PROJECT SUMMARY: The applicant is proposing to construct two separate (2) access piers each with a covered T -Head platform and floating kayak launch for use by current and future residents of the Kingfish Bay Subdivision. Kingfish Bay Development, LLC Page 2 9. PROJECT DESCRIPTION The proposed project is located at the end of Kingfish Blvd, near Calabash in Brunswick County, adjacent to the Calabash River. To find the property from U.S.-17 S Shallotte, turn left onto Seaside Rd SW/NC 904 and travel approximately 2.22 miles. Turn right onto Old Georgetown Rd. SW/NC-179 and continue for approximately 4.18 miles. The entrance to Kingfish Bay Subdivision will be located on the left side of the road. Follow the main boulevard and take the first right off the roundabout. The improved road will end and there is a dirt road you can follow to reach the shoreline area of the tract. Some travel by foot may be required. The project site is a 68.2 acre parcel of land which is currently an unfinished subdivision known as Kingfish Bay. The majority of the subdivision remains undeveloped, however new construction of single family residences is ongoing on the north side of the tract, outside of any CAMA Areas of Environmental Concern (AEC). High ground vegetation consists mainly of hardwoods including live oaks, pines, and red cedar as well as natural shrubs and herbaceous vegetation. There is an approved wetland delineation by the U.S. Army Corps of Engineers for the tract that expires 12/21/2021 (See Project Narrative Section 3.11 for list of previous authorizations). Coastal wetlands border the entire length of shoreline and include high marsh measuring approximately 10'-15' in width and low marsh measuring approximately 80'-100' in width. High marsh areas consist primarily of Salt Meadow Hay (Spartina patens) and Black Needlerush (Juncus roemarianus). Low marsh areas consist primarily of Smooth Cordgrass (Spartina alterniflora). Shoreline frontage along Calabash River is approximately 2,447 linear feet. The application states that the high ground portion of the site has an average elevation of approximately 12 feet above normal high water (NHW). The Town of Calabash Land Use Plan classifies the upland areas of this project as Residential and the wetland and open water areas as Conservation. The waters of the Calabash River in the vicinity of the project area are classified SA; HQW by the NC Division of Water Resources. The Division of Marine Fisheries has NOT designated these areas as Primary Nursery Area and the waters of Calabash River area CLOSED to the harvesting of shellfish. 10. PROPOSED PROJECT The applicant is proposing to construct two (2) separate access piers each with a covered T -Head platform and floating kayak launch for use by current and future residents of the Kingfish Bay Subdivision. The western proposed pier would measure approximately 6' in width and is proposed to extend approximately 156' waterward of the Mean High Water (MHW) line with approximately 59' of access landward of the MHW line. The eastern pier is proposed to extend approximately 150' waterward of the MHW line with approximately 80' of access landward of the Mean High Water (MHW) line. Each of the two access piers are proposed to terminate at a fixed, covered, T -head measuring approximately 16' in width by 16' in length. In addition, each of the two (2) proposed access piers are proposing to have a ramp located off the west side measuring approximately 6' in width by 16' in length that leads down to a proposed floating kayak launch measuring approximately 10' in width by 24' in length. The proposed locations of the kayak launches are intertidal areas void of water during typical low tides. The kayak launches are proposed to have stops installed on the associated pilings at 24" above the existing bottom to prevent the platform from resting on the substrate during low tides (See Sheets No. 3 & 4 of 5). The two community kayak facilities have been proposed to incorporate open water areas void of prominent oyster beds that are apparent in the surrounding intertidal areas of Calabash River. The proposed structures are located a distance greater than 150' from the property's riparian line to the west and a distance greater than 300' from the property's riparian line to the east. ANTICIPATED IMPACTS The proposed construction of two separate community piers and kayak launches would incorporate approximately 2,828 square feet of Estuarine and Public Trust Waters Areas of Environmental Concern, of which 996 square feet would shade coastal wetlands. The western proposed pier extends approximately 90' into a waterbody that measures approximately 360' across. The eastern proposed pier would extend approximately 75' into a waterbody that measure approximately 310' across. As proposed, the piers and T -Heads would not appear to extend into the channel portion of the waterbody nor exceed the I/4 width of waterbody limitation. The U.S. Army Corps of Engineers federal channel located within the Calabash River terminates prior to the upstream location of the proposed facilities. The proposed water dependent structures would not encroach into either of the 15 feet adjacent riparian property owner setback requirements. The proposed facilities would not provide mooring for any vessels at any time and proposed only for non -motorized use by subdivision residents. Project Narrative 3.1.1 Introduction and Project History The applicant, Kingfish Bay Development, LLC, purchased the 68.2 -acre tract of land in 2016 from a bank foreclosure company to modify and complete the planned unit residential development. The property is located off Beach Drive SW (Hwy 179), northeast of the Town of Calabash and between Highway 179 and the Calabash River (See Appendix A). The previous owners, known as the Wakefield/Sandler companies, brought water and sewer to the project and constructed some attached patio homes just south of NC 179 (Beach Drive). They also obtained Army Corps and NCDENR permits for four wetland -stream road crossings. Wetland delineations, 404/401 permits, and stormwater/sediment control permits were also approved in the 2006 -2007 calendar years. A CAMA application for two 10 slip docking facilities within Calabash Creek was also pending in 2008, but were not authorized before the previous owners stopped all progress on the property. What follows is a synopsis of the past approvals and development status of Kingfish Bay. Wetland delineation approvals SAW -2006 by Ronnie Smith COE issued 1/6/06 expired 1/6/11. Renewal of JD for all wetlands on 8/28/12 by Emily Hughes COE; and updated 12/21/16 by Liz Hair that expires 12/21/21. US Army Corps Nationwide Permits, SAW -2006-00020, authorized four road crossings that impacted .246 acres of riparian wetlands and 120 feet of stream. Issued by Kim Garvey (COE) on 7/19/07 and expired 7/19/10. Reissued by Emily Hughes 7/16/10 and expired 8/18/12. NCDENR 401 Certifications, DWQ permit #07-0587 issued 6/22/07; General water quality certification (GC3886) was issued 8/14/12. DWQ permit 07-0587V2 required mitigation and recordation of a conservation map that included 7.5 acres of wetlands. Mitigation requirements were met when Wakefield mailed in a check (#1208) to the EEP in the amount of $20,567 on 9/7/07. The conservation easement was not recorded before the prior owners ceased all project activities. Stormwater Permit SWS 061225 was issued to Wakefield/Sandler on 2/19/07 and it was good for 10 years. 3.1.2 Existing Conditions The nearly rectangular tract known in the permit past as the "Wilson tract" is specifically located on tax pin #103518318735 and at Latitude 33.8913 / Longitude -78.5585 and is situated between NC 179 and the Calabash River. The tract consists of mostly well drained Baymeade and Leon soil types on the uplands with Bohicket soils along the small streams and Carteret salt marshes along the tidal waters. The tract has nearly 50 feet of fall from a 53' elevation in its NE corner down to the MLW mark. Calabash Creek is classified as SA and is closed to shell fishing at this location. The site is not officially classified as PNA but does exhibit nursery characteristics. There is oyster rock scattered along the intertidal fine sand flat with a 5.5 foot daily tidal amplitude. There was no submerged aquatic vegetation (SAV) along the shoreline. The CAMA regulated salt marsh consisted of mostly black needlerush and smooth cordgrass along the 5-7 foot high banks along the high tide line. The mean high-water line was surveyed at 4.2' MSL and extends along these near vertical banks up the creek to a point where the 404 wetland and stream intermixes. Two small RECEIVED DCM WILMINGTON, NC freshwater stream branches and their adjacent wetlands were surveyed and approved by the Army Corps of Engineers. Except for the previously permitted 4 minor road crossings no other wetlands have been impacted by proposed development activities. A silt fence buffer 75 foot landward of the MHW and streams was installed in the past to prevent logging and clearing in wetlands as an added precaution. 3.1.3 Proposed Action The applicants propose to construct two residential wooden fixed piers out from the common buffer/walking paths and adjoining playground areas where there will be gazebos, siting areas and a gang way down to a small floating dock that will service as a kayak launch. The western pier will measure about 156 feet in length by 6 feet in width and will have a 16' x 16' gazebo over the water. A 6 -foot wide hinged gang way with treads will lead down to a wooden 24' x 10' floating dock with a 12' x 4' notch or ramp for safe kayak launching activities. The end of the pier will align with the waterward end of the % distance rule and will sit in 1 foot to no water during most of the low tidal cycles. To keep the floating docks from resting on the mud flat a wooden "stop" cradle will sit under the floating dock so that it will be at least 18 inches above the mud flat. Both docks will be aligned away from all oyster rock zones. The eastern fixed pier will measure approximately 150 feet and will contain the same features as the western pier amenities just described. Since the owners of the properties are design and build all the single-family homes they have set aside 3 lots on the eastern end that would have optional riparian access rights. All the remaining 18 marsh view lots will be set back 75 plus feet from the MHW and will not have riparian rights. A common sand and gravel nature trail is planned along 2240 feet of estuarine shoreline within the project. It is anticipated that up to 238 cottages will be constructed on the property over the next 10 years. The roads and paths have been permitted and have been partially installed. In addition to the previously constructed entrance road, patio homes and sales office the owners have been building an amenity center with pool, gym, meeting/siting/game rooms and an HOA/ managers office.
