Notification (PCN) on June 26, 2017 was unnecessary. ''This notification proposes permanent impacts to 0.08 acre of
wetlands to construct a - new overhead 115k trans`m'ission line within entirel,y;new right -of -Way. The existing substations
at either terminus are proposed to be expanded',to,'accommodate the new bine. This project will convert forested
wetlands'to maintained herbaceous/scrub shrub. Wetlands however no discharge of.fill'is associated with the'conversion
(stumping and grubbing will not occur)-. Based on the, information you provide; your workis authorized by Nationwide
Permit (NWP) 12 for Utility Line;Activities proyi,d'edit is accomplished in accordance'with the NWP's along with'the

Any violation of the a ttache'd'conditions or deviation from your proposed work scope may subject the permittee,to'!a

authorization expires or is suspended, revoked, or is modified, such that the activity would no longer comply, With the

completed within twelve months of the date of the nationwide permit's expiration, modification or revocation, unless

delineate for waters type. I noticed you have several ditches listed. Please note, with a PJD we are assuming these are
jurisdictional. Perhaps we should review some of these features during our field visit. Please complete our JD request

Missing information for PCN:
You did not provide a mitigation plan. Please see Regional Condition 4.1.10
"Any permanently maintained corridor along the utility right of way within forested wetlands shall be considered a
permanent impact. A compensatory mitigation plan will be required for all such impacts associated with the requested
activity if the activity requires PCN and the cumulative total of permanent forested wetland impacts exceeds 1/10 -acre,
unless the District Engineer determines in writing that either some other form of mitigation would be more
environmentally appropriate or the adverse effects of the proposed activity are minimal.
For permanent forested wetland impacts of 1/10 -acre or less, the District Engineer may determine, on a case-by-case
basis, that compensatory mitigation is required to ensure that the activity results in minimal adverse effects on the
aquatic environment."
Additionally, I did not see a restoration plan for cleared areas. See Regional Condition 4.1.9
"A plan to restore and re -vegetate wetland areas cleared for construction must be submitted with the required PCN.
Cleared wetland areas shall be re -vegetated to the maximum extent practicable with native species of canopy, shrub,
and herbaceous species. Fescue grass shall not be used."
Please provide impact maps and typical details for access roads, replanting, etc. Please provide justification for 100 ft
permanent maintained corridor.
The PCN includes a letter to SHPO which references previous correspondence. Please provide all correspondence with
the SHPO.
At this time the application is incomplete. Please provide the additional information within 30 days or we may withdraw
your application. We are a scheduled to conduct the field review on August 9-10. 1 will email you prior to our meeting
to select a meeting location. I suggest we meet around 9:00 if that works for you and your team?

Because the area will still function as a wetland it is still considered a temporary impact. We do not require mitigation
for permanent.conversion of.forested wetland to an herbaceous, wetland. The USACE'doe's require mitigation for this

I appreciate the additional information. After further review we determined the notification via Pre -Construction
Notification (PCN) on June 26, 2017 was unnecessary. This notification proposes permanent impacts to 0.08 acre of
wetlands to construct a new overhead 115k transmission line within entirely new right-of-way. The existing substations
at either terminus are proposed to be expanded to accommodate the new line. This project will convert forested
wetlands to maintained herbaceous/scrub shrub wetlands however no discharge of fill is associated with the conversion
(stumping and grubbing will not occur). Based on the information you provide, your work is authorized by Nationwide
Permit (NWP) 12 for Utility Line Activities provided it is accomplished in accordance with the NWP's along with the
corresponding permit conditions. See the link below.

Any violation of the attached conditions or deviation from your proposed work scope may subject the permittee to a
stop work order, a restoration order and/or appropriate legal action. The expiration date for the permit authorization is
March 18, 2022 unless the nationwide authorization is modified, suspended or revoked. If the nationwide permit
authorization expires or is suspended, revoked, or is modified, such that the activity would no longer comply with the
terms and conditions of the: nationwide permit, activities which have commenced (i.e., are, under construction) or are
under contract to commence-Jri reliance upon the nationwide permit,.will remain authorized provided the activity is
completed within twelve months of the date of the nationwide permit's expiration- modification or 'revocation, unless
discretionary authority has been exercised on a case-by-case basis to modify, suspend or revoke the authorization.
Activities subject to Section 404 may also require an individual Section 401 Water Quality Certification: You should
contact the. NC Division of Water Resources to, determine.Section 401 requirements. This response does not relieve the
permittee -,of the responsibility to obtain any other required Federal, State or local approvals/permits. Please let me

I have left a message for Amanda but we have not been able to catch up. I want to ensure you know we will not be
requiring mitigation for this project. Our scope for this project is limited to the waters of the United States (wetlands)
that will be directly affected by the proposed structures and uplands directly affected as a result of authorizing the
structures. I would still like to see the additional correspondence from the SHPO.
