On October 20, 2017, the Division of Water Resources (Division) received your application
dated October 17, 2017 with additional information received on November 21, 2017 requesting
a Buffer Authorization from the Division for your project. The Division has determined that
your application is incomplete and cannot be processed. The application is on -hold until the
following information is received:
1. Please explain how you propose to construct your project, including the installation of
the retaining wall, the addition of earthen fill, such that downstream impacts to the
creek and impacts to the adjacent riparian areas do not occur.
2. In addition to your written response, please contact Jeremiah Dow at 919-791-4248 or
[e-mail] in order to schedule a site visit. The purpose of this visit is
to confirm the footprint/extent of the stream bank that is unstable and eroding. This is
necessary in order to determine whether the proposed impacts to the streamside area
(riparian buffer) can be authorized, per the Table of Use [15A NCAC 02B .0233 (6) .
Pursuant to Title 15A NCAC 02H .0502(c), the applicant shall furnish all of the above requested
information for the proper -consideration of -the application. If all of the requested information
is not received in writing within 30 calendar days of receipt of this letter, the Division will be
unable to approve the application and it will be returned. The return of this project will

necessitate reapplication to the Division for approval, including a complete application package
and the appropriate fee.
Please respond in writing within 30 calendar days of receipt of this letter by sending four copies
of all of the above requested information to the 401 & Buffer Permitting Unit, 1617 Mail Service
Center, Raleigh, INC 27699-1617.
Please be aware that you have no authorization under the Water Quality Certification Rules for
this activity.
