On April 26, 2017 McMahan received a Request for Additional Information from the 401 & Buffer Permitting Branch. The request stated that the application would be only hold until McMahan provided 1.) a water quality monitoring plan, and 2.) a copy of the Federal Energy Regulatory Commission (FERC) Draft Environmental Assessment (DEA) for the project. McMahan has submitted a water quality monitoring plan to the Division for review. However, McMahan has yet to receive a DEA from the FERC, and is therefore still unable to provide this requested document to the Division for review. Once the FERC produces the DEA for the Bynum Hydro Project, McMahan will provide the Division with copies in compliance with the request from April 26, 2017. By submittal of this letter, McMahan is withdrawing its current application, and re -applying for the 401 Certification. McMahan requests that all existing file materials for DEQ Project # 2015- 0124 be retained, and no additional application fee be imposed. Please contact me if any additional information is needed on this matter. Respectfully, L 1, k_ Andrew McMahan President, McMahan Hydroelectric LLC
