REQUEST FOR MORE INFORMATION
Dear Mr. Ammons:
On July 12, 2008, the Division of Water Quality (DWQ) issued a.401 Water Quality
Certification (WQC) to you for the above-referenced project. On February 18, 2009, the DWQ
received correspondence dated February 17, 2009, from you addressing Condition Nos. 10, 11,
12, and 17, of the above-referenced 401 WQC. Based on review of the February 17, 2009,
correspondence, the DWQ requests the additional information cited below to adequately address
these conditions.
Additional Information Requested:
After careful review of your additional information dated February 17, 2009, the DWQ has
determined that the measures proposed and described to ensure minimum water release are
acceptable. However, this office recommends the following:
1. The minimum release (low flow) pipe is at least 4 inches in diameter (6 inches
preferred), fitted with an end cap, and a 2-inch hole (orifice) drilled into the cap. This
will ensure ease of maintenance in case there is clogging.
2. Please raise the low flow pipe at least 6 inches above the floor (current elevation
2487.5 feet) to further minimize any potential for clogging of the orifice.
3. That the pipe material should be strong enough to carry the surcharge from the 10-
feet earth material plus vehicular traffic on the pavement. In this sense, we suggest
that you consider using a ductile iron pipe (DIP) instead of PVC.
4. Please ensure that all pipes through the berm shall be provided with seepage control
(anti-seepage) measures.

Please submit revised plans and cross sections of the impoundment on Sheet D11 showing the
minimum water release pipe, primary outlet structure, emergency spillways and major pool
levels.
Please submit this information within 30 calendar days of the date of this letter. This letter only
addresses requirements of Condition Nos. 10 11, 12, and 17, of your 401 WQC and does not
authorize any impacts to wetlands, waters or protected buffers. Please be aware that any impacts
authorized in your 401 WQC may nor occur until the requirements of Conditions Nos. 10, 11, 12,
and 17, of the above-referenced 401 WQC of your WQC have been met. Please call Ms. Cyndi
