Dear Mr. Grambling:
On December 30, 2008, the Division of Water Quality (DWQ) received your application dated December
29, 2008 to impact 0.10 acres of wetlands, 54 linear feet of intermittent streams and 17 linear feet of
perennial stream, 7,272 square feet (ft) of Zone 1 protected riparian buffers and 17,747 square feet (ft)
of Zone 2 protected riparian buffers to construct the proposed mixed use development at the site. The
DWQ has determined that your application was incomplete and/or provided inaccurate information as
discussed below. The DWQ will require additional information in order to process your application to
impact protected wetlands and/or streams on the subject property. Therefore, unless we receive five
copies of the additional information requested below, we will place this project on hold as incomplete
until we receive this additional information. If we do not receive the requested information, your project
will be formally returned as incomplete. Please provide the following information so that we may
continue to review your project.
Additional Information Requested:
1. The riparian buffer planting plan included in the stream restoration plan includes the planting of
tag alder (Alnus serrulata). DWQ acknowledges that tag alder is a natural component of riparian
areas and wetlands throughout North Carolina. However, this species fixes nitrogen, and the
downstream waters have a supplemental classification of NSW (nutrient sensitive waters). An
alternative woody riparian species should be selected.
2. This Office believes that the stormwater ponds labeled on the plans as "Site 4", "Site 5" and "Site
7", can be moved or reconfigured to avoid the impacts to the protected riparian buffers.. Please
revise the plans to avoid the impacts.

Please respond in writing within 30 calendar days of the date of this letter by sending a copy of this
information to me and to Lauren Witherspoon of the DWQ Raleigh Regional Office. If you will not be
able to provide the requested information within that timeframe, please provide written confirmation that
you intend to provide the requested information, and include a specific timetable delineating when the
requested materials will be provided. If we do not hear from you in 30 calendar days, we will assume that
you no longer want to pursue this project and we will consider the project as returned.
This letter only addresses the application review and does not authorize any impacts to wetlands, waters or
protected buffers. Please be aware that any impacts requested within your application are not
