Bulk petroleum liquids are stored at this facility in covered tanks without exposure to storm water and
rainfall. However, petroleum liquids may have the potential to be exposed to storm water during
transfer activities at the facility. Past and present materials management practices employed to
minimize contact by these materials with storm water runoff include the sheltering of transfer areas
from rainfall and no spill/leak transfer procedures. All petroleum liquid storage areas and transfer
areas are contained by secondary containment measures including earthen berms and concrete dikes

Apex Oil Company, Inc (Apex) currently operates a bulk petroleum liquids storage terminal in
New Hanover County, Wilmington, NC along the Cape Fear River dust south of the Port of
Wilmington. The terminal has bulk petroleum liquids storage capacity in excess of one million
gallons Due to modifications proposed for the secondary containment structures associated with
the current terminal, Apex is applying for an NPDES Minor Industrial permit in order to manage
accumulated stormwater. The terminal has historically never discharged water as part of routine
operations and has thus never obtained or held an NPDES Minor Industrial permit As a part of
the NPDES permit review process, the North Carolina Department of Environmental Quality has
required Apex to prepare an Engineering Alternatives Analysis (EAA)
This EAA is submitted to comply with the NCDEQ's requirements for a Minor Industrial NPDES
permit application The Apex terminal proposes to only discharge stormwater collected from
within the facility's secondary containment areas after the water has been processed through
settling basins and oil water separators and met all enforceable effluent limitations This project
does not involve domestic wastewater discharge Data collected and presented within this
document reasonably demonstrates that a direct discharge is the most environmentally sound
alternative selected from all reasonably cost-effective options
This EAA document presents all information requested in electronic correspondence from Mr
Charles Weaver on November 27, 2017 as well as all information required in the Engineering
Alternatives Analysis (EAA) Guidance Document found on the Division of Water Resources
website The structure of this document will follow the four steps presented in the guidance
document previously mentioned
The facility is located at River Road and consists of two properties The first property is located
at 3314 River Road This is a 28 82 acre area on the west side of River Road with 16 tanks total
The second property is at 3329 River Road and is 10 23 acres on the east side of River Road
with 5 tanks total Partial topo survey was provided by the client, and stage storage volume was
analyzed (by others) per tank farm to identify areas of containment The proposed containment
system discharge will discharge to the Cape Fear River A Site Location Map is attached as
Figure 1
1.1 Remediation System Description
There are 7 tank farm containment areas that house the two tank parcels — Tank farm #1 drains
to outfall 002 Tank farms #2 through tank farm #7 drain to outfall 003 Outfall 001 and 004 are
bypass/emergency outfalls associated with these areas Culvert pipes connect the containment
areas to the ultimate treatment facility A Site Map is included as Attachment 1 to provide site
detail and proposed outfall locations
The surface water gravity feeds to the stormwater (SW) retention ponds were applicable. For
low lying areas this water is pumped through a pressurized force main The water settles in the
SW retention pond, enters an oily water separator and then outfalls to the Cape Fear river

2 Potential Restrictions
2.1 Zero Flow Restrictions
The Cape Fear River at our point of interest is tidally affected The USGS currently refrains from
providing low -flow estimates for streams known or suspected of being tidally affected
Correspondence with the USGS is included as Attachment 2 The facility will not discharge any
oxygen -consuming waste
2.2 Receiving Stream Classification Restrictions
There are no receiving stream classification restrictions for the Cape Fear River at the point of
discharge that would prohibit wastewater discharge to surface waters The receiving stream is
classified as Tidal Salt Water SC (PNA) by the Division of Water Resources (DWR)
2.3 Basinwide Water Quality Plans
The proposed point of discharge is located in the Cape Fear River Basin, specifically the subbasin
Lower Cape Fear (HUC 03030005) The basin -specific plan published in 2005 identifies one
permit limit to be recommended for oxygen -consuming wastes pertaining to new industrial
discharges The limit is as follows New Industrial discharges BOD5 = 5 mg/I, NH3-N = 2 mg/I
This facility will not discharge any oxygen -consuming waste (See Attachment 2)
2.4 Impaired Waters and TMDLs
The Cape Fear River at the point of discharge is listed as impaired on the 2014 303(d) list. The
2014 AU Number is 18-(71)a3. The Parameters of Interest are Copper and Dissolved Oxygen.

2.6 Presence of Endangered Species
A query of the North Carolina Natural Heritage Program (NCNHP) database indicates that there
are records for rare species, important natural communities, natural areas, or
conservation/managed areas within the proposed project boundary There are no endangered
species present within the project boundary The NCNHP query results are presented in
Attachment 4

Monthly averages have been calculated based upon average annual precipitation received in the
Wilmington, NC area of 571n/year and the proposed impervious drainage area Stormwater
volumes are not expected to change over the next 20 -years

3.1 Connect to a Local POTW
The Cape Fear Public Utility Authority operates a publicly owned treatment works (POTW) system
for the Wilmington area Per a phone conversation on December 20, 2017 between Nick Parks
and David Dailey with the CFPUA, the CFPUA does not currently accept stormwater discharge
to the POTW system An Opinion of Cost for this option was not completed

3.2 Land Application
The current site has secondary containment for the tanks for a majority of the site There are
developed industrial parcels to the North, East and West of the facility The Cape Fear River is
to the West Land application is infeasible based on land constraints An Opinion of Cost for this
option was not completed
3.3 Wastewater Reuse
The facility is a fuel storage facility, and therefore does not require water for operations The only
possible re -use would be for limited irrigation purposes There is currently no irrigation system at
the site and no plans to install one since secondary containment is being installed for the majority
of the site An Opinion of Cost for this option was not completed
4 ECONOMIC FEASIBILITY OF ALTERNATIVES
Due to current existing infrastructure, land uses, limited land availability, discharge options for the
collected stormwater at the Terminal are very limited The alternatives discussed above are not
feasible at this time, therefore, an economic feasibility evaluation of alternatives was not
conducted
5 Local Government Approval
Per a conversation between Matthew Trottier of Apex Oil Company with Derek Denard of the
NCDEQ Division of Water Resources, the outflow associated with this project does not require
local government approval because the NPDES permit is not for a non -municipal domestic
wastewater treatment facility

In response to your inquiry about the low -flow characteristics (7Q 10) for a location on the Cape Fear River south of Wilmington in New
Hanover County, the following information is provided
The Cape Fear River at your point of interest is tidally affected (lat/long coordinates 34°11' 19"N, 77'57'14"W, provided via your email
dated November 21, 2017)
The USGS South Atlantic Water Science Center (Raleigh office) currently refrains from providing (or updating previously determined) low -
flow estimates for streams known or suspected of being tidally affected.
There are currently no techniques that allow for quantifying the effects of tides on low flows
Concerns that tides may possibly reduce low -flow discharges (that is, relative to low -flow estimates for the same stream not tidally -affected)
lead us to speculate that any such estimates for these streams may be too high Given the "back -n -forth" flow dynamics associated
with tidal effects, attempting to determine low -flow characteristics based on the assumption of uni-directional flow characteristics is not
meaningful
You will need to contact the NCDEQ Division of Water Resources to obtain further guidance concerning any efforts to obtain an NPDES
permit for a location in a tidally -affected stream
I regret this response does not provide the flow statistics you were seeking, but hope this information is helpful in some manner or at least
provides some direction to you in your efforts on this matter
