(1 Fe 6 el, 7 i 9 North Carolina Wildlife Resources Commission 9 MEMORANDUM TO Cathy Bnttmgham Division of Coastal Management FROM Travis Wilson, Highway Project Coordinator Habitat Conservation Program DATE October 2, 2008 SUBJECT NCDOT request for a LAMA/ Dredge and Fill permit for the replacement of bridge 103 over Runyon Creek on NC 32, in Beaufort County We have reviewed the information included in the package received from the Division of Coastal Management Our comments are provided in accordance with provisions of the Fish and Wildlife Coordination Act (48 Stat 401, as amended, 16 U S C 661 et seq ) and the Coastal Area Management Act (G S 113A-100 through 113A-128) We do not object to the issuance of the CAMA permit for this project provided that the following conditions are included in the CAMA Permit 1 All nprap placed in-water should be free of pollutants and soil 2 Live concrete should not be allowed to contact the water in or entering into the stream 3 Turbidity curtains should be used to contain all bottom disturbing activities, including pile or casement driving/vibrating/jetting, placement of nprap, excavation or filling Excessive silt and sediment loads can have numerous detrimental effects on aquatic resources including destruction of spawning habitat, suffocation of eggs, and clogging of gills of aquatic species 4 The February 15 to September 30 in water work moratorium listed in the permit application is no longer valid The revised dates for the in water work moratorium are February 15 to June 15 NCDOT is expected to use Best Management Practices for the protection of Surface Waters and Sedimentation and Erosion Control measures sufficient to protect the aquatic resources Mailing Address: Division of Inland Fisheries • 1721 Mail Service Center • Raleigh, NC 27699-1721 Telephone: (919) 707-0220 • Fax: (919) 707-0028 Memo 2 February 6, 2003 Thank you for the opportunity to comment on this permit application If you have any concerns about our comments, please contact me at (919) 528-9886 Cc Stephen Lane, DCM David Wainwright, DWQ William Wescott, USACE
