittee sha11 immediately cease work and notify DCM at {252) 264-3901.
5) No vegeta.ted wetlands or waters of the State, including submerged aquatic vegetation (SAV), sha.11 be
excavated or filled, without permit modification.
Beach Disnosal and Dune Maintenaace
6) The permittee shall ensure that all disposal material placed on th,e beach is compatible with native beach
mate�.al in the project area. Shauld the excavation operations encounter sand deemed non-compatible
with the characteristics of the native beach, the permittee sha11 immediately cease operation and contact
DCM. Permitted activities shall resume only after resoIution of the issue of sand compatibility.
NOTE: The permittee is advised that any submerged lands that are currently located below the mean
high water line, and that are raised above the mean high water Iine as a result of ihe authorized
project, vcrill remain in public ownership, either by the State of North Carolina or the National
Park Service (NPS). The permittee is strongly encouraged to coordinate the proposed project
with both the N.C. Sta.te Property Office and NPS ta ensuxe that unforeseen issues relating to
property rights do not occur.
7) Where beachfront development exists at elevations neaxly equal to that of the native beach, a low
protective dune sha11 be pushed up along the backbeach to prevent slurty from draining towaxds the
raadway or adjacent development.
8} The north and south ends of the beach disposal area shall angle onto and blend with the existing adjacent
beaches.
9) T'he authorized dunes shall be stabilized with appropriate vegetation as quickly as is feasible. The
pianting shall be done in a manner acceptable to DCM and NPS. If the vegetation is nat successful, then
replanting of the dune may be required within ane year of notification by DCM and/or NPS.
10) The authorized dune maintenance aciivities may not result in impacts to the existing frontal dune systems
that would �eaken the pratective values of those dune systems. Any alteration of existing dunes shall be
coordinated with DCM and NPS.
Maintenance Clause
11) The existing maintenance clause provisions of the active Permit No. 224-87 shall apply to the excavation
and assaciated spoil disposal and dune maintenance that are authorized by this Major Mo�.ification.

12} The permittee and/or his contractor shall conta.ct the DCM Transportation Field Repxesentative in
Elizabeth City at (252) 264-3901 to request a preconstruction conference prior to project initiation.
13) If it is determined tha� additional permanent and/or temporary impacts are necessary that are not shown on
the attached work plan drawings or described in the authorized permit application, a permit modification
andlox additianal authorization from DCM shall be required. In addition, any changes in the approved
plan may also require a permit modification and/or additional autharization from DCM. The permittee
shall contact a representative of DCM prior to commencement of any such activity for this determination
and any permit modificatian.
14) Nothing iz� this permit authorizes any activity which has not received approval from NPS far work within
the Cape Hatteras National Seashore. The praposed work shall not commence until the pernuttee has
been issued a Special Use Permit from the NPS, if one is required, and a copy of the Special Use Permit is
received by DCM.
1 S} The N.C. Division of Water Resources (DWR) authorized the proposed praject on 6/23117 (DWR Project
No. 20170508} under Water Quality Certification No. 004115. Any violation of the Certifications
approved by DVJR shall be considered a violation of this CAMA permit.
NOTE: The U.S. Army Corps of Engineexs has assigned the project Action ID No. �AW-2017-00407.
lb) This Major Modification does not eliminate the need to obtain any additianal permits, approvals or
authozizations that may be required.
17) This Major Modification sha11 be attached to the original of Permit No. 224-87, which was issued on
11/20/87, as well as all subsequent modifications, renewals and letters of refznement, and copies of all
documents shall be readily available on site when a Division representative inspects the project for
cornpliance.
1 S) All conditzons and stipulations of the active permit remain in force under this Major Modifcation unless
altered herein.
NOTE: A major modification application processing fee of $475 was received by DCM for this project.
