Thanks, Rachel 1 DEPARTMENT OF THE ARMY WILMINGTON DISTRICT, CORPS OF ENGINEERS 69 DARLINGTON AVE • WILMINGTON, NORTH CAROLINA 28403 -- January 23, 2018 REPLY TO ATTENTION OF: Regulatory Division Action ID: SAW -2008-02698 Bailey & Fuller Properties, LLC C/o Mr. Chris Bailey 405D Western Boulevard Jacksonville, North Carolina 28412 Dear Mr. Bailey: Please reference your November 17, 2017, request submitted by your agent, Southern Environmental Group, Inc., to modify the Department of the Army (DA) permit issued on February 16, 2017 to fill approximately 1.01 acres of jurisdictional wetlands and 120 linear feet of jurisdictional ditches associated with a commercial development. This site is located at 810 West Corbett Avenue (Highway 24) in Swansboro, Onslow County, North Carolina. This DA authorization expires on December 31, 2021. Your request is to modify the plans for the commercial development and impact 0.69 acre of wetlands and 265 linear feet of jurisdictional ditches. Upon the review of your permit modification request, our office has determined that the modification is hereby authorized pursuant to Section 404 of the Clean Water Act provided adherence to all new, modified, and original conditions. 1) New Special Condition: a. Special Condition #18: AVOIDANCE OF REMAINING ON-SITE WETLAND: The Permittee shall avoid the remaining onsite wetlands (as detailed on the attached drawings). These natural wetland areas were avoided as part of the permit application review process and therefore will not be disturbed by any dredging, filling, mechanized land clearing, or other construction work whatsoever. 2) Modified Special Condition (numbers coincide with the original permit conditions a. Special Condition #17: MITIGATION: In order to compensate for impacts associated with this permit, mitigation shall be provided in accordance with the provisions outlined on the most recent version of the attached Compensatory Mitigation Responsibility Transfer Form. The requirements of this form, including any special conditions listed on this form, are hereby incorporated as special conditions of this permit authorization. The permittee, prior to initiating any land -disturbing activities, shall provide 1.40 credits of mitigation via payment into the Hoffman Forest Wetland Mitigation Bank for the project related impacts of 0.69 acres of non -riparian wetlands. Prior to initiating any land -disturbing activities, a copy of the updated acceptance letter and proof of payment provided by the Hoffman Forest Wetland Mitigation Bank shall be sent to the Corps of Engineers. All other permit conditions pursuant to the February 16, 2017 authorization (copy enclosed) remain applicable.
