Madison County, North Carolina DWQ Project # 08-0675 Dear Mr. McMillan, Please reference the "Approval of 401 Water Quality Certification" (Certification) dated December 22, 2008 (Attachment A) sent by the North Carolina Division of Water Quality (DWQ) in response to the permit application submitted by ClearWater Environmental Consultants, Inc. (CEC), on behalf of Mr. Justus Ammons of Ammons Mountain Properties, Inc. The Certification authorizes impacts associated with development of a residential community with an amenity pond to be known as Traditions. In the Certification, the DWQ requested the submittal of several additional items prior to impacts occurring at the site. Each requested item will be discussed below. Condition #10: "The minimum water release plan for the proposed dam must be approved in writing by this Office before the approved impacts may occur. The plan must include written explanation of the specific discharge rate and mechanism to provide ,for each required release. The plan must also include any design specifications, details and calculations to show that the release shall be achieved in the given conditions. The plan shall also include monitoring that ensures compliance. The plan and any associated ,facilities, once approved, must be in place and implemented upon the completion of the dam." The proposed dam design includes a 2" PVC low-flow release pipe. This pipe is located as the base of the dam, along side the 12" drain. This pipe provides for continuous flow through the dam regardless of the ponds water level. The low- flow release pipe can be seen on the dam design drawings that have been included for review (Figure 1). Water flow from the 2" PVC low-flow release pipe will be approximately 0.19 cubic feet per second. Condition #11: "The impoundment discharge should be monitored to ensure thermal impacts to waters will not exceed the temperature standard for mountain streams. Unless otherwise stipulated by the Division of Water Quality, discharge water temperatures should be routinely monitored and compared to inflow water temperatures to ensure compliance." Upon completion of construction of the pond, CEC will install two Onset Tidbit temperature data loggers (logger) below the outfall of the dam to record stream temperatures. One logger will be placed immediately downstream of the pond outfall the other will be placed 300 to 500 feet downstream of the outfall. Upon completion of construction, the dam will impound the origins and headwaters of the associated tributaries. Because of this, it is not possible to install loggers upstream to monitor in-stream flow. The loggers will be monitored and downloaded every two months to ensure they are in proper working order. Temperature data will be submitted annually with the associated water quality sampling report (discussed below). Condition #12: "The discharge should be aerated to enhance dissolved oxygen levels." The proposed dam design will provide for the aeration of water. Water will flow into the cold water release inlet then travel through a 24" pipe and into a 2' by 8' inlet box structure. Water will then flow across the top of the dam (and under a small bridge) and cascade down the back of the dam. The back of the dam will be reinforced with gabions which will be faced with rock revetments. Water cascading down the rock revetment wall will become aerated before it reaches the stream. Dam construction details are illustrated in the attached dam design drawings (Figure 1). Condition #16: "An impoundment sampling schedule and methodology must be finalized before the proposed impacts may occur. The office recommends utilizing the attached guidance document `Predictability Study Protocol for Sampling Reference Impoundments' (NCDWQ, March 12, 2008)." A "Water Quality Monitoring and Sampling Protocol" for the pond located within the Traditions subdivision is attached for review (Attachment C). This study will continue for a period of five years. Reports will be submitted annually to the DWQ. Condition #17: "Final design details for the dam and impoundment shall be submitted to DWQ for approval in writing before the proposed impacts may occur. The final plan shall include a discussion of how water quality standards will be monitored and Mr. Ian McMillan 02/12/09 Page 3 of 3 maintained within the impoundment. The final plan shall also include the structural design drawings and details for the dam, including the plan and profile views illustrating the height, toe, materials, spillway, as well as the operation and maintenance plan." The dam includes a cold water release, a low-flow release pipe, and outfall designed to aerate water released from the dam. The final dam design has been attached for review (Figure 1). Water quality standards will be monitored for a period of five years as outlined in the "Water Quality Monitoring and Sampling Protocol" (Attachment C). The applicant is responsible for the operation and maintenance of the dam and will follow the "Dam Operation, Maintenance, and Inspection Manual 1985 (revised 2007)" developed by the NC Division of Land Resources, Land Quality Section. The information submitted in this package addresses all requests made in the Certification. CEC believes the totality of this information allows DWQ to conclude that the applicant has addressed recommendations in the letter. Page 2 of 2 December 22, 2008 NORTH CAROLINA 401 WATER QUALITY CERTIFICATION THIS CERTIFICATION is issued in conformity with the requirements of Section 401 Public Laws 92- 500 and 95-217 of the United States and subject to the North Carolina Division of Water Quality (DWQ) Regulations in 15 NCAC 2H, Section .0500 to Mr. Judd Ammons of the Ammons Mountain Properties, Inc., NC to fill or, otherwise impact 415 linear feet of perennial stream (fill 60 linear feet of perennial stream and flood 355 linear feet of perennial stream in the French Broad River Basin, to construct a residential community and with anaesthetic lake at the site. The site is located off Crooked Creek Road (SR 1526), northeast of Mars Hill, in Madison County, North Carolina, pursuant to an unsigned and undated application (received by the DWQ on July 31, 2008), and Public Notice issued August 22, 2008 (received by the DWQ on August 22, 2008), and by additional information received.from you on October 14, 2008, and November 12, 2008. The application and supporting documentation provides adequate assurance that the proposed work will not result in a violation of applicable Water Quality Standards and discharge guidelines. Therefore, the State of North Carolina certifies that this activity will not violate the applicable portions of Sections 301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in accordance with the application, the supporting documentation, and conditions hereinafter set forth. This approval is only valid for the purpose and design submitted in the application materials and as described in the Public Notice. If the project is changed, prior to notification a new application for a new Certification is required. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions of this Certification. Any new owner must notify the Division and request the Certification be issued in their name. Should wetland or stream fill be requested in the future, additional compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). If any plan revisions from the approved site plan result in a change in stream or wetland impact or an increase in impervious surfaces, the DWQ shall be notified in writing and a new application for 401 Certification may be required. For this approval to be valid, compliance with the conditions listed below is required. Conditions of Certification: 1. Impacts Approved The following impacts are hereby approved as long as all of the other specific and general conditions of this Certification (or Isolated Wetland Permit) are met. The devices shall be maintained on all construction sites, borrow sites, and waste pile (spoil) projects, including contractor-owned or leased borrow pits associated with the project. c. Sufficient materials required for stabilization and/or repair of erosion control measures and stormwater routing and treatment shall be on site at all times. 3. No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas beyond the footprint of the impacts depicted in the 404/40 1 Permit Application. All construction activities, including the design, installation, operation, and maintenance of sediment and erosion control Best Management Practices, shall be performed so that no violations of state water quality standards, statutes, or rules occur; 4. Sediment and erosion control measures shall not be placed in wetlands or waters without prior approval from the Division. If placement of sediment and erosion control devices in wetlands and waters is unavoidable, design and placement of temporary erosion control measures shall not be conducted in a manner that may result in dis-equilibrium of wetlands or stream beds or banks, adjacent to or upstream and down stream of the above structures. All sediment and erosion control devices shall be removed and the natural grade restored within two (2) months of the date that the Division of Land Resources or locally delegated program has released the project; 5. Protective Fencing - The outside buffer, wetland or water boundary and along the construction corridor within these boundaries approved under this authorization shall be clearly marked with orange warning fencing.(or similar high visibility material) for the areas that have been approved to infringe within the buffer, wetland or water prior to any land disturbing activities to ensure compliance with GC 3705; Continuing Compliance: 6. Mr. Judd Ammons of the Ammons Mountain Properties, Inc., shall conduct construction activities in a manner consistent with State water quality standards (including any requirements resulting from compliance with section 303(d) of the Clean Water Act) and any other appropriate requirements of State law and federal law. If the Division determines that such standards or laws are not being met (including the failure to sustain a designated or achieved use) or that State or federal law is being violated, or that further conditions are necessary to assure compliance, the Division may reevaluate and modify this Certification to include conditions appropriate to assure compliance with such standards and requirements in accordance with 15A NCAC 2H.0507(d). Before modifying the Certification, the Division shall notify Mr. Judd Ammons of the Ammons Mountain Properties, Inc., and the US Army Corps of Engineers, provide public notice in accordance with 15A NCAC 2H.0503 and provide opportunity for public hearing in accordance with 15A NCAC 2H.0504. Any, new or revised conditions shall be provided to Mr. Judd Ammons of the Ammons Mountain Properties, Inc., in writing, shall be provided to the United States Army Corps of Engineers for reference in any Permit issued pursuant to Section 404 of the Clean Water Act, and shall also become conditions of the 404 Permit for the project; Mr. Judd Ammons and Ammons Mountain Properties, Inc. Deed notifications or similar mechanisms shall be placed on all lots with remaining jurisdictional wetlands and waters or areas within 50 feet of all streams and ponds. These mechanisms shall be put in place within 30 days of the date of issuance of the 401 Certification letter or the issuance of the 404 Permit (whichever is later). A sample deed notification format can be downloaded from the 401/Wetlands Unit web site at http://h2o.enr.state.nc.us/ncwetlands DWQ shall be sent copies of all deed restrictions applied to these lots; Construction Stormwater Permit NCGO10000 Upon the approval of an Erosion and Sedimentation Control Plan issued by the Division of Land Resources (DLR) or a DLR delegated local erosion and sedimentation control program, an NPDES General stormwater permit (NCGO10000) administered by DWQ is automatically issued to the project. This General Permit allows stormwater to be discharged during land disturbing construction activities as stipulated by conditions in the permit. If your project is covered by this permit [applicable to construction projects that disturb one (1) or more acres], full compliance with permit conditions including the sedimentation control plan, self-monitoring, record keeping and reporting requirements are required. Native wetland species and shrubs should be planted along the aquatic shelf in areas where practicable to help promote diversity among species that may naturally propagate. 10. The discharge should be aerated to enhance dissolved oxygen levels. 13. Forested areas, buffers and littoral shelves should be preserved as undisturbed (to the extent practicable) and protected as restricted use conservation areas. Maximum available forested buffers should be provided and protected. It is our understanding that a minimum 30-foot vegetated buffer is required pursuant to water supply regulations and that these buffers will be enhanced with an additional 20-foot vegetated exterior buffer. 14. Littoral shelves and native vegetation should be provided along the shoreline for stability, safety, shading and habitat. 15. The use of motorized equipment as well as fertilizers and other chemicals in the lake and around the shoreline and buffer zones should be strictly controlled so as not to cause direct or ancillary pollutant issues downstream. (the permittee). The permittee currently owns approximately 400 acres near Mars Hill in Madison County, North Carolina and is proposing the development of a low-density residential subdivision, known as Traditions, with approximately 200 lots, ranging from 1.08 to 4.21 acres. A site vicinity map is included for review (Figure 1). The permittee has also made application to the US Army Corps of Engineers (Corps) for impacts associated with subdivision infrastructure and development. As a part of the development, the permittee will be constructing a small on-line pond (approximately 0.75 acres) on the northern portion of the property. A pond location map is included for review (Figure 2). The proposed study outlined below will be done in accordance with Condition 10 of the Certification and the North Carolina Division of Water Quality, Wetlands and Stormwater Branch's "Predictability Study Protocol for Sampling Reference Impoundments - DRAFT" (Protocol) dated February 28, 2008. METHODOLOGY The permittee and Clearwater Environmental Consultants, Inc. (CEC) developed this plan for monitoring the water quality of the permitted pond upon completion of construction. Sampling as outlined in the Protocol is planned to begin the week of August 3, 2009 at the Traditions pond. If the pond has not been constructed by the week of August 3, 2009, sampling as outlined in the Protocol will begin as soon as pond construction is complete. At the impoundment, five sampling stations will be identified. During the first sample, latitude and longitude of each station will be taken for use with topographic maps or GIS data. A summary of the general locations of the sampling stations is as follows: • Stations 1, 2, and 3 will be evenly spaced across the centerline of the impoundment (lentic); • Station 4 will be located downstream and within 50 linear feet of the impoundment outfall in the flowing (lotic) stream reach; and • Station 5 will be located downstream and between 200 and 500 linear feet of the impoundment outfall in the flowing (lotic) stream reach. As a note, no upstream sample station will be identified. Upon completion of construction, the dam will impoundment the headwaters and origin of the associated stream channels; therefore, there will be no stream segments above the impoundment. SAMPLING Five water quality sampling stations will be established at the Traditions ponds as described above. Water samples will be taken every other week during the growing season from the week of August 3, 2009 through the week of September 21, yielding 4 sample sets. Samples are divided into lotic samples which include the samples and measurements taken at Stations 4 and 5; and lentic samples which include samples and measurements taken at Stations 1, 2, and 3. Field measurements and grab sample results will be recorded on data sheets taken from the DWQ's "Intensive Survey Unit Standard Operating Procedures". The type of sample or measurement taken (field or grab) and parameters measured are outlined below. Lotic Samples (Stations 4 and 5) o Field Measurements (taken 0.1m below the surface) ¦ temperature ¦ dissolved oxygen (% and mg/1) ¦ pH ¦ specific conductance o Grab Samples (taken 0.1m below the surface at/near the thalweg) ¦ nutrients (total phosphorous, total Kjeldahl nitrogen, ammonia [NH3], nitrate + nitrite [NO2+NO31, chlorophyll-a) ¦ turbidity • Lentic Samples (Stations 1, 2, and 3) o Field Measurements (taken 0.1m below the surface and at lm intervals to the lake bottom) • temperature ¦ dissolved oxygen (% and mg/1) ¦ pH ¦ specific conductance o Field Measurement (1 measurement reported at each sample location) ¦ Secchi depth transparency - reported value as the average of two measurements o Grab Samples Using a LabLine (taken as spatial composites of the photic zone, defined as twice the Secchi depth) ¦ nutrients (total phosphorous, total Kjeldahl nitrogen, ammonia [NH3], nitrate + nitrite [N02+NO31, chlorophyll-a) ¦ turbidity EQUIPMENT The in situ field measurements (temperature, dissolved oxygen (% and mg/1), pH, and specific conductance) will be taken using a Hydrolab Quanta. A Secchi disk will be used to measure the water transparency at the three lentic stations across the centerline of the impoundment. All data conforms to the "Standard Method for the Examination of Water and Wastewater" and EPA methods. In addition, Onset Tidbit temperature data loggers will be installed at both downstream stations at the site to monitor water temperatures every two hours. These data loggers will provide precise temperature ranges and can be easily downloaded in the field. Installation of the data loggers will also satisfy Condition 11 of the Certification. REPORTING This study will be conducted for 5 years during August and September of the respective year.
