Hubert Hawkins, Dam Safety Engineer Division of Land Resources, Land Quality Section FROM: Ron Linville, Regional Coordinator JAN 1 P ?q Habitat Conservation Program ZJ UENR - VVA.Ti_R 01JALI1 Y sr;??;;{lR,:aTr: i sArlcl DATE: October 7, 2008 VVETLANX AND SUBJECT: Cleveland County Sanitation District, Off-Stream Reservoir, Cleveland County These comments are provided in accordance with provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et. seq.), the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d) and the Dam Safety Law of 1967 (GS 143-215.23 et. seq.). The proposed impoundment will affect about 800 linear feet of jurisdictional stream to create a 4.5 acre water supply (pre-treatment) water storage reservoir. No state or federal threatened or endangered species are indicated for the area. We have reviewed the subject project and find no cause for objecting to the design and specifications of the dam with the following provisions: 1) As appropriate, minimum flow requirements as established by the NC Division of Water Resources should be provided immediately downstream of the dam. Stream flows below the dam should not fall below the 7Q10. 2) Project sponsors should be contact the US Army Corps of Engineers (COE) and the NC Division of Water Quality (DWQ) to obtain a COE 404 Permit and a DWQ 401 Certification. Any stream or wetland mitigation required at this site should be should be coordinated with the COE and DWQ. 3) Stringent erosion control measures should be installed where soil is disturbed and maintained until project completion. 4) The stream above and below the impoundment should be provided with permanently preserved undisturbed buffers to enhance water quality and habitat benefits. Minimum 50" intermittent stream or minimum 100' perennial stream forested buffers are recommended. We routinely recommend fencing and conservation easements to protect buffers.
