TROGDON, III SECRETARY SUBJECT: Pre-Construction Notifcation Pursuant to Nationwide Permit #13 and 33 Bridge No. 16 on SR 1611 over Muddy Creek (Class C), Forsyth County, NC WBS Number: 45727.1.1 Dear Mr. Roden-Reynolds: We are requesting Section 404 Nationwide Permits (NWP) 13 and 33 for the replacement of Bridge no. 16 with a new bridge at the same location over Muddy Creek (Class C) on SR 1611 (Main St) in Rowan County. In addition to the PCN application, included are, a"No Archeological Sites Present or Affected" form for Archeology, a"No Adverse Effect" form for Historic Architecture, permit drawings and a stormwater management plan. The project will permanently impact 73' of Muddy Creek for bank stabilization and temporarily impact 37' of Muddy Creek for bent removal. Bethania National Register Historic District The bridge replacement project falls within the Bethania National Register Historic District. The project has been coordinated with the State Historic Preservation Office. It was deterxnined that the bridge replacement project would have "No Adverse Effect" on the District or the viewshed from those structures within the Bethania Historic District with the following commitments: Two-bar metal rail at bike height Plain concrete treatment to the parapet wall Protected Suecies The U.S. Fish and Wildlife Service (USFWS) lists the Northern long-eared bat (Myotis septentrionalis) as threatened for Forsyth County. There is summer roosting habitat in the existing bridge, which has no evidence of bats, and the surrounding trees for Northern long-eared bat (NLEB). Anticipated tree clearing impacts for this project are estimated to be minimal. The NCDOT determined that the project `May Affect, but is Not Likely to Adversely Affect' the NLEB. A NLEB Screening checklist is attached. No alterations of a known hibernaculum's entrance or interior environment if it impairs an essential behaviaral pattern, including sheltering Northern long-eared bats (January 1 through December 31); 2. No tree removal within a 0.25 mile radius of a known hibernacula (January 1 through December 31); and 3. No cutting or destroying a known, occupied maternity roost tree, or any other trees within a 150-foot radius from the known, occupied maternity tree during the period from June 1 through and including July 31. NCDOT has determined that the proposed action does not require separate consultation on the grounds that the proposed action is consistent with the final Section 4(d) rule, codified at 50 C.F.R. § 17.40(0) and effective February 16, 2016. Section 7 responsibilities are therefore considered fulfilled. Bald Eagles are protected under the Bald and Golden Eagle Protection Act. A desktop-GIS assessment of the project study area, as well as the area within a 1.13-mile radius (1.0 mile plus 660 feet) of the project limits, was performed in October 2016 using 2014 color aerials. There are water bodies large enough and sufficiently open to be considered potential feeding sources within 1.13 miles of the project limits. However, a field survey of the project study area was conducted on October 19, 2016. No eagles or nests were observed. Therefore, the bald eagle will not be impacted as a result of project construction.
