I am copying you both since I'm not sure who will handle this one. Steve issued the
original permit.
In a nutshell, we have completed this project but the wet pipe at station 126+87 turned
out to be shorter than it needs to be. It appears to be an error by the designer. There is
essentially no shoulder on the approach to the nearby bridge. We need to extend the
wet pipe at station 126+87 by an additional 30' and request that the permit be modified
to reflect that. I have attached photos of the area and modified the mitigation needed
already. Dave — please change the 401 accordingly. WBS is 11C.014088. The permit fee
will be $570.
The last photo was taken while looking upstream from the other side of the road. Let
me know if you have questions or need additional information.

The purpose of this letter is to notify you that the Division of Mitigation Services (DMS) will provide
the additional compensatory stream mitigation for the subject project. Based on the information supplied by you
on March 12, 201 S, the impacts are located in CU 03050101 of the Catawba River basin in the Northern
Mountains (NM) Eco-Region, and are as follows:

This additional impact and associated mitigation needs were not projected by the NCDOT in the 2018
impact data. DMS is currently providing stream mitigation for the impacts associated with this project located
in cataloging unit 03050101 of the Catawba River basin as required by the 404 permit issued in March 2016 as
shown in the below table (in mitigation credits):

DMS will provide the amount of mi6gation as determined by the regulatory agencies.
This mitigation acceptance letter replaces the mitigation acceptance letters issued on August 12,
2015. This impact and associated mitigation need were under projected by the NCDOT in the 2018 impact data.
DMS will commit to implement sufficient compensatory stream mitigation credits to offset the impacts
associated with this project as determined by the regulatory agencies using the delivery timeline listed in Section
F.3.c.iii of the In-Lieu Fee Instrument dated July 28, 2010. If the above referenced impact amounts are revised,
then this mitigation acceptance letter will no longer be valid and a new mitigation acceptance letter will be
required from DMS.

Your work is authorized by the above referenced permit provided it is accomplished in strict accordance with the attached
conditions and your submitted application and attached information dated August 11, 2015 . Any violation of the
attached conditions or deviation from your submitted plans may subject the permittee to a stop worl� order, a restoration
order, a Class I administrative penalty, and/or appropriate legal action.
This verification will remain valid until the expiration date identified below unless the nationwide/regional authorization is modified,
suspended ar revoked. If, prior to the expiration date idenrified below, the nationwide/regional permit authorizarion is reissued and/or
modified, this verification will remain valid unril the expirarion date idenrified below, provided it complies with all requirements of
the modified narionwide/regional permit. If the nationwide/regional permit authorizarion expires or is suspended, revoked, or is
modified, such that the activity would no longer comply with the terms and condirions of the nationwide/regional permit, acrivities
which have commenced (i.e., are under construcrion) or are under contract to commence in reliance upon the nationwide/regional
permit, will remain authorized provided the activity is completed within twelve months of the date of the nationwide/regional permit's
expiration, modification or revocation, unless discretionary authority has been exercised on a case-by-case basis to modify, suspend ar
revoke the authorization.
Activities subject to Section 404 (as indicated above) may also require an individual Section 401 Water Quality Certification. You
should contact the NC Division of Water Resources (telephone 919-807-6300) to determine Section 401 requirements.

Basis for Determination:
The stream channel within the project area is an unnamed tributary (UT) to Mulberry Creek which flows into the
Upper Catawba Watershed; Santee Basin; HUC: 0305010L The UT to Mulberry Creek flows to the Atlantic Ocean
via Mulberry Creek, Johns River, the Catawba River and the Santee-Cooper River. The Catawba River is a Section
10 Navigable-In-Fact water starting at the Mt. Island Lake Dam.
Remarks: This jurisdictional determination pertains to only the 12 impact areas within the project area.

This delineation/determination has been conducted to identify the limits of Corps' Clean Water Act jurisdiction for the particular site
identified in this request. The delineation/determination may not be valid for the wetland conservation provisions of the Food Security

1) In order to compensate for impacts associated with this permit, mitigation shall be provided in
accordance with the provisions outlined on the most recent version of the attached Compensatory
Mitigation Responsibility Transfer Form. The requirements of this form, including any special
