Baker 5855 Old Carriage Road Rocky Mount, NC 27803 DWQ Project # 2008-1404 Nash County Subject Property: Lakewood Subdivision, Rocky Mount, NC Tar River Reservoir [030302,28-(63), WSIV, NSW, CA] REQUEST FOR MORE INFORMATION Dear Sirs: On September 25, 2008, the Division of Water Quality (DWQ) received your application dated September 11, 2008, with additional information received by DWQ on November 5, 2008, December 12, 2008 and December 29, 2008 to impact 10,464 square feet (ft) of Zone 1 protected riparian buffers and 14,134 square feet of Zone 2 (ft) protected riparian buffers to construct the proposed canal, boardwalk, trails from the lots and walkway to the boat docks and fishing platform. The DWQ has determined that your application was incomplete and/or provided inaccurate information as discussed below. The DWQ will require additional information in order to process your application to impact protected wetlands and/or streams on the subject property. Therefore, unless we receive five copies of the additional information requested below, we will place this project on hold as incomplete until we receive this additional information. If we do not receive the requested information, your project will be formally returned as incomplete. Please provide the following information so that we may continue to review your project. Additional Information Requested: 1. The elevation of the top of the stream bank does not appear to be correctly stated in the Level Spreader Supplement Form. It appears that the buffer down slope of the level spreader becomes quite steep. If the filter strip is too steep, please either redesign the riparian buffer to have appropriate slopes or relocate the level spreader to a location where the filter strip slopes are appropriate. 2. Zone 2 of the riparian buffer downslope of the level spreader must be allowed to secede to forest vegetation. Please respond in writing within 30 calendar days of the date of this letter by sending a copy of this information to me and to Lauren Witherspoon of the DWQ Raleigh Regional Office. If you will not be able to provide the requested information within that timeframe, please provide written confirmation that you intend to provide the requested information, and include a specific timetable delineating when the requested materials will be provided. If we do not hear from you in 30 calendar days, we will assume that you no longer want to pursue this project and we will consider the project as returned. This letter only addresses the application review and does not authorize any impacts to wetlands, waters or protected buffers. Please be aware that any impacts requested within your application are not authorized (at this time) by the DWQ.
