The study area is located along River Road between Cathay Road and Riverbreeze Road in Wilmington, North Carolina. The study area lies within a Coastal Area Management Act (CAMA) county; it is, therefore, subject to rules and policies of the Coastal Resources Commission (CRC). The study area is approximately 7.6 acres and approximately 3,500 feet long, and lies within an existing NCDOT right of way along River Road. Adjacent land use to the west of River Road is primarily tidal wetlands with a few scattered residential structures. Land use immediately east of River Road consists of non -tidal wetlands and residential developments. There is a golf course immediately northeast of the study area. creating experiences through experience 2905 Meridian Parkway, Durham, NC 27713 / 919. 361. 5000 'J MCADAMS NATIONWIDE PERMIT 12/GC 4133 > AQU-17000 JURISDICTIONAL FEATURES: The study area is in the Mott Creek — Cape Fear River watershed (HUC 030300050702) within the Cape Fear River basin. The study area drains west to an adjacent tidal wetland, which then drains directly to the Cape Fear River, which is designated Class SC. Class SC designates "all tidal salt waters protected for secondary recreation such as fishing, boating, and other activities involving minimal skin contact; fish and noncommercial shellfish consumption; aquatic life propagation and survival; and wildlife." The study area is depicted on both a current U.S. Geological Survey (USGS) map (Figure 1) and the New Hanover County NRCS Soil Survey (Figure 2). There are no potential stream features mapped within the study area on the USGS or Soil Survey maps; the USGS map depicts wetlands and tidal flats within and adjacent to the study area. McAdams staff conducted field investigations on May 11, 2017 with the objective of flagging streams and wetlands (Waters of U.S.) as defined by the 1987 U.S. Army Corps of Engineers (USACE) Wetland Delineation Manual. Based on our field investigations, four jurisdictional wetlands were flagged within the study area (Wetlands A, B, C, and D). Wetland A is classified as palustrine needle -leaved evergreen forested and broad-leaved deciduous scrub -shrub seasonally flooded (PF04/SS1C), Wetlands B and C are classified as palustrine persistent emergent seasonally flooded (PEM1R), and Wetland D is classified as palustrine broad-leaved deciduous or needle -leaved evergreen forested temporarily flooded (PF01/4A), as defined by Cowardin, et al. (1979). Wetland systems designated as PEM1R are typically hydrologically influenced by tidal fluxes. A total of approximately 1.25 acres of wetlands were flagged within the study area. In addition to the delineated wetlands, there is a 75 -foot Coastal Area Management Act (CAMA) Area of Environmental Concern (AEC) buffer established from the mean high water (MHW) elevation. Wetland systems flagged on the east side (landward side) of River Road and designated as PEM1R are typically tidally influenced. The 75 -foot AEC buffer was established from tidally -influenced wetland systems located on the west side (river side) of River Road. The approximate extents of the 75 -foot AEC buffers are shown in Figure 3. A Preliminary Jurisdictional Determination confirming McAdams' findings was issued by the US Army Corps of Engineers (USACE) on July 25, 2017 (USACE Action ID: SAW -2017-01516). The study area lies within a CAMA county; it is, therefore, subject to rules and policies of the Coastal Resources Commission (CRC). PROPOSED IMPACTS: Aqua North Carolina, Incorporated is proposing to install an eight -inch PVC/HDPE water main along the east side of River Road for the purposes of improved flow distribution by creating a loop within the water distribution system. The site was designed to minimize impacts to aquatic resources while achieving the project objectives. The proposed project will result in 0.108 acres of temporary non -tidal wetland impact. Additionally, there will be impacts to a CAMA AEC; a CAMA permit will be obtained from the NC Division of Coastal Management (DCM) for impacts within the AEC (Figure 3). No stream or riparian buffer impacts will result from this project. Fill (water line installation) 0.089 TOTAL 0.108 acres AVOIDANCE and MINIMIZATION: Impacts to jurisdictional Waters of the U.S. have been minimized to the maximum extent practicable. The River Road water main extension is needed to improve flow distribution by creating a loop in the water distribution system. Proposed impacts to wetlands have been minimized by keeping the proposed water line as close to the existing edge of pavement as is practically feasible. The proposed water main will be located approximately five feet from the edge of pavement of existing roads and within existing North Carolina Department of Transportation (NCDOT) easements. There is 0.108 acre of proposed temporary non -tidal wetland impacts associated with the proposed water line extension. Temporary fills will be removed in their entirety and the affected areas will be returned to pre -construction elevations and re -vegetated with appropriate vegetation. No impacts to jurisdictional streams or riparian buffers are proposed. MITIGATION: Because there are no proposed permanent impacts to non -tidal Waters of the U.S., mitigation in the form of avoidance and minimization is proposed. DIFFUSE FLOW: The proposed project is not located within or adjacent to protected riparian buffers identified within any of the NC Riparian Buffer Protection Rules. Therefore, a diffuse flow plan is not required for this project. STORMWATER MANAGEMENT: The project will not result in an increase of impervious surface, thus a stormwater management plan is not required. Consideration of this project is greatly appreciated. Project Information and Prior Project History 3a. Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application: The proposed project is located along River Road between Cathay Road and Riverbreeze Road in Wilmington, North Carolina. The study area is approximately 7.6 acres and approximately 3,500 feet long, and lies within an existing NCDOT right of way along River Road. Adjacent land use to the west of River Road is primarily tidal wetlands with a few scattered residential structures. Land use immediately east of River Road consists of non -tidal wetlands and residential developments. There is a golf course immediately northeast of the study area. The study area is in the Mott Creek — Cape Fear River watershed (HUC 030300050702) within the Cape Fear River basin. The study area drains west to an adjacent tidal wetland, which then drains directly to the Cape Fear River, which is designated Class SC. Class SC designates "all tidal salt waters protected for secondary recreation such as fishing, boating, and other activities involving minimal skin contact; fish and noncommercial shellfish consumption; aquatic life propagation and survival; and wildlife." The study area is depicted on both a current U.S. Geological Survey (USGS) map (Figure 1) and the New Hanover County NRCS Soil Survey (Figure 2). There are no potential stream features mapped within the study area on the USGS or Soil Survey maps; the USGS map depicts wetlands and tidal flats within and adjacent to the study area. McAdams staff conducted field investigations on May 11, 2017 with the objective of flagging streams and wetlands (Waters of U.S.) as defined by the 1987 U.S. Army Corps of Engineers (USACE) Wetland Delineation Manual. Based on our field investigations, four jurisdictional wetlands were flagged within the study area (Wetlands A, B, C, and D). Wetland A is classified as palustrine needle -leaved evergreen forested and broad-leaved deciduous scrub -shrub seasonally flooded (PF04/SS1C), Wetlands B and C are classified as palustrine persistent emergent seasonally flooded (PEM1R), and Wetland D is classified as palustrine broad-leaved deciduous or needle -leaved evergreen forested temporarily flooded (PF01/4A), as defined by Cowardin, et al. (1979). Wetland systems designated as PEM1R are typically hydrologically influenced by tidal fluxes. A total of approximately 1.25 acres of wetlands were flagged within the study area. In addition to the delineated wetlands, there is a 75 -foot Coastal Area Management Act (CAMA) Area of Environmental Concern (AEC) buffer established from the mean high water (MHW) elevation. Wetland systems flagged on the east side (landward side) of River Road and designated as PEM1R are typically tidally influenced. The 75 -foot AEC buffer was established from tidally -influenced wetland systems located on the west side (river side) of River Road. The approximate extents of the 75 -foot AEC buffers are shown in Figure 3. Describe the overall project in detail, including the type of equipment to be used: Aqua North Carolina, Incorporated is proposing to install an eight -inch PVC/HDPE water main along the east side of River Road for the purposes of improved flow distribution by creating a loop within the water distribution system. The site was designed to minimize impacts to aquatic resources while achieving the project objectives. The proposed project will result in 0.108 acres of temporary non -tidal wetland impact. Additionally, there will be impacts to a CAMA AEC; a CAMA permit will be obtained from the NC Division of Coastal Management (DCM) for impacts within the AEC (Figure 3). No stream or riparian buffer impacts will result from this project. Typical construction equipment, such as a long-arm track -hoe, front end loader, and bush hog will be used. Section D. Impact Justification and Mitigation 1a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project. Impacts to jurisdictional Waters of the U.S. have been minimized to the maximum extent practicable. The River Road water main extension is needed to improve flow distribution by creating a loop in the water distribution system. Proposed impacts to wetlands have been minimized by keeping the proposed water line as close to the existing edge of pavement as is practically feasible. The proposed water main will be located approximately five feet from the edge of pavement of existing roads and within existing North Carolina Department of Transportation (NCDOT) easements. There is 0.108 acre of proposed temporary non -tidal wetland impacts associated with the proposed water line extension. Temporary fills will be removed in their entirety and the affected areas will be returned to pre - construction elevations and re -vegetated with appropriate vegetation. No impacts to jurisdictional streams or riparian buffers are proposed. Because there are no proposed permanent impacts to non -tidal Waters of the U.S., mitigation in the form of avoidance and minimization is proposed. 1b. Proper sedimentation and erosion control methods will be utilized during all phases of construction and installation, as described in the Erosion Control Plan sheets to be reviewed and approved by the NC Division of Land Resources and/or New Hanover County. All work will take place during dry conditions and can be facilitated from high, non - jurisdictional, stable ground adjacent to the shoreline. The contractor shall install silt fence, inlet protection, sediment traps, diversion ditches, tree protection, and other measures as shown on the erosion control plans, clearing only as necessary to install these devices. All erosion and sediment control measures will be checked for stability and operation following every runoff producing rainfall, but in no case less than once every week. Any needed repairs will be made immediately to maintain all measures designed. An erosion control inspections report is required and will be kept by the owner's representative. All slopes shall be graded no steeper than the angle that can be retained by vegetative cover or other adequate erosion control devices or structures. No material for construction will be placed in wetlands or streams at any time.
