To Whom It May Concern:
The purpose of this letter is to provide verification that the Request for More Information letter was received on
December 5, 2006 (see attached letter dated December 4, 2006) and that the applicant is interested in continuing to
pursue a 401 Water Quality Certification for this project. However, it is important to note that the applicant
received this letter on day 53 of the NCDWQ 60 day review process. Because of this extensive delay in notifying
the applicant that his stormwater BMP is 15% too small and that the Operations & Maintenance Agreement is
inadequate, he is now having to wait an additiona128 days to speak with the reviewer to determine her method in
calculating these deficiencies.
If it is possible for another member of the NCDWQ staff review the submitted stormwater calculations for the
subject project to help clarify how this deficiency was determined, that would be extremely helpful. If you have any
questions or if a meeting can be scheduled, please call me at (919)846-5900.

REQUEST FOR MORE INFORMATION
Dear Mr. Falcone:
On October 13, 2006, the Division of Water Quality (DWQ) received your application dated October 13,
2006, to fill or otherwise impact 115 linear feet of perennial stream, and 3,580 square feet of Zone 1
protected Neuse River basin riparian buffer and 589 square feet of Zone 2 protected Neuse River basin
riparian buffer to construct the proposed townhome development at the subject property. The DWQ has
determined that your application was incomplete and/or provided inaccurate information as discussed
below. The DWQ will require additional information in order to process your application to impact
protected wetlands and/or streams on the subject property. Therefore, unless we receive five copies of the
additional information requested below, we will have to move toward denial of your application as
required by 15A NCAC 2H .0506 and will place this project on hold as incomplete until we receive this
additional information. Please provide the following information so that we may continue to review your
project.
Additional Information Requested:
1. Your constructed wetland stor7rtwater BMP design is 15 percent too small as proposed. Please re-
design your constructed wetland so that it is appropriately sized and submit your new plans and
worksheet. Additionally, your Operations and Maintenance agreement is inadequate. Please
contact Cynthia Van Der Wiele at 919-715-3473 to discuss the Operations and Maintenance
agreement for this project.
Please contact the DWQ within three weeks of the date of this letter to verify that you have received this
letter and that you remain interested in continuing to pursue permitting of your project and will be
providing the DWQ the requested information at a later date. Please contact me in writing and Mike
Horan of the DWQ Raleigh Regional Office. If we do not hear from you within three weeks, we will
assume that you no longer want to pursue this project and we will consider the project as withdrawn.
This letter only addresses the application review and does not authorize any impacts to wetlands, waters
or protected buffers. Please be aware that any impacts requested within your application are not
