SUBJECT: Consistency Certification Submission Status for Proposed Impacts to Wetlands to
Facilitate the Construction of a Shopping Center, Surf City, Pender County
(DCM#20080097)
Dear Ms. Williams:
We received the consistency certification of the Land Management Group, Inc. on behalf of
Commercial Property Analysts, Inc. ("Applicant") on July 11, 2008 for proposed impacts to 8.65
acres of wetlands to facilitate the construction of a 220,000 regional shopping center on a 50.58
acre site southwest of the intersection of US 17 and SR 210 near Surf City in Pender County,
North Carolina. On February 24, 2009 we received a project update. According to the project
update, wetland impacts will be reduced to 5.33 acres.
The Division of Coastal Management does not typically issue a consistency concurrence decision
until the applicant has obtained all other required State permits and/or permissions. This allows
for DCM to review the final project that may have been modified to incorporate the requirements
of the other State agencies. Other required State approvals may include, but are not limited to, a
Section 401 Water Quality Certification, an erosion and sediment control plan, a stormwater
management plan, and an acceptance of any proposed mitigation by the State's Ecosystem
Enhancement Program (EEP). Before DCM makes a final decision on this consistency
determination, all of these approvals, as required, must be obtained. Please forward copies of
those approvals as they are received to DCM.
Please provide a summary of the status of all required State approvals/permits. Additionally,
pursuant to 15 NCAC 07M .0700 (Mitigation), please provide a review of how the proposed
project will mitigate its impacts.

Please provide this information prior to March 13, 2009, if feasible. The deadline for completing
the consistency review process is March 27, 2009. In the event that it is not feasible to provide
copies of all required State approvals/permits and a mitigation plan by March 13, 2009, the
deadline for completing the consistency review process may be extend by mutual written consent.
