Authorizing development in Hvde and Dare County at Hatteras Inlet, Hatteras Island Ferrv Basin,
and Silver Lake Harbor , as requested in the permittee's application dated 7/13/17, including
attached workplan drawin�s (43) as referenced in Condition No. 2 of this permit.
This permit, issued on October 9. 2017 , is subject to compliance with the application (where consistent
with the permit}, all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Ocracoke-Hatteras Passen�er Ferry
1) Unless specifically altered herein, this Major Modification authorizes the follawing infrastructure
improvements to two existing ferry facilities related to the praposed passenger ferry route between
Hatteras Island and Ocracoke Island: (a) two additional parking lots; (b) two stormwater infiltration
basins; (c) approximately 1851inear feet of trench drain; (d) two open a.ir covered passenger vyaiting
pavilions; (e) gravel construction entrances; (� reconfiguration of some existing piles and dolphin
strucfures; {g) floating dock structures; (h) sidewalk/ramp/boardwalk/path improvements; (i) a transit
pull out area for a passenger tram; (j) additional restroom building; (k) associated utiliry work; (1)
parking lot and fencing improvements; and (m) miscellaneous additional improvements, all as depicted
on the atta.ched workplan drawings.

This permit action may be appealed by the permittee or
other qualified persons within twenty (20} days of the issuing
date.
This permit must be accessible on-site to Departrnent
personnel when the project is inspected for compliance.
Any maintenance work or project modificarion not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2021
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina Coastal
Management Program.

2) Unless specif cally altered herein, a11 work authorized by this permit shall be carried out in accordance
with the following attached workplan drawings, 22 dated 5/1/17, 9 dated S/10/17, 6 dated as received 8/8/7, 4
dated 6128/17, 2 dated 7/12/17, & 2 dated 8/1 ll17, except as rriodified herein.
3} In accordance with commitments rnade by the permittee, in order to protect the endangered West Indian
Manatee, Trichechus manatus, the applicant shall implement the U.S. Fish & Wildlife Service's
Guidelines, and strictly adhere to all requirements therein. The guidelines can be found a�

NOTE: The State Historic Preservation Qffice Representative signed the Historic Architecture and
Landscapes Assessment of Effects Form on January 24, 2017 �with concurrence that the proposed
project will have a"de minimus" effect on historic properties, including the National Register-
listed Ocracoke Historic District and t1�e Cape Hatteras Natianal Sea�hore.
4) The authorized activities shall not result in any permanent or temporary impacts to wetlands, without
permit modification.
5) No new excavation or fill shall occur within waters of the State, either by conventional methods or by
prop wash "kicking", without permit modification.
6} Construction staging areas shall be located only in upland areas, and not in wetlands or waters of the Sta.te.
7) Any waste materials or debris associated with construction, demolition, or other activities shall not enter
wetlands or waters of the State, even temporarily. It shall be disposed of at an approved upland site or
shall be recycled in an environmentally appropriate manner provided appropriate authorizations from any
relevant state, federal, or local authorities are obtained.
8) This Perrnit authorizes only the floating dock structures, piles, and dolphin structures and associated
structures and uses located in or over the water that are expressly and specifically set forth in the permit
applicatian. No other structure, whether floating or stationary, may become a permanent part of this
facility without permit modification. No non-water dependent uses of structures may be conducted on, in,
or over public trust waters without permit modificatian.
9} This project shall conform to a11 requirements of the N.C. Sedimentation Pollution Control Act and the
N.C. Department of Transportation's {NCDOT's) Memorandum of Agreement with the N.C. Division of
Energy, Mineral and Land Resources.
10} Any utility work associated with this project that is not specifically depicted on the atta.ched workplan
drawings, or described within the attached permit application, shall require approval from DCM, either
under the authority of this permit, or by the utility company obtaining separate authoriza#ion.
11) Uncured concrete shall not be allowed to contact waters of the State or water that will enter waters of the
State.
12) The permittee and/or his con�ractor shall contact the DCM Transportation Field Representative in
Elizabeth City at {252} 264-3901 to request a preconsttuction conference prior to praject initiation.

13) If it is determined �hat additional permanent andlor temporary impacts are necessary that are not shown on
the attached workplan drawings or described in the autharized permit application, a permit modification
anc}/or additional authorization from DCM shall be required. In addition, any changes in the approved
plan rr�ay also require a permit modification and/or additional authorization from DCM. The permittee
shall contact a representative af DCM prior to commencement of any such activity for this determination
and any permit modification.
14) Nothing in this permit authorizes any activity which has not received approval from the National Park
Service (NPS) for work within the Cape Hatteras National Seashore.
NOTE: The NPS issued a Special Use Permit # 5700-027 on July 14, 2017.
1S) The N.C. Division of Water Resources {DWR) authorized the proposed project on 10/3/17 (DWR Project
No. 20171060) under Watex Quality Certification No. 4097 and under the Tar-Pamlico Buffer Rules (for
the Silver Lake facility only}. Any violation of the Certification approved by DWR shall be considered a
violation of this CAMA permit.
NOTE: The U.S. Army Corps of Engineers has assigned the project Actian ID No. SAW-2017-01751.
16) This Major Modification does not eliminate the need to obtain any additional permits, approvals or
authori�atians that may be required.
17) This Major Modification shall be attached to the original of Permit No. 224-87, which was issued on
11/20187, as well as all subsequent modifications, renewals and Ietters of refinement, and copies of a11
documents shall be readily available on site when a Division representa.tive inspects the project for
compliance.
18) All canditions and stipulations of the active permit remain in force under this Major Modification unless
� altered herein.
NOTE: A majar modification application processing fee of $475 was received by DCM for this project.
This fee also satisfied the Section 401 application processing fee requirements of the Divisian of
Water Resources.
