Chris,
I agree that since this pipe was already there, it's allowable and doesn't affect your permitting
(1 don't know anything about these apartments, but when you deal with them, please let them know that should they ever expand their lot in any way, they would need
better stormwater treatment )
My only concern would be to make sure the riprap ditch is designed to keep velocities down if all possible Perhaps even widening and/or flattening it some at the
end, to attenuate flow before it hits your newly moved stream (And of course, revegetate any area disturbed by this work)
But overall I agree with your assessment and think this is the way to go Just include this in your as-builds and I'll include this in our file to show you have my OK

The Department finished construction of this project in 2007 One stability issue has come to our attention that requires prompt action by the Department The Presidential
Apartment complex is located directly adjacent to 1-85 between Duke Street and Broad Street Runoff at the apartment complex has always been collected in a drainage system that
discharged though a 24 inch concrete pipe towards Ellerbe Creek Unfortunately the 24 inch concrete pipe was never depicted on the roadway construction plans The contractor for
the 1-85 widening project placed fill in the area (per the plans and permit drawings) which covered up the outlet of the pipe and also placed fill on top of the pipe (i a the pipe system
was completely covered up and could not be observed) No one in the Division was aware of this pipe system
Runoff from the apartment complex through the drainage system obviously continued through the life of the project and after construction was completed However since the pipe
outlet was covered with fill it only resulted in a super saturated soil in the area This was not a problem until last week when the pipe system backed up and caused extensive flooding
in the first floor apartments at the complex The Durham County maintenance unit and Division construction unit investigated the area last week and determined that the drainage
system from the apartment complex had in fact been covered up by fill during construction of the 185 widening project
The Department now must come up with an plan to allow water from the apartment complex to come in to our nght-of-way and continue unimpeded towards Ellerbe Creek This is
an existing drainage system that has to be accommodated by the Department The only way to allow this to occur is to uncover the pipe outlet and install a np rap lined ditch toward
Ellerbe Creek The rip rap ditch will terminate behind a culvert wing wall The location of this proposed ditch is depicted below
