I have attached the previous file as requested along with my notes (.pdf map) that documents the history of this site to date. It looks like we have issued two permits on this site. One for the stream crossing immediately adjacent to Pond Road and then another stream crossing to access the trailer park in the southern part of the property. From what I can tell, there was fill placed in the same wetland as where your current request is when the road construction was occurring for the first crossing. We notified them of the problem and they removed the fill in 2010 (as conditioned by the permit for the second stream crossing). With regards to this current application, it is on hold until we can get additional information regarding avoidance/minimization measures and more details on the size/type agricultural building that is needed and what agricultural operation this building will be servicing if you are wanting to use a Nationwide Permit #40. As discussed on site, there are uplands immediately adjacent to the wetland fill areas that appear to be of adequate size to place a shed/building on and thereby avoid the need to fill this wetland again. This site also does not appear to be near any existing farming operations. If the applicant would like to continue with attempting to permit this fill material, this additional information should be submitted by October 27th or we will consider the application withdrawn and will then need to work with the owner to remove this fill material and restore the wetland areas to pre -construction conditions. Please note that if the application is withdrawn and the area is not restored in a timely manner, then this matter may be referred to the U.S. Attorney and/or Environmental Protection Agency for civil/administrative penalties.
