Subject: Modification/Re-evaluation of Section 404 Nationwide Permit 3(SAW 2016 00246) and DWR 401 WQC
(DWR Project No. 20160194) for proposed pipe replacement on Mt. Misery Rd (SR 1426) in Brunswick
County. WBS # 3B.201011
Dear Mr. Shaver & Ms. Steenhuis:
The North Carolina Department of Transportation (NCDOT) acquired written approval from your agencies on March
1, 2016 to replace an existing pipe on Mt Misery Road (SR 1426) in Brunswick County. The pipe is located 1.8 miles
west of the intersection of SR 1430 (Cedar Hill Rd.) at the crossing of Indian Creek which is classified as C;Sw
waters.
Due to the large number of pipes that had to replaced following Hurricane Matthew, this pipe replacement had to be
delayed and the original permits have expired, therefore NCDOT is providing the enclosed information requesting
your agency to re-evaluated their original written approval of this project. In preparation of this request NCDOT has
also revisited this project internally and has determined that the following changes need to be disclosed:
The proposed structure in the original submittal was 2@ 81" x 51" x 40 ft. CMPA. After coordination with
pipe manufacturers the actual proposed structure is 2@ 87" x 63" x 40 ft. CMPA. A 2.2 ft. sill is still
proposed on the inlet of the overflow pipe.
Permanent stream impacts have been reduced from 441f to 31 lf and temporary stream impacts have been
reduced from 601f to 291f. The reduction in impacts is due to modification of the proposed rip rap
placement at the outlet end of the structure. Based on the water depth in the channel, NCDOT is revising the
original proposal to include a submerged 10:1 rip slope at the outlet rather than flling in the entire scour hole
with rip rap. This revision would still allow aquatic passage since the pipe is 1.75 ft. below the normal water
surface and would reduce impacts to the natural stream bank.
The attached revised permit drawings and wetland impact summary reflect the changes described above.
Under the current NW 3 permit and regional conditions, it is anticipated that formal notice under NW 3 is no longer
required to the US Army Corps of Engineers (USACE) for this project. Furthermore, given that the proposed
reduction in permanent stream impacts is below 401f, it is anticipated that written approval is no longer required from
DWR under WQC 4132. By submittal of this information and attachments, NCDOT is requesting approval from
your agency that NCDOT can proceed with this replacement under the new Nationwide 3 and WQC 4132 without
written approval.
