Explain the purpose of the proposed project: The purpose of the proposed project is to provide access to an area of the proposed subdivision that contains 44 residential lots. 3e. Describe the overall project in detail, including the type of equipment to be used: The overall project consists of development of the site with a 70 lot single family residential sub -division. In order to provide access to 44 lots of the residential sub -division, the applicant proposes to construct an access road (Dolomite Drive) from Moonstone Court, which will require a stream/wetland crossing. To facilitate development of the site and construction of the proposed stream crossing, clearing and grading the site is necessary. Comments: Pilot was informed that this development is in general compliance with a plan approved prior to implementation of Phase 2 NPDES and prior to implementation of Jordan Lake buffer rules. Therefore it is our understanding that the stream buffer and stormwater regulations in place at the time of the original plan approval apply. D. Impact Justification and Mitigation 1. Avoidance and Minimization 1 a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project. The applicant has designed the proposed residential sub -division to avoid other impact to streams and wetlands, specifically associated with lot/pad fill. The applicant has further demonstrated avoidance and minimization of stream and wetland impacts by proposing to construct head/end walls. The residences will utilize municipal sanitary sewer services and has been designed to avoid impact to jurisdictional features associated with sewer line connection. The sanitary sewer services will connect to existing sewer lines that cross the site. The applicant has designed the stream crossing to be buried 6 inches below the existing stream bed elevation to adequately allow aquatic passage. The remaining approximate 1.31 acres of wetlands and 3,762 linear feet of stream channel are being avoided. 1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques. The clearing limits will be staked and best management practices will be used. A temporary coffer dam will be installed upgradient of the proposed culvert. During construction, water will be pumped around the construction footprint. Appropriate stream bank protection will be provided in the channel during construction and all excess excavated material will be immediately removed from the stream bank crossing area. Upon completion of the culvert installation, the temporary sand bag coffer dam will be removed and flow will be diverted through the culvert. Following construction, disturbed banks will be restored to similar pre -construction conditions, matted and seeded/live staked. 2. David Bailey with the US Army Corps of Engineers was also present during the site visit. The Division acknowledges the areas and boundaries identified as jurisdictional wetlands by the USACE. The attached map accurately depicts all stream determinations conducted during the site visit. Please note that at the time of this letter, all perennial stream channels and jurisdictional wetlands found on the property are subject to the mitigation rules cited above. These regulations are subject to change in the future. In addition, the Jordan Lake Buffer Rules may apply to some streams at this location, please be sure to contact the local government for further information regarding the Jordan Lake Buffer Rules. The owner (or future owners) should notify the Division (and other relevant agencies) of this decision in any future correspondences concerning this property.
