9. PROTECT DESCRIPTION
The project site is located at 1901 Seaside Road (State Road 1162), adjacent to the Atlantic Intracoastal
Waterway (AIWW), between Sunset Beach and Ocean Isle Beach, Brunswick County. To find the property,
take Highway 17 south from Wilmington towards Sunset Beach. Turn left at Grissettown on N.C. Highway
904 and travel approximately 3.6 miles. Cross over N.C. Highway 179 and continue along Seaside Road
approximately 0.4 miles and the subject property will be located on the left side of Seaside Road. The
subject property is bordered by residential properties to the north, east and west. The AIWW borders the
property to the south.
The subject property consists of approximately 10.6 acres which is divided into 11 residential lots, each
varying in size from approximately 0.56 acres to 1.96 acres with a combined shoreline frontage of
approximately 516 linear feet. Existing structures on the property consist of a residential structure,
driveway and wooden bulkhead. The subject property averages approximately 5 feet above Normal High
Water (NHW). High-ground vegetation on the tract consists primarily of lawn grasses, Longleaf Pine
(Pinus palustris), Oak (Quercus spp.) and Southern Wax-myrtle (Myrica cerifera). Coastal marsh
vegetation, consisting primarily of Smooth Cordgrass (Spartina alterniflora) exists along the southern
shoreline, on the waterward side of the existing bulkhead. The marsh area adjacent to the site ranges in
width from approximately 45 to 65 feet.
The waters of the project site are classified as SA by the NC Division of Water Quality. The NC
Division of Marine Fisheries has designated this area of AIWW as a Primary Nursery Area, and the
waters adjacent to the proposed project are CLOSED to the harvesting of shellfish.
PROPOSED PROJECT
The applicant is proposing to construct a pier, covered platform and 2 floating docks. As proposed, the
pier (155' x 6') would originate on Lot 5 and would extend waterward from the existing bulkhead
approximately 155' in a southerly direction (see Sheet 5 of 9). The pier would span coastal wetlands
consisting primarily of Smooth Cordgrass (Spartina alterniflora) measuring approximately 65' in width
and terminate in a fixed 20' x 20' covered "T-Head" platform (see Sheet 6 of 9). The platform would be
located over open water, approximately 70' from the waterward edge of the coastal marsh. As proposed
there would be 2 floating docks, one on the west side and one on the east side of the "T-Head" platform
each measuring approximately 118' in length by 6' in width, each would be aligned parallel to the
shoreline and the established channel of the AIWW (see Sheet 6 of 9). The floating docks would be
connected to the "T-Head" by a ramp measuring approximately 14' in length by 4' in width. Water
depths in the vicinity of the proposed floating docks range from approximately -0.5' to -1.5' @ Normal
Low Water (NLW) and therefore, the applicant is proposing to install "stops" on the floating docks in
order to maintain 18" of clearance from the substrate (see Sheet 7 of 9). The application also states that
there will be handrails placed on the landward side of the floating docks to prevent vessels from tying up
(see Sheet 7 of 9) and that all slips will be for temporary/transient dockage. As proposed, the structure
would provide dockage for 10 vessels.
The applicant is proposing to access the pier and docks via a natural, grassed driveway and turnaround
area, which would be demarked by wooden stakes and rope. The driveway area would measure
approximately 379' in length by 18' in width and would connect to the existing driveway located in front

of the existing residential structure. The turnaround area would measure approximately 125' in length by
68' in width with a portion of the turnaround located within the 75' Estuarine Shoreline AEC and
landward of the 30' coastal shoreline buffer (see Sheet 5 of 9).
10. ANTICIPATED II PACTS
The proposed driveway and turn around area would encompass approximately 14,039 sq. ft. of high
ground area, of which approximately 3,750 sq. ft. would be located within the 75' AEC. The proposed
access pier would result in the shading of approximately 390 sq. ft. of coastal wetlands. The proposed
docking facility would incorporate approximately 2,236 sq. ft. of estuarine waters and public trust area.
The proposed docking facility would extend approximately 90 feet into a waterbody that measures
approximately 481 feet across. This distance conforms to the 1/4 width rule, would not encroach into the
U.S. Army Corps of Engineers 80' Federal Channel Setback and would also meet the 15' Riparian
Corridor Setback. Minor increases in turbidity should be expected during construction.

Seaside Holdings LLC - Applicant
The subject tract is located at the end of SR 904, Seaside Landing Rd., where it
intersects the AIWW. This area is locally known as Seaside Landing and is located
between Sunset Beach and Ocean Isle Beach, Brunswick County. Currently, there
is a single story house and driveway located on the tract. The property is
approximately 10.6 acres comprised of 11 lots owned by Seaside Holdings, LLC.
Waters in the vicinity of the property are designated as SA, HQW (high quality
waters) and are considered primary nursery area by the by the North Carolina
Environmental Commission (ECM).
The applicant proposes to construct a fixed pier (161'x 6'), a 20'x20' gazebo, and
two 6'x118' floating docks along the AIWW. No permanent dockage is proposed and
only canoes, kayaks, small runabouts, or jet skis are approved for usage. Depths at
the waterward end of the floating docks are approximately -1.5 feet MLW. No
dredging is proposed and floating docks will be prevented from resting on the bottom
substrate by installing `stops' at 18' above existing grade. All dock structures will be
elevated a minimum of 3' above any wetlands.
Parking for vehicles and trailers will be provided at the existing driveway attached to
the single story house already on site. Upland development proposes a grass
access drive and turnaround to be provided through the tract for unloading and
loading of supplies and canoes. This access drive and turnaround will be
maintained as grass and demarcated by wooden stakes and rope. No new
impervious surface is proposed for this access drive. A low density Stormwater
Permit Application Form has been submitted to NCDWQ (29 September 2008) along
with this application package.
