(SEGi) has been retained by HRP Renaissance Market (herein referred to as the "Applicant") to pursue USACE and DWR approvals, in the form of an Individual Permit (IP) Modification and Major Water Quality Certification (WQC) Modification respectively. The authorizations are necessary to facilitate the modification of the previously approved impact of 100 linear feet of jurisdictional stream. The project is located at the intersection of Military Cutoff Road and Sir Tyler Drive; Wilmington, New Hanover County, North Carolina and is locally known as Renaissance Market. The purpose of the modification is associated with road crossings that need to be modified from their original design to meet current standards. The Applicant has developed the majority of the property that was permitted with the existing Individual Permit. The current area, subject of the modification request, is one of the last remaining undeveloped tracts. Although the development of this area was included in the original permit, only a general design was required for approval. The new site plan — developed over the past year and include design aspects for the wetland modification is compliant with our rezoned conditional use and is no longer a concept plan. The plan attached incudes the feedback from multiple consultants and city officials (engineering, traffic, fire, etc.) and includes grading, utility design, and tenant specific input (truck route, landscape plan, outdoor seating areas, parking configuration, parking ratio, building locations and building design). During the design and review by The City of Wilmington and NC DOT, it became apparent that additional lanes would be necessary on Sir Tyler Drive. In order to accomplish this the stream crossing at Sir Tyler Drive will need to widened .by 60 linear feet. To accomplish this the applicant is proposing to reduce previously approved impacts downstream of Sir Tyler Drive to ensure no increase in impacts occur. In addition to the modification of impacts, the Applicant is also requesting a three (3) year extension for the permit to December 31, 2020. This will ensure ample time to complete the construction of the project. The project is currently in compliance with all conditions of the existing permit. Compensatory mitigation that was required included the purchase of mitigation credit and preservation of existing wetlands. Both of these aspects have been completed and are detailed in the attached document. Modification Purpose and Need SEGi The original and current overall project purpose is to construct a mixed use office and retail development with associated amenities along the Military Cutoff Road coridoor in Wilmington, New Hanover County, North Carolina. This section of Wilmington is rapidly growing and the need for both office and retail space exists. The area around the project has grown considerably since the original permit was issued in 2006. Mayfaire Town Center and the widening of Military Cutoff Road are the most notable changes. This growth has increased traffic in and around the project site, causing NC DOT and The City of Wilmington to require additional turning lanes along Sir Tyler Drive. The proposed new lanes will result in additional stream impacts to the Sir Tyler Drive stream crossing. The project was issued an Individual Permit (IP) in 2006 (extended to December 31, 2017) which approved impacts to 100 linear feet of stream and 0.44 acres of riparian wetland. The Permittee is proposing to modify the permit to reduce the stream impacts at the approved stream crossing to off -set the proposed unavoidable impacts at Sir Tyler Drive. The applicant is also requesting a three (3) year extension for the permit to December 31, 2020. II. Location and Existing Conditions The project site is on approximately 68 acres of land located east of Military Cutoff Road at its' intersection with Sir Tyler Drive; Wilmington, New Hanover County, North Carolina and is locally known as Renaissance Market (See Appendix A). Wetlands present within the project area include streams, riparian wetlands and pocosins. A tributary to Howe Creek runs through the project and connects to Howe Creek along the northern property line. The majority of the original project has been built with only the current subject area remaining. III. Project History A Department of the Army (DoA) wetland Jurisdicitonal Determination (JD) was issued for the project area in December 2009 (See Appendix B for JD Maps and Forms). A DoA Individual Permit was then issued in 2006 authorizing 0.44 acres of riparian wetlands and 100 linear feet of stream impacts (See Appendix C). The permit also authorized temporary impact to 56 linear feet of stream and 140 square feet of wetlands. No other DoA or Department of Water Resources (DWR) permits have been obtained. Mitigation to off -set the approved impacts included the purchase of 0.88 acres of riparian wetlands and 312 linear feet of warm water stream. The Permittee also preserved 10.50 acres of DoA Jurisdictional Wetlands adjacent to the project area. Please see Appendix D for mitigation documents. Renaissance Market IP Modification SEGi The new site plan — developed over the past year, has taken the property through a more complex conditional use commercial zoning, where the site plan submitted for rezoning and permit must be substantially similar to what was approved in front of city council. The updated plan included for the wetland modification is compliant with our rezoned conditional use and is no longer a concept plan. The plan attached incudes the feedback from multiple consultants and city functions (engineering, traffic, fire, etc.) and includes grading, utility design, and tenant specific input (truck route, landscape plan, outdoor seating areas, parking configuration, parking ratio, building locations and building design). As part of the new plan review a traffic study was required by The NC Department of Transportation (NC DOT) and The City of Wilmington. Results of the traffic study indicated that additional turn lanes will be required along Sir Tyler Drive. These additional lanes will allow the necessary stacking area for vehicles turning left from Sir Tyler Drive onto Military Cutoff Road. IV. Modification Description The Applicant is requesting to modify the existing permitted impacts to allow construction of the additional turning lanes on Sir Tyler Drive. The existing permit approves permanent impacts to 0.44 acres of Section 404 jurisdictional wetlands and 100 linear feet of stream (Crossing B). It also approves temporary impacts to 0.003 acres of Section 404 jurisdictional wetlands and 56 linear feet of stream. Please see Appendix C. Specifically, the Applicant is requesting to reduce the width of the permitted stream crossing labeled "Road Stream (1)" on sheet C3 from 100 linear feet to 40 linear feet (Crossing B). The remaining 60 linear feet of stream impacts will then be utilized for the additional lanes at Sir Tyler Drive (Crossing A). Please refer to Appendix E — Proposed Site Plan and Impact Map, for details of the proposed impacts. Please note that the existing pipes under Sir Tyler Drive are at two different depths. This is the result of the higher pipe having been installed prior to the feature being designated a stream. The second pipe was then partially buried in the substrate as required by DWR. The extension of these pipes will be completed in a similar fashion to maintain the current pipe slopes. V. Avoidance and Minimization It is the Applicant's desire to avoid and/or minimize impacts to wetlands to the greatest extent practicable. During the design phase of the crossings the engineer and design team reviewed multiple layouts to accomplish the Applicants purpose and need while limiting wetland impacts. Avoidance of impacts as it relates to Section 404(b)(1) guidelines was primarily accomplished during the original IP review process. As this modification is specific to the existing permitted crossing and the unavoidable impacts related to required traffic improvements, avoidance was limited. However, the rip -rap aprons at each crossing were able to be reduced or eliminated. Minimization of impacts was also demonstrated during the original IP process. However, additional minimization techniques have been applied during the modification process. These include the use of retaining or end walls at each crossing. Both of which limit side -slopes subsequent overall crossing width. Each crossing was also reviewed and redesigned within the smallest footprint possible while still meeting the design criteria for both NC DOT and The City of Wilmington. Please see Appendix E. Renaissance Market IP Modification VI. Alternatives SEGi During the original IP process, the Applicant did successfully perform an Alternative Analysis per the Section 404(b)(1) guidelines, including off-site analysis. The Applicant has also investigated potential on-site alternatives to the proposed modified design for each crossing. They are as follows: A. On -Site Alternatives Analysis 1. Alternative 1 — Current Proposed Design: This alternative was designed to meet NC DOT and The City of Wilmington traffic requirements, while minimizing the width (stream impact) to the least amount possible at both crossing A and B. Alternative 1 was accepted as it was the least environmentally damaging practicable alternative. 2. Alternative 2 — Use of Bridge(s): The option to reduce or eliminate was each crossing by utilizing bridges was considered. However, due to the existing crossing (A) at Sir Tyler bridging only the proposed additional lanes was not practicable and would not meet NC DOT requirements. Bridging the existing permitted crossing (B) is not possible due to limited areas for bridge take -off and landing. Therefore, Alternative 2 was rejected due to design constraints. 3. Alternative 3 — Use of Bottomless Culvert(s): The use of bottomless or three -sided culverts at crossing A and B was considered. At crossing A, NC DOT will not allow the use of a bottomless culvert in this situation. Additionally, it would not possible to utilize a bottomless culvert for only the additional lanes proposed. The alignment of crossing B makes the utilization of a bottomless culvert difficult at best. Due to existing alignment of the take -off point the culvert would encroach into both existing and proposed parking areas. For these reasons this alternative was rejected. 4. Alternative 4 — No Action Alternative: The No Action Alternative or the alterative that proposes no impacts would not provide the additional turn lanes required at Sir Tyler Drive. This would eliminate access to the current project site Sir Tyler Drive and limit interconnectivity within the subdivision. For these reasons the No Action Alternative is not practicable and was rejected. B. Alternative Analysis Conclusion: Based on the results of the on-site and off-site Alternative Analysis, it is apparent that on-site Alternative 1 is the least environmentally damaging practicable alternative. VII. Compensatory Mitigation A. Compensatory Mitigation: The Applicant has chosen to modify the existing approved impacts and not increase any impacts to the overall project. For this reason, no additional mitigation is being proposed at this time. Renaissance Market IP Modification VIII. Summary The Applicant is proposing to modify the existing Individual Permit to reduce impacts at stream Crossing B by 60 feet and widen a second existing crossing, Crossing A by 60 feet. The expansion of the existing crossing is necessary to meet the requirements of NC DOT and The City of Wilmington traffic requirements. No additional impacts are being requested as part of this modification. The Applicant intends to utilize the previously approved mitigation to offset the proposed permanent impacts to the stream as no additional impacts are proposed. The Applicant and SEGi believe the project, as proposed, is the least environmentally damaging, practicable alternative. In addition to the requested impact modification, the Applicant also requests the expiration of the permit be extended for 3 years.
