Subject: Request to Re -apply for 401 Water Quality Certificate
McMahan Hydroelectric, LLC - Bynum Hydro Project

Dear Ms. Higgins:
On March 3, 2017 the Division of Water Resources - 401 & Buffer Permitting Branch (Division)
acknowledged the receipt of an application for a 401 Water Quality Certification by McMahan
Hydroelectric LLC (McMahan) as part of the federal relicensing process for the Bynum Hydro
Project (FERC Project # 4093).
On April 26, 2017 McMahan received a Request for Additional Information from the 401 & Buffer
Permitting Branch. The request stated that the application would be only hold until McMahan
provided 1.) a water quality monitoring plan, and 2.) a copy of the Federal Energy Regulatory
Commission (FERC) Draft Environmental Assessment (DEA) for the project.
McMahan has submitted a water quality monitoring plan to the Division for review. However,
McMahan has yet to receive a DEA from the FERC, and is therefore still unable to provide this
requested document to the Division for review. Once the FERC produces the DEA for the Bynum
Hydro Project, McMahan will provide the Division with copies in compliance with the request
from April 26, 2017.
By submittal of this letter, McMahan is withdrawing its current application, and re -applying for
the 401 Certification. McMahan requests that all existing file materials for DEQ Project # 2015-
0124 be retained, and no additional application fee be imposed.
