Findings of Fact - (9) (a) (i)
Practical difficulties or unnecessary hardships are present:
A. Applicant cannot make reasonable use of property for
consolidation of the Department of Water Management
without impacting the buffer
B. Hardship from application of the Rule combined with other
constraints
C. Hardship is due to configuration of property and location of
buffered stream
D. Applicant has not violated the Rule
E. Purchased some parcels prior to the effective date of the
Rule and others after
F. Unique for application of the Rule to prevent intended use of
a property a portion of which was purchased prior to
implementation of the Rule

Findings of Fact- (9) (a) (ii) & (iii)
The variance is in harmony with the general purpose and intent
of the State's riparian buffer protection requirements and
preserves its spirit
In granting the variance, the public safety and welfare have
been assured, water quality has been protected, and substantial
justice has been done.
• Propose to purchase 57,027 buffer mitigation credits
• Propose Stormwater Management Plan to treat
stormwater runoff from the facility

DWR Recommendation
DWR recommendation is that the Water Quality Committee grant
this major variance request.
If the Water Quality Committee approves this request, the Division
recommends approval with the following conditions or stipulations:
• Mitigation
The applicant shall provide mitigation for the impacts to the buffer by
purchasing 57,027 buffer credits from the North Fork Little River
Nutrient Offset & Buffer Bank sponsored by Wildlands Holdings II, LLC.

DWR Recommendation
• Stormwater Management Plan (SMP)
The applicant shall provide one copy of the approved SMP,
including plan details on full-sized plan sheets, with proof of the
City of Durham's approval. The approved SMP shall be
submitted to the DWR 401 & Buffer Permitting Branch digitally
at https://edocs.deq.nc.gov/Forms/Supplemental-Information-
Form before any impacts authorized in this approval occur. After
it is approved and submitted to the Division, the SMP may not be
modified without prior written authorization from the City of
Durham. If the SMP is modified in the future, then one modified
SMP with proof of approval shall be provided to the DWR 401 &
Buffer Permitting Branch prior to the commencement of the
modifications.
