On August 25, 2017, you requested a 401 Water Quality Certification from the Division of Water
Resources (Division) for the above referenced project to address a Notice of Violation (NOV 2017 -
CV -0001) issued by the Division. On November 14, 2017, the Division received a request via
email from your agent, Clement Riddle, to withdraw the current application. Therefore, your 401
Water Quality Certification file is hereby considered withdrawn.
Since you are no longer pursuing an after -the -fact permit for the wetland fill, you must submit a
Wetland Restoration Plan (Plan) to the Division per the requirements outlined in the NOV 2017 -
CV -0001 letter dated April 20, 2017. Please submit the Plan no later than January 5, 2018.
In an email sent to you on November 24, 2017 from Amanda Jones with the United States Army
Corps of Engineers (USACE), she requested that all unauthorized fill material from the wetland be
removed no later than February 1, 2018.
Please be aware that you do not authorization under Section 401 of the Clean Water Act for the
wetland fill and any additional work done within waters of the state may be a violation of North
Carolina General Statutes and Administrative Code.
