Violator: Beacham Associates Ltd
Facility Name: Beacham Apartments #2 WWTP
Permit Number: NCO028215

Case Number: LM -2017-0037
ASSESSMENT FACTORS
1) The degree and extent of harm to the natural resources of the State, to the public health, or to private
property resulting from the violation;
The degree and extent of harm has not been quantified, however, high BOD concentrations in
wastewater effluent can lead to degradation of the receiving stream (eutrophication, oxygen
depletion, harmful effects on aquatic life, etc )
The receiving stream is an unnamed tributary to Brinson Creek, currently classified SC -NSW
waters in the White Oak River Basin
2) The duration and gravity of the violation;
This penalty assessment is for limit violations to the BODS daily maximum and monthly average
and for failure to properly monitor total nitrogen
3) The effect on ground or surface water quantity or quality or on air quality;
The effect on ground or surface water quantity or quality have not been evaluated
4) The cost of rectifying the damage;
Unknown
5) The amount of money saved by noncompliance;
Unknown for violations to BOD limits For failure to properly monitor, it is estimated that savings were $45
for TN
6) Whether the violation was committed willfully or intentionally;
There is no evidence that the violation was committed willfully or intentionally However, the
facility has one NOD in May 2017 and one NOV in July 2017, both for daily maximum BODS
violations
7) The prior record of the violator in complying or failing to comply with programs over which the
Environmental Management Commission has regulatory authority; and
The facility has zero penalty assessments in the preceding 12 -month period
8) The cost to the State of the enforcement procedures.
