Subject: DWR 2017-1512 Lake Lure Dredging
On November 27, 2017, the Division of Water Resources (Division) received your application dated November 15, 2017,
requesting a 401 Water Quality Certification from the Division for the subject project. The Division has determined that
your application is incomplete and cannot be processed. The application is on hold until all of the following items are
addressed:
1. Specify on a map the location where dredge spoils will be hauled to, what erosion control measures will be in place,
and how spoils will be stabilized. Please confer with Division of Energy Minerals and Land Resources to determine
whether a sediment and erosion control plan will be needed. A map is attached. I have left messages for the Division of
Energy Minerals and Land Resources in their general voicemail box, but haven't received a return telephone call. Could
you advise someone specific I can contact?
2. Will water from the dredge spoils at the disposal site(s) flow into Waters of the US? If so, what measures will be used
to manage this return -water? The contractor advised there is a river located a minimum of 250 feet from the disposal
area, but water from the spoils will not flow into the river.
3. Provide information on the estimated volume of dredge material to be removed. 350 yards
4. Demonstrate how stream flow from the unnamed tributary into Lake Lure will be maintained through the proposed
dredge area, so as to not violate water quality standards while work is in progress. We asked the contractor to assist in
answering this because we were unable. He advised that the area he will be dredging is in Lake Lure, not the

tributary. He advised the flow of water would continue during the dredging. He stated as he dips the bucket into the
lake to remove the sediment it would disturb the lake bottom. The water flow from the tributary is traveling through
the sediment that needs to be removed and he wasn't aware of any way to remove the sediment without disturbing the
lake bottom or the water flow.
Pursuant to Title 15A NCAC 02H .0502(e), the applicant shall furnish all of the above requested information for the
proper consideration of the application. Please provide a response by January 15, 2018.
