TROGDON, III SECRETARY Subject: Ocean Outfall #6 Maintenance and Repair in Kill Devil Hills, Dare County Dear Gary Jordan, The NC Department of Transportation requests concurrence on a"May Affect, Not Likely to Adversely Affect" determination on potential impacts to Sea Turtles, Piping Plovers, and Red Knots for an ocean outfall project in Dare County. The outlet of Ocean Outfall #6 at Lake Drive is in need of repair, and NCDOT proposes to replace the last 60 feet of existing 36" RCP with 60 feet of 36" CAP. The existing ocean outfall outlet is located within the existing intertidal zone. The project is scheduled to be completed by NCDOT maintenance personnel in April, but may be pushed into the month of May if inclement weather occurs. The ocean outfall is located at a beach access, and the work would occur within 100 feet of either side of the outfall during daylight hours. Construction equipment will be moved to the beach access and stored off the beach each night. Considering the limited scope of work area and restriction to daylight hours, it is my opinion that proposed project justifies a biological conclusion of "May Affect, Not Likely to Adversely Affect" for protected sea turtles, Piping Plovers, and the Red Knots. If the project is pushed into the month of May, NCDOT will conduct a turtle crawl survey (starting May 1S`) within the project vicinity each morning prior to any work taking place, and a log will be generated. If any turtle crawl is observed, NCDOT will stop work and consult with the NCWRC prior to any further work taking place. NCDOT is coordinating with the NCDCM, NCDWR, and USACE for the proposed ocean outfall repair project. If you could please review the attached plans and project area map.
