HomeMy WebLinkAbout19990658 Ver 3_Other Agency Comments_200901149 cl- v(SFS V3 Permit Class Permit Number MODIFICATION/MAJOR 128-00 STATE OF NORTH CAROLINA Department of Environment and Natural Resources J v and Coastal Resources Commission 009 e�+ JAN � for X Major Development in an Area of Environmental Concern pursuant to NCGS I I3A-118 X Excavation and/or filling pursuant to NCGS 113-229 Issued to Snug Harbor Partners, LLC, 252 Highway 70 East, Sea Level, NC 28577 Authorizing development in Carteret County at Nelson Bqy and Salter's Creek, south side US 70, near Sea Level as requested in the permittee's application dated 5/5/08, incl. drawings(10), CP1- CP8 all dated revised 9/17/08, SD -2R dated 6/12/06 and BW -2 dated 9/17/08 This permit, issued on January 7, 2009 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. 1) Unless specifically altered herein, this Major Modification authorizes a reconfiguration of the upland subdivision portion of the previously approved project, a reconfiguration of the previously approved marina portion of this project, and the widening of the previously authorized access channel, all as depicted in the attached permit application forms and workplan drawings. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2012 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee �y Sailors Snug Partners, LLC Permit #128-00 ` Page 2 of 5 ADDITIONAL CONDITIONS Upland Development 2) Unless specifically altered herein, this permit authorizes only the land disturbing activities associated with development of the Marina Village at Snug Harbor subdivision, all as expressly and specifically set forth in the permit application and depicted on the attached workplan drawings. Any additional land disturbing activities and/or construction, including but not limited to single family home construction, shall be evaluated on a case-by-case basis by a representative of the Division of Coastal Management (DCM) to determine additional permit requirements. Contact a representative of the Division at (252) 808-2808 prior to the commencement of any such activity for this determination. 3) All portions of all sidewalks that are located within 30 feet of the normal high water line shall be wooden, slatted and elevated above the high ground substrate. Included in this requirement are those sections of the proposed concrete sidewalks located around the aLithorized high ground marina basin. Additional Marina Basin and Access Channel Excavation 4) The additional area of excavation of the access channel and marina basin shall adhere to that depicted on the attached workplan drawings. 5) Excavation shall not exceed -3 feet below the normal low water level. In no case shall the depth of excavation exceed the depth of connecting waters. Spoil Disposal 6) Al! material resulting from the additional access channel and marina basin excavation shall be disposed of in the existing on site spoil disposal area. Shoreline Stabilization 7) The bulkhead shall be constructed prior to any backfilling activities. 8) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure. 9) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet piles or other suitable materials approved by Division personnel. 10) The backfill material shall be clean and free of any pollutants except in trace quantities. 11) All backfill material shall be obtained from a high ground source and confined behind the permitted bulkhead. Sailors Snug Partners, LLC ADDITIONAL CONDITIONS Permit #128-00 Page 3 of Community Access Pier 12) This Major Modification authorizes only the community access pier and associated uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this access pier without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 13) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 14) The authorized structure and associated activity shall not cause an unacceptable interference with navigation. 15) The roof of the covered platform shall not be designed for second story use. 16) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 17) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury that may be caused from existing or future operations undertaken by the United States in the public interest. 18) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 19) This permit does not authorize any formalized boat slips on the authorized community access pier. Marina Reconfiguration 20) This Major Modification authorizes a reconfiguration of the previously permitted marina facility, all as depicted in the attached workplan drawings and permit application forms. 21) Prior to the occupancy of any slips authorized under this Major Modification, a marine pumpout sewage disposal facility shall be installed and operable, and maintained for the life of the marina. 22) Prior to the occupancy of any slips authorized by this permit, the permittee shall meet on-site with a representative of the Division to ensure that the required pumpout facility is in place and operable. Sailors Snug Partners, LLC ADDITIONAL CONDITIONS Permit 4128-00 Page 4 of 5 23) The marina facility shall display a sign showing the location of the on-site pumpout facility, including other appropriate waste disposal information, at the entrance and exit from the main pier(s). 24) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the marina facility. Any sewage discharge at the marina facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 25) This Major Modification authorizes a total of 53 formalized boat slips. Sedimentation and Erosion Control NOTE: A modified Erosion and Sedimentation Control Plan will be required for this project. If such approval has yet to be requested, this plan must be filed at least thirty (30) days prior to the beginning of any land disturbing activity. Submit this plan to the Department of Environment and Natural Resources, Land Quality Section, 127 Cardinal Drive Extension, Wilmington, NC 28405. 26) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 27) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, etc.). Stormwater Management 28) The N.C. Division of Water Quality approved this project under stormwater management rules of the Environmental Management Commission under Stormwater Permit No. SW8970431, which was modified on 11/9/07. Any violation of the permit approved by the DWQ shall be considered a violation of this CAMA permit. General 29) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the orized representative, said structure or work shall cause opinion of the Secretary of the Army or his auth unreasonable obstruction to free navigation of the navigable waters, the permittee shall be required, upon due notice from the Corps of Engineers, to remove relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. Sailors Snug Partners, LLC ADDITIONAL CONDITIONS Permit #128-00 Page 5 of 5 30) This Major Modification shall be attached to the original of Permit No. 128-00, which was issued on 8/18/00, as well as all subsequent modification, renewals and refinements, and copies of all documents shall be readily available on site when a Division representative inspects the project for compliance. .3 All conditions and stipulations of the active permit remain in force under this Major Modification unless specifically altered herein. 32) This permit shall not be not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. NOTE: This permit does not eliminate the need to obtain any additional permits, approvals or authorizations that may be required, including but not limited to any permits that may be required for the construction of the wastewater treatment plant or the community water supply system. NOTE: The N.C. Division of Water Quality has authorized the proposed project under General Water Quality Certification No. 3642 (DWQ Project No. 990658V3), which was modified on 12/23/08.
