Hope your feeling well. LeeAnn is on her way down there currently with the packets containing 5 copies of the maps for our site visits next week. There is also one in Wake Forest that the town has requested to be done. It is being named the Ligion Mill Road extension project. There are 3 streams that will be permitted this winter but a fourth one is intermittent in our proposed crossing area. I would like to have this one verified. The folder includes the initial interest form, 5 packets, and $200 check. Fortunately, it's behind the WF walmart and in between our Rose Oil site at ligon mill & burlington mill road sites and the holden road site in youngsville. If you can't do it, then please let me know Monday when we could visit it. Thanks again for your help and have a great weekend. Director Division of Water Quality December 5, 2006 DWQ EXP# 03-0570v2 Wake County Mr. Harry Mitchell 10405-E Ligon Mill Road Wake Forest, NC 27587 Subject Property: Ligon Mill Road Extension On-Site Determination for Applicability to the Neuse Riparian Area Protection Rules (15A NCAC 2B .0233)-EXPRESS REVIEW PROGRAM On December 5, 2006, at the request of Mr. Jay Keller, an on-site determination was conducted to review one stream feature located on the subject property for applicability to the Neuse Buffer Rules (15A NCAC 2B .0233). The feature is labeled as "A", initialed by Lia Myott and Sonia Gregory on December 5, 2006. The Division of Water Quality (DWQ) has determined that the following: • Feature "A" is subject to the Neuse Buffer Rule from the flag labeled "A I" (at the base of the dam). Feature "A" transitions to a perennial stream at the flag labeled "A2". The intermittent section of Stream A scored a 22.25 on the NCDWQ Stream Identification Form, and a salamander and numerous crane fly larva were found in the perennial section of the stream. This on-site determination shall expire five (5) years from the date of this letter. Landowners or affected parties that dispute a determination made by the DWQ that a surface water exists and that it is subject to the buffer rule may request a determination by the Director. A request for a determination by the Director shall be referred to the Director in writing c/o Cyndi Karoly, DWQ 401 Oversight/Express Review Permitting Unit, 2321 Crabtree Blvd., Raleigh, NC 27604-2260. You must act within 60 days of the date that you receive this letter. Applicants are hereby notified that the 60-day statutory appeal time does not start until the affected party (including downstream and adjacent landowners) is notified of this decision. This determination is final and binding unless you ask for a hearing within 60 days. This letter only addresses the applicability to the buffer rules and does not approve any activity within the buffers.
