4a. Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application:*
I This permit modification is necessary due to additional wetland impacts at Site 2. Boardwalk became unfeasible
due to the presence of unknown utilities and access concerns for utility ROW.
The proposed multi-use trail, located in the Town of Apex in western Wake County, consists of appro�amately 1.8
miles of asphalt, boardwalk, and concrete greenway trail. The trail will connect to an existing trail section east of
Green Level Church Road, and will progress west to connect to the American Tobacco Trail. E�asting conditions in
I the project vicinity include forested floodplain, sewer easements, and recent/ongoing residential development
projects. Surrounding land use is primarily residential and forest. Easements have been acquired for the length of
I the project.

The greenway will add to the ewsting western Wake County trail net�nrork. This trail section will serve as a vital
connection between two existing trail sections. The completion of this greenway project will support bicycle and
pedestrian travel between residential and recreational centers creating a well-rounded integrated transportation
system.
4g. Describe the overall project in detail, including indirect imapacts and the type of equipment to be used:*
The Town of Cary proposes to construct an appropmately 1.8-mile greenway along the White Oak Creek corridor
which will connect e�asting greenway at Green Level Church Road with the American Tobacco Trail. The trail will
consist primarily of asphalt and boardwalk, with a small section of concrete trail wtiere necessary under the
e�asting Green Level Church Road bridge over White Oak Creek. The greenway will begin at the American
Tobacco Trail as a 10-foot wide asphalt trail, and will progress west within Town property, right-of-way, and
easements. Seven boardwalks will be utilized over four tributary streams and several wetlands.
The location of the proposed trail avoids and minimizes impacts to jurisdictional resources to the maxmum extent
practicable. Where feasible, boardwalk will be used to further avoid and minimize impacts to jurisdictional
resources. The contractor selected for the project will determine the equipment used on the project. Trail
contractors generally use small paving machines and earth moving equipment which results in smaller impacts to
the project area than traditional highway construction equipment. Boardwalks will be constructed utilizing a"top
down" approach to avoid disturbance to the wetland ground surface during construction. Timber mats will be
utilized where temporary access roads are necessary within jurisdictional areas to minimize disturbance.
Nationwide Permit 14 General Conditions will be included in the construction documents to direct contractor
operations in and around wetlands.

project area south and west of 35.768785/-78.916859. The project area north and east of this point was delineated by the Agent/Consultant
and a request for Preliminary JD was submitted. The delineation was field verified by Ms. Tasha Alexander, and the project was assigned
Action ID 2015-00043. In the vicinity of the proposed greenway trail, wetland and stream determinations reflect the results of these two
determinations.

ITrail construction will be limited to upland areas to the extent practicable. Impacts to tributaries and wetlands will
be avoided and minimized by the construction of elevated boardwalk segments. A construction access haul road
necessary to construct boardwalks will utilize timber mats to avoid ground disturbance in wetlands. A small area of
clearing of wetlands will be required in order to construct these boardwalks.

Greenway trails are an allowable use within buffer zones. No practical alternative e�asts which would accomplish
the project goal of constructing a greenway trail to connect nearby existing trail segments.

1. Avoidance and Minimization
1a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project:*
The construction of the White Oak Creek greenway trail will result in no temporary or permanent stream impacts.
Buffer impacts are perpendicular where possible. The following measures have been taken to avoid and minimize
impacts to jurisdictional waters:
Corridor Alignment — The horizontal corridor alignment was designed to avoid and minimize impacts to wetlands,
streams, and buffers to the extent practicable.
Trail Design — Sections of trail which cross wetlands and tributaries will be constructed using elevated boardwalk,
where possible, to avoid impacts to these waters.
Minimize Stream Crossings - A detailed analysis was performed at all proposed stream crossings to identify the
best crossing location. This analysis included locating narrowcrossing locations and, where feasible, crossing
perpendicular to the stream. Boardwalks will be used to cross streams.
Minimize Grading — The trail has been designed, to the extent possible, to match e�sting grade in order to
minimize the amount of fill, reducing the overall project footprint, and thus the impacts to jurisdictional resources.
At Site 2, where additional wetland impact was necessary, fill slopes were steepened from 3:1 to 2:1 in order to
minimize impact.
Minimize Clearing — Where feasible, the trail has been located within cleared sewer easements, minimizing tree
clearing in regulated buffer areas and jurisdictional waters.
Stormwater Treatment — All ditches have been designed to outlet as diffuse flow.
Erosion Control — Silt fence will be installed along fill slopes and upstream of all wetlands and streams. Tree
protection fence will be utilized to demarcate buffer zones in order to maximize protection of riparian areas during
construction.
Buffer impacts are perpendicular wtiere possible and primarily result from the necessity to construct boardwalk to
Iavoid wetland impacts. The only non-perpendicular buffer impact, at permit drawing Site 8, is the result of the
inability to create sharp angles in boardwalk trail segments due to the nature of the material used.
Impervious surface in the buffer, especially Zone 1, is minimized to the extent practicable. Boardwalk approach
slabs are required at permit drawing Sites 1, 3, and 6. At permit drawing Site 1, riprap stabilization is required to
slowwater velocity due to the steep 7% slope and drainage area of ditches on either side of the trail through a
stream buffer. At permit drawing Site 3, a proposed drainage ditch was designed to collect overland flowfrom the
greenway and offsite areas. A riprap dissipator pad was placed at the end of the ditch to reduce velocity and
ensure diffuse flow into the buffer. The ditch was designed to discharge outside both zones of the riparian buffer.
At permit drawing Site 8, impervious surface is required in Zone 1 due to the inability to place a boardwalk
structure under a NCDOT bridge, the narrow available project area, and flood modeling concerns associated with
the elevated boardwalk in a FEMA regulated floodway. For these reasons, concrete trail is shown under and
adjacent to the bridge and Green Level Church road ROW.

The contractor shall be responsible for minimizing impacts through construction techniques. The bid specifications
will call for, where possible, hand clearing, the use of construction mats and low impact machines in sensitive
areas, and small paving machines. Multiple construction entrances have been provided to minimize heavy
equipment trip distances. Nationwide 14 General Conditions will be included in the construction specifications.

Ecological Engineering reviewed the USFWS list of federally protected species documented from Wake County
and the NC Natural Heritage Program database, conducted habitat evaluations, and surveyed for federally
protected species for which potentially suitable habitat was found within the study area. Conclusions were
documented in the approved PCE and submitted to the USFWS Raleigh Field Office. In a letter dated October 4,
2016, the USFWS concurred with "no effecY' determinations for all species except the northern long-eared bat
(NLEB), and noted that the NLEB is covered by an e�asting agreement. The project is in compliance with the
Endangered Species Act.
