Dear Mr. McMillan,
Please reference the "Request for More Information" letter dated February 24, 2009
(Attachment A) sent by the North Carolina Division of Water Quality (DWQ) in response
to the February 17, 2009, "401 Water Quality Certification - Request Items" letter
submitted by Clearwater Environmental Consultants, Inc. (CEC), on behalf of Mr. Justus
Ammons of Ammons Mountain Properties, Inc. In the "Request for More Information"
letter, the DWQ requested the submittal of several additional items prior to impacts
occurring at the site.. Each requested item will be discussed below.
DWQ Comment #1: "The minimum release (low flow) pipe is at least 4 inches in
diameter (6 inches preferred), fitted with an end cap, and a 2-inch hole (orifice) drilled
into the cap. This will ensure ease of maintenance in case there is clogging."
As indicated on the attached plans, the low-flow release pipe has been increased
to 4 inches in diameter. This pipe will be fitted with a cap, which has a 2-inch
orifice.
DWQ Comment #2: "Please raise the low flow pipe at least 6 inches above the floor
(current elevation 2487.5 feet) to further minimize any potential for clogging of the
orifice. "
As indicated on the attached plans, the low-flow release pipe has been raised
approximately 12 inches from the bottom elevation of the pond.

DWQ Comment #3: "That the pipe material should be strong enough to carry the
surcharge from 10 feet earth material plus vehicular traffic on the pavement. In this
case, we suggest that you consider using ductile iron pipe (DIP) instead of PVC"
As determined by Mercer Design Group, the pipe material, in this case PVC, is
strong enough to carry the weight of 10 feet of earth and vehicle loads. Use of
PVC pipes is typical for this type of construction and weight baring loads.
DWQ Comment #4: "Please ensure that all pipes through the berm shall be provided
with seepage control (anti-seepage) measures."
As indicated on the attached plans, anti-seep collars have been placed on the 12-
inch drain and 4-inch low-flow release pipe passing through the dam.
The information submitted in this package addresses all requests made in the "Request for
More Information" letter. CEC believes the totality of this information allows DWQ to
conclude that the applicant has addressed recommendations in the letter. The applicant
respectfully requests that the DWQ approve the attached information so that construction
may begin at the site.

REQUEST FOR MORE INFORMATION
Dear Mr. Ammons:
On July 12, 2008, the Division of Water Quality (DWQ) issued a.401 Water Quality
Certification (WQC) to you for the above-referenced project. On February 18, 2009, the DWQ
received correspondence dated February 17, 2009, from you addressing Condition Nos. 10, 11,
12, and 17, of the above-referenced 401 WQC. Based on review of the February 17, 2009,
correspondence, the DWQ requests the additional information cited below to adequately address
these conditions.
Additional Information Requested:
After careful review of your additional information dated February 17, 2009, the DWQ has
determined that the measures proposed and described to ensure minimum water release are
acceptable. However, this office recommends the following:
1. The minimum release (low flow) pipe is at least 4 inches in diameter (6 inches
preferred), fitted with an end cap, and a 2-inch hole (orifice) drilled into the cap. This
will ensure ease of maintenance in case there is clogging.
2. Please raise the low flow pipe at least 6 inches above the floor (current elevation
2487.5 feet) to further minimize any potential for clogging of the orifice.
3. That the pipe material should be strong enough to carry the surcharge from the 10-
feet earth material plus vehicular traffic on the pavement. In this sense, we suggest

minimum water release pipe, primary outlet structure, emergency spillways and major pool
levels.
