NOTICE OF VIOLATION OF MINING PERMIT

Dear Mr. Cecile:
This is to inform you of a violation of Mining,Permit No. 95-03 issued to
Radford Quarries of Boone to operate the Bamboo Road Quarry in Watauga
County.
On Ju'ne 21, 2004, the Land Quality Section's Winston-Salem.Regional
Office (WSRO) was notified'of a fly rock incident that occurred at the ' above
referenced mine on June 21, 2004, which resulted in rock being thrown outside your
permitted area. Therefore, this incident constitutes a violation of Operating
Condition No 8G of Mining Permit No- 95-03 which governs the control of fly rock at
this mine.
The following actions must be taken to correct this violation:
A. Immediately. cease further use of explosives at the Bamboo Road
Quarry.

B. Submit in duplicate to the Department, within 10 days following your
receipt of this Notice, a complete blast investigation report prepared by a
third party consultant. Said report shall contain, but not be limited to, the
following:
a) blast repo rts/record s,
b) a scaled map showing the exact location of the June 21, 2004 blast
and the distances to and locations of the fly rock and offsite
damage (if any),
c) actions to be taken by your corporation to repair any damages,
d) probable cause(s) of the fly rock,
e) description of the blasting procedures employed at the time of the
incident, and
f) what changes will be made in procedures to ensure that fly rock will
not exit the permitted and guarded area in the future.
You will be notified if the above investigative report meets with the approval
of the Department. Should the report not meet with Department approval, you will

be notified of the deficiencies.
Failure to take the corrective actions specified above may result in the
assessment of a civil penalty against your corporation. If a civil penalty is assessed,
the amount may be up to five hundred dollars ($500.00) for each day of violation,
beginning with the date of your receipt of this Notice of Violation (N.C.G.S. 74-64).
Other enforcement actions may include seeking an injunction or revoking your
mining permit.
The responsibility for understanding and complying with the conditions of
your mining permit rests with you.

I Our office has completed its review of Radford quarries of Boone's blasting information,
including blast reports and seismograph recordings, related to the April 18 through August 4, 2008
blasts conducted at its Bamboo Road Quarry. It was found that Radford Quarries of Boone was not in
violation with the blasting requirements of its mining permit during the period in question.
All peak particle velocities, a measurement of ground vibration with units in inches per second
ops), -were -well below the maximum allowable limits specified in Radford Quarries of Boone's mining
permit. More specifically, all recorded values were at or below.07 ips at a distance cl—os—e-r-than t
closest offsite occupied structure (the location where compliance with the permit limits is determined).
According to extensive research by the U.S. Bureau of Mines and others, particle velocities below 0.5
ips effectively eliminate the possibility of any structural damage.
No airblast readings were recorded by the seismograph which may be an indication that the
seismograph was not working properly.. All calculated airblast readings, a measurement of the
atmospheric pressure wave (overpressure) with units in psi or dBL, were well below the U. S. Bureau
of Mines' recognized level of 164 dBL for prevention of glass breakage. A key point worth noting is
that glass breakage occurs at much lower levels of overpressure than structural damage, such as
cracking plaster.
We will monitor all blasting records and seismograph readings at this sit until further notice to
ensure the seismograph is functioning properly.

tl�rough August 4, 2008 blasts at the Bamboo Road Quarry. Your company has not been found to be
in violation with the blasting conditions outlined in Mining Permit No. 95-03. 1 have already notified the
complainant, Mr. Tom Turner, of our findings.
It appears that the seismograph may not have been working properly because of the low
readings for ground vibrations and no readings for the airblast for the above referenced blasts.
Therefore, please submit copies - of all blas - ting_ records and seismog-raph readings of all -future
blasts until further notice to ensure the seismograph is functioning properly.

I am enclosing a copy of the shot report for the blast on May 22, 2009 at the Bamboo
Quarry in Boone, NC. This report includes a seismograph reading from Radford's machine and
from Austin Powder's machine.
The seismograph reading from Radford's seismograph shows that the results fall within
the OSMRE range of allowed values. Also, the sound reading is 0.000431 psi, which can be
converted to decibels using the formula Pdb = 170.8 + 20 log (Pp,d. Using this formula, the
reading is 123.5 db. These numbers are consistent with those from Austin Powder's machine;
the slight difference resulted because the machines were not at the same distance from the shot
according to Steve Anders of Austin Powder.

The review has been completed on the shot records you previously submitted for the April 18
tl�rough August 4, 2008 blasts at the Bamboo Road Quarry. Your company has not been found to be
in violation with the blasting conditions outlined in Mining Permit No. 95-03. 1 have already notified the
complainant, Mr. Tom Turner, of our findings.
It appears that the seismograph may not have been working properly because of the low
readings for ground vibrations and no readings for the airblast for the above referenced blasts.
----T-herefore,-please-submit-cop es of all blasting records and seismograph readings of all future
blasts until further notice to ensure the seismograph is functioning properly.

Our office has completed its review of Radford quarries of Boone's blasting information,
including blast reports and seismograph recordings, related to the April 18 through August 4, 2008
blasts conducted at its Bamboo Road Quarry. It was found that Radford Quarries of Boone was not in
violation with the blasting requirements of its mining permit during the period in question.
All peak particle velocities, a measurement of ground vibration with units in inches per second
--(jps),-were-welI below the maximum allowable limits specified in Radford Quarries of Boone's mining
permit. More specifica y, all recorded values were at or below.07 ips at a distance c
closest offsite occupied structure (the location where compliance with the permit limits is determined).
According to extensive research by the U.S. Bureau of Mines and others, particle velocities below 0.5
ips effectively eliminate the possibility of any structural damage.
No airblast readings were recorded by the seismograph which may be an indication that the
seismograph was not working properly.. All calculated airblast readings, a measurement of the
atmospheric pressure wave (overpressure) with units in psi or dBL, were well below the U. S. Bureau
of Mines' recognized level of 164 dBL for prevention of glass breakage. A key point worth noting is
that glass breakage occurs at much lower levels of overpressure than structural damage, such as
cracking plaster.
We will monitor all blasting records and seismograph readings at this sit until further notice to
ensure the seismograph is functioning properly.

Also my seismograph has been sent off for repair. I read in the permit that
I can do a calculation in the event that I do not have it. This is correct
right? Do you think I can handle the calculation?

I have compiled the information requested in your letter of July 21, 2008. Attached to
this letter, you will find duplicate copies of production shot records for the following dates:
April 18, June 27, July 21, and August 4 of the current year. I did not find any abnon-nalities in
reviewing these records. Further, I spoke to Mr. Virgil Freeman, owner of the nearest structure
to our site, and Mr. Freeman indicates that he did not feel any vibration on either of the above -
listed dates. He may be contacted at (828) 265-9031 if necessary.

off. My mom talked to him. Big D was in the pit. I was at my office.
OK as Big D says "take your time but,hurry." I'm hoping that if you request

above referenced quarry. According to the complainant, Mr. the vibrations
produced from the blast at the * Quarry on July 21, 2008 caused his entire house to shake.
As provided in the mining permit for this site, you are requested to provide this office
duplicate copies of all shot records related to the blasts conducted on July 21, 2008, including
any seismograph recordings made. Furthermore, please forward all shot information for two
production shoot conducted immediately before and one production shot after the blast in
question for thi S- office's review.
It is recommended that you discuss this matter with him. His address and telephone
